HomeMy Public PortalAboutM 1947-05-06 - CC REGULAR MEETING MAY 6, 194? The City Council of the City of Lynwood met in a regular session in the City Hall, 11331 Plaza Street on above date at ?:30 P. M. Mayor Doty in the chair. Councilmen Doty, Jensen, Shrock, Wiggins, and W111iams answered the roll call. It was moved by Councilman Shrock, seconded by Councilman Williams, that the minutes of the previous regular meeting of April 15, 1947, be approved as written. All members of the City Council present voting aye, the Mayor declared the motion duly carried. A communication from the American Legion Auxiliary was presented, requesting permission for poppy sales May 23 and 24. It wa~hnoved by Councilman Williams, seoonded by Councilman Shrock, that said permission be granted to the American Legion and to the Veterans of Foreign Wars for poppy sales on the above mentioned dates., All members of the City Council present voting aye, the Mayor decslared the motion duly .carried. The hour of 8:00 P. M. having arrived, said hour being the time fixed for receiving any and all bids for furnishing asst iron pipe, the Mayor inquired if there was anyone present .wishing to submit a bid. There was no response. The Clerk stated he had received four bids. It was moved by Councilman Williams, seconded by Council- man Jensen, that the bids be publicly opened, examined, and declared. All members of the City Council voting aye, the Mayor declared the motion duly carried. The following bids were received: ' U.S.Pipe & Pacific States American Cast National Cast Foundry, Cast Iron Pipe Iron Pipe Iron Pik, 6" Pipe 1.285 No Bid 1.314 .3 5 It was moved by Councilman Wiggins and seoonded by Council- man Shrock, that the bids be referred to the Acting City Manager for checking and report thereon. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication from the Lynwood Chamber of Commerce was read wherein they request certain parking regulations be adopted. It was moved by Councilman Wig~xins, seconded .by Councilman Jensen, that the communication be referred to the Chief of Police for a report thereon. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication from the Veterans'_of Foreign ware oi' Lynwood was read expressing appreciation for the dedication of the gun in Lynwood Memorial Park. It was moved by Councilman Shrock, seoonded by Councilman Wiggins, that the communication be filed. All members of the City Council voting aye, the Mayor declared the motion duly carried. Two communication from the Lynwood Junior High School P.T.A. and the Wilson P.T.A. were read, wherein they expressed their feelings that the present crossing guard system should be maintained and that there should be no change to juvenile patrols. It was moved by Councilman Shrock, seconded by Councilman Williams, that the communication be filed. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication from F. B. MoCall,,Superintendent of Lynwood Schools, was read, enclosing a carbon copy of his letter to Chief Kerr and bringing to the Council's attention the condition brought .about by vandalism activities of Lynwood youth. Also, a communication was read from James R. Osment expressing the same points and listing cases. A progress report on the Police investigation of the van- dalism case at Central School by Chief Kerr was read. There was further discussion Prom the floor wherein Mr. Osment brought out the damages in this one case amount to X644.56 and that as a taxpayer he .thinks something should definitely be done to avoid any recurrence of this type of activity. Thereupon, it was moved by Councilman Wiggins, seconded by Councilman Williams, that the School Board and Superintendent of Schools be invited to meet with the Council and Police Chief in an ____ ~U effort to work out some solution of this recurring condition of juvenile vandalism and that the Clerk be instructed to arrange such a meeting. All members of the City Council voting aye, the Mayor declared the motion duly carried. RESOLUTION NO. 2041, entitled, "RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DECLARING ITS INTENTION TO VACATE CERTAIN PORTIONS OF PENDLETON AVENUE," was read. It was moved by Councilman Wiggins, seconded by Councilman Jensen, that said Resolution be adopted. Roll Call: Ayes: Conncilmen Doty, .Jensen, Shrock, Wiggins,. and Williams. Noes: None. An Ordinance entitled, "AN ORDINANCE OF THE CITY OF LYNSYOOD AMENDING ORDINANCE N0. 422, COMMONLY KNOWN AS THE ZONING ORDINANCE, BY ADDING A DEFINITION THERETO," was read for the first time.- After some discussion, it was moved by Councilman Williams, seconded by Councilman Shrock, that said ordinance be accepted as read the first time and pass to the second reading. Rall Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. The ublic official bond•of Channcey K, McHenry, Jr. in the amount of•1,000.00 as bail clerk was presented. It was moved. by Councilman Shrock, seconded by Councilman Jensen, that said bond be accepted and filed. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. The Clerk presented two grant deeds dated April 23, 1947 and sighed by Myrtle H. Anderson whereby she conveys her interest in and to the Westerly 20 feet of Parcel 52 as shown on Licensed Surveyor's Map recorded in Book 16 Page 37, Records of Surveys, Los Angeles County, California, to the City of Lynwood. It was moved by Councilman Wiggins, Seconded by Councilman Jensen, that the deeds be accepted and that the City Clerk be directed to cause said instruments to be recorded in the Office of the Recorder of Los Angeles County. Noes: None. The Clerk presented Judgment Quieting Title. It was moved by Councilman Wiggins, seconded by Councilman Jensen, that said instrument be accepted and that the City Clerk be directed to cause same to be recorded in the Office of the Recorder of Los Angeles County. - Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. The Clerk presented several•grant deeds and a recommenda- tion of the City Engineer as to their acceptance for the opening of Nedra Street between Pendleton and Abbott Road. After some dis- cussion with the City Attorney as to the contingencies of acceptance, it was moved by Councilman Williams and seconded by Councilman ~~ Shrock,. that said matter be referred to the Planning Commission for its action and report thereon. All members of the City Council voting aye, the Mayor declared the motion duly carried. A communication from theChamber of Commerce was presented wherein they request some action as to the improvement or removal of the high board fence at the southwest corner of Abbott Road -and Atlantic Avenue. After some discussion, it wag moved by Councilman Jensen and seconded by Councilman Shrock, that said matter be referred to the Attorney for a report as to the City's responsibility. All members of the City Council voting aye, the Mayor declared the motion duly carried. • The Clerk requested permission to advertise for bide on mobile two-way radio to be installed in the car of the Chief of Police. It was moved by Councilman Shrock, seconded by Councilman Jensen, that said authorization be granted. All members of the City Council voting aye, the Mayor declared the motion duly carried. The Clerk further requested permission to advertise for bids to provide the City with decal insignia to be applied to the equipment. It•was moved by Councilman Jensen, seconded by Councilman Williams, that said authorization be granted. All members of the City Council voting aye, the Mayor declared the motion duly carried. A request from Officer William Oeller for a 90-day leave of absence was presented. There has been no established policy on leaves of absence and after some discussion, it was moved-by Council- man Wiggins, seconded by Councilman Shrock, that said leave of absence of 90 days be approved, commencing May 31, 1947. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. ORAL COMMUNICATIONS: R. D. Hamilton, 3565 Mulford Avenue, addressed the Council in regard to the parking problem on Mulford Avenue, requesting some solution which in his mind was only one thing, widening of Mulford Avenue. He pointed out that the situation is quite undesirable owing to the church activities and the City Park's gain in popularity and resultant traffic. Mr. Middleman, 3538 Mulford Avenue, expressed similar opinions about the disagreeable condition on Mulford. Also, Mr. Louis Barrard, 3525 Mulford, in addition to the traffic, complained of the noise•and confusion at Late hours from the church property. At•the conclusion of the discussion, it was moved by Councilman Jensen, seconded by Councilman Wiggins, that the Chief of Police be instructed to check into the problem and that one measure be taken imm8diately, that of continuing the present red curb the full length .to Birch Street. All members of the City Council voting aye, the Mayor declared the motion duly carried. The Clerk presented a home occupation application from Charlotte C.~Garrity for a dressmaking business at 3171 Beechwood Avenue. All. the provisions of Ordinance No. 443 having been complied with and no objections received, it was moved by Councilman-Williams, seconded by Councilman Shrock, that said application be granted. All members of the City Council voting aye,•the Mayor declared the motion duly carried. Also a home occupation application wa8 received Prom Charles P. Fitzpatrick, M. D., asking permission to conduct his offiee•of- neurology specialist at 3313 Burton Avenue. The provisions of Ordinance No-.443 were complied with and resulted in two objections, one as to parking conditions on the narrow street and the other from a neighbor in regard to his type of practice, objecting to neurotics being brought into a residential neighborhood. • After some discussion with Dr. Fitzpatrick, it was moved by Councilman Wiggins, seconded by Councilman Shrock, that said appli- cation be denied. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and William8. Noes: None. • Final Tract Map No. 13407 was presented. After some dis- cussion, it was moved bye Councilman Williams, seconded by Councilman Jensen, that the map be approved and that the streets and alleys ~3 Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. offered therein be accepted subject to the following provisions: The filing and approval of a faithful performance bond in the amount of X48,200.00 guaranteeing the construction of sidewalks, curbs, gutters, pavement, sewers, and water lines and the filing and acceptance of a bond or policy of insurance in the amount of X5,000.00 P/D and ~10,000/~20,000 P/L, indemnifying the City against possible damage suits during the construction period. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Wiggins, and Williams. Noes: None. Final Tract Map No. 14636 was presented. It was moved by Councilman Wiggins, seconded by Councilman Jensen, that the map be approved and that the streets and alleys offered therein be accepted subject to the following provisions: The filing and approval of a faithful performance bond in the amount of X10,600.00 guaranteeing the construction of sidewalks, curbs, gutters, pave- ment, sewers, and water lines and the filing and acceptance of a bond or olicy of insurance in the amount of $5,000.00 P/D and ~10,000/~20,000 P/L, indemnifying the City against possible damage suits during the construction period. As held over Prom the last meeting for further study, the Council again considered the Planning Commission's recommenda- tion for variance cf rear yard requirements as presented by George Kennedy for Enes Santi. After some discussion wherein possible discrepancies that might arise Prom lack of single ownership oP the properties involved in the granting of such a variance were considered, it was moved by Councilman Jensen, seconded. by Council- man Shrock, that said variance be denied.
