City Hall, 11331 Plaza Street, on above date at 7:30 p . m. Mayor Willard in the chair. Councilmen Bruner, Jensen, Stroh, Willard, and Williams, answered the roll call. It was moved by Councilman Williams, seconded by Councilman Stroh, that the minutes of the previous regular meeting of Jul 19 199, be approved as written. All members voting aye, the Mayor de- clared the motion duly carried. The hour of 8:00 p. m. having arrived, said hour being the .time fixed to receive any and all bids for furnishing the City's gaso- 11ne. requirements for the coming year, the Mayor inquired if there were any present wishing to present bids. There was no response. The Clerk stated he had received 8 bids. It was moved by Councilman Williams, seconded by Councilman Stroh, that said bids be publicly opened, exa mined, and declared. All members voting aye, the Mayor declared the motion duly carried. All members voting aye, the Mayor declared the motion duly carried. The Mayor inquired if there were any oral communications. Whereupon, Mr. Harold Downs, 3355 Alma Avenue, addressed the Council in regard to the buildings to be moved into Licensed Surveyor's Tract .on Benwell Drive, stating that he represented the people in that ar-ea and objected to the project as the buildings are old and shabby and reminiscent of the bootleg era and that there is nothing. to assure workmanlike rebuilding upon arrival. Mr. Downs requested the petition that had been filed to be presented to the Council. Whereupon, the Clerk read the petition. Mr. Harrison of 7917 West Norton Avenue, Hollywood, owner of the property and buildings, addressed the Council, stating he• had checked the petitioners and found that hardly any of them had seen the buildings or knew what they were signing. The Council as~sed the Building Inspector to explain the conditions. Mr. Hall stated he had inspected the buildings and found them to be sound and in compliance with all City codes and ordinances. The Clerk was requested to read the various reports. Whereupon, the Buildings Inspector's pre-location report, expert testimony of Almas Housemovers, and Robin A. Graves, Engineer, were read, all stating that the buildings were above requirements. There was additional discussion wherein Mr. George Kennedy, local attorney, addressed the Council, stating that his interest in this matter was to see that proper procedure was carried out and ordinances complied with. He further stated his investigation dis- closed, in his opinion, that the ordinances had not been complied with. The City Attorney pointed out that in his opinion nothing could be done in regard to this case but suggested that an amendatory ordinance be prepared that would incorporate procedure to notify neighbors of proposed relocations in the future. Whereupon,. it wa8 moved by Councilman W illiame, aec~nded by Councilman Bruner,, that upon advice of the City Attorney that the petition be filed. All members voting aye, the Mayor declared the motion duly carried. 3~~ It was moved by Councilman Williams, seconded by Councilman Bruner, that the Attorney be instructed to prepare an amendatory or- dinance incorporating neighborhood notification in the event of build- ing relocations. All members voting aye, the Mayor declared the motion duly carried. The Mayor inquired if there were any other oral communications. Mr. Foley, 3282 Flower Street, addressed the Council regard- ing the possible widening of Flower Street and also, that the unsightly and possibly unsanitary condition in the rear oP Von~s Market be inves- tigated. There was discussion wherein it was moved by Councilman Stroh, seconded by Councilman Williams, that the Engineer be instructed to prepare a survey and report on probable costs, policy, and proce- dure toward widening all of the narrow streets, Por the next meeting. All members voting-aye, the Mayor declared the motion duly carried. Ira Presson, 11016 Bullis Road, addressed the Council re- garding building-code enforcement, citing the case of a substandard housing condition near him and that the occupant had been allowed to maintain occupancy contrary to ordinance. The Building Inspector explained the history oP the ease and that owing to the nature of it, the veteran and his wife and child had been shown leniency but were on notice that they must start construc- tion to conform by September 1. There was additional discussion as to strict enforcement in these cases wherein the City Attorney pointed out the inability of any officer oP the City to waive any ordinance re- quirement s. . Whereupon, it was moved by Councilman Williams, seconded by Councilman Stroh, that the Building Inspector be instructed t© enforce the building code to the letter of the law. All members voting aye, the Mayor declared the motion duly carried. A communication Prom the Loa Angeles City Council in regard to beach development report invitation was read. It was moved by Coun- cilman Williams, se conded by Councilman. Stroh, that said communication be Piled. All members voting aye, the Mayor declared the motion duly carried. A communication from Paul Gillman tendering his resignation as a member of the Lynwood Recreation Commission, was read. It was moved by Councilman Williams, seconded by Councilman Stroh, that res- ignation be accepted with regrets and appropriate letter sent. All members voting aye, the Mayor declared the motion duly carried. A communication Prom Missionary Church Association, Western Division, was read wherein they request permission for tent Por tem- porary church purposes on their property on Carlin Avenue near the new Caress Street grammar school. There was discussion on policy in these matters wherein it was moved by Councilman Stroh and seconded by Councilman Bruner, that a 60-day permit be granted with no provision for extension. All members voting aye, the Mayor declared the motion duly carried. • Communication from Martin McDonald, Secretary oP the Chamber of Commerce was read wherein he informed the Council of his resignation and extended his thanks Por cooperation during his term of office. It was moved by Councilman Stroh, seconded by Councilman Bruner, that said communication be Piled. All members voting aye, the Mayor de- clared the motion duly carried. Communication was read Prom the Lions Club in regard to the Rose Parade float participation by the City of Lynwood, wherein they stated their inability to handle the project as an individual club and requested the City oP Lynwood to consider it as a city function. There was a discussion as to procedure to follow in such mat- ters oP publicity wherein it was decided that all such pro,~ects should clear through the. Chamber oP Commerce as representing the entire city and being the proper organization for municipal promotional activities. Whereupon, it was moved by Councilman Bruner, seconded by Councilman Stroh, that the Lions Club be instructed to refer their re- quest to the Chamber of Commerce for action. All members voting aye, the Mayor declared the motion duly carried. A letter Prom the Chamber oP Commerce was read wherein they requested and urged Favorable action by the City Council as to the proposed annexation oP property east oP Wright Road near the Pacific Electric right of way. It was moved by Councilman Williams, seconded by Councilman Stroh, that said fetter be filed. Whereupon, RESOLUTION N0. 2228 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING REPORT OF THE CITY ENGINEER AND FIXING TIME OF HEARING IN THE MATTER OF THE PROPOSED IM- PROVEMENT OF SAN LUIS AVENUE ET AL BY THE CONSTRUCTION OF SANITARY SEWERS" was presented. It was moved by Councilman W111iams, seconded by Councilman Stroh, that said resolution be adopted. Roll Call: Ayes: Councilmen Bruner, Jensen, Stroh, Willard,. and Williams. Noes: None. ORDINANCE N0. 503 entitled "AN ORDINANCE AMENDING ORDINANCE N0. 422 FOR THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY AND THE ADOPTION OF AN AMENDED SECTION OF THE ZONING MAP WHICH IS A PART OF SAID ORDINANCE N0. 422" was read by caption. (Fletcher-Platt Ave.) It was moved by Councilman Williams, seconded by Councilman Bruner, that further reading be waived. All member$ voting aye, the Mayor declared the motion duly carried. It was .moved by Councilman Bruner, seconded by Councilman Williams, that said ordinance be adopted as read for the second time, finally pass and be published as required by law. Roll Call: Ayes: Councilmen Bruner, Jensen, Stroh, Willard, and Williams. Noes: None. Recommendation from the Chief of Police in regard to pro- posed ambulance agreement with the County of Los Angeles was read, wherein he recommended that owing to the problems involved in emer- gency services, that the. agreement be entered into. The City Attor- ney pointed out that the agreement had a 30-day cancellation clause in the event it didn~t work out in the City~s interest and therefor, would be safe to enter into. he further requested statement of policy by the Council in regard to paying doctor's bills incurred by Police Department origin, stating that there have been several emergency house calls made as a result of citizens calling the Police Department for medical aid, thereafter the doctor being unable to collect and pre- senting bills to the City. There was considerable discussion in regard to this mat- ter wherein the Chief of Police explained the problem as it affected his department. Whereupon, it was moved by Councilman Williams, seconded by Councilman Stroh, that a policy-be adopted honoring doctors bills only where the City is directly involved in course of duty of either the fire or police departments, and that a letter be sent to the Medical Association so informing them and. requesting their cooperation in seeing that emergency calls are handled. All members voting aye, the Mayor declared the motion duly carried. There was additional discussion in regard to the ambulance agreement wherein Councilman Williams pointed out the danger in allocating too much of a municipalities' authority to the County, particularly in light of Richard Graves., of the League, recent discussion. However, owing to the 3o-day cancellation clause, this particular agreement might not be too dangerous. Whereupon, it was moved by Councilman Bruner and seconded by Councilman Stroh, that as per recommendation of the Chief of Police the agreement be approved and the Mayor and City Clerk be authorized to execute same. It was moved by Councilman Williams, seconded by Council- man Stroh, that an ordinance amending Ordinance No. 305 in regard to permissible uses in certain zones, be .ref erred to the Planning Com- mission Por investigation and report. An ordinance entitled "A N ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, RELATING TO DISASTER; MAKING PROVISION FOR THE ORGANI- ZATION AND FUNCTIONING OF A DISASTER ORGANIZATION AND COUNCIL; AND REPEALING ALL ORDINANCES AND PARTS_OF ORDINANCES IN CONFLICT THERE- WITH" was read for the first time. It was moved by Councilman V~~ Williams, seconded by. Councilman Stroh, that said ordinance be accepted as read for the fir8t time and pass to the second reading. All members voting aye, the Mayor declared the motion duly carried. Councilman W1111ams discussed a condition that exlats in the Recreation Commission ordinance wherein there is no statement-as to time or place of a regular meeting by said commission. It was moved by Councilman Williams, seconded by Councilman Stroh, that the Attorney be instructed to prepare an amendatory ordinance stating that no less than one meeting per month be held and stating the place where such meeting shall be held. All members present voting aye, the Mayor de- clared the motion duly carried. Councilman Williams stated he wished an explanation as to why a large order of Rensselaer valves was placed without formal bid, said order being in excess oP the X1000 limitation. The Engineer not being present, it was moved by Councilman Williams, seconded by Councilman Stroh, that the demands for said pur- chase be held pending a report by the Engineer on said purchase. All members voting aye, the Mayor declared the motion duly•earried. It was further moved by Councilman Williams, seconded by Councilman Bruner, that a monthly list of the demands be-published in the Lynwood Press, the legal publication. All members voting aye, the Mayor declared the motion duly carried. It was regularly moved by Councilman.Williams, seconded by Councilman Bruner, that the demands presented at the meeting of August 2, 1949, having been regularly audited, are hereby allowed.and approved and warrants ordered drawn on the City Treasurer therefor in accordance with and to the payees named and the Funds indicated in the several de- mands hereby approved. There was discussion on the problem wherein it was moved by Councilman Stroh and seconded by Councilman Williams, that the old men be referred to the recreation building on Birch Street and the maintenance Facilities presently occupying said building be moved to other quarters and that steps be taken to move the old menus shed.
