OTHER MOBILE HOME/MANUFACTURED UNITS, AND AMENDING CHAPTER 6 OF TITLE 9 SECTIONS 9.6.02 (A) 3, (C) AND (T), AND 9.6.05 (D)6.b., AND CHAPTER 7 OF TITLE 9 SECTION 9.7.06 (C) ENVIRONMENTAL AND AESTHETICS, ALL OF WHICH AMENDMENTS PROVIDE FOR THE CREATION OF A NEW BUSINESS PARK ZONE AND/OR TO ACCOUNT FOR THE NEW BUSINESS PARK ZONE REGULATIONS. WHEREAS, this ordinance is a combination of two separate code amendment applications (one to create the Business Park Zone (CA-10-08); one to make the appropriate references throughout the Code to the new Business Park Zone (CA-11-01)); and WHEREAS, pursuant to MCC 3.13.04, an application (CA-10-08) for the code amendment creating the new Business Park Zone was initiated by the City of McCall on October 8, 2010; and Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 1 of 25 March 24.2011 WHEREAS, the McCall Area Planning and Zoning Commission held a properly noticed and regularly scheduled public hearing on October 5 and November 2, 2010 to consider the code amendment creating the new Business Park Zone; and WHEREAS, at the November 2, 2010 meeting the McCall Area Planning and Zoning Commission recommended the code amendment creating the new Business Park Zone for approval by the McCall City Council; and WHEREAS, the McCall City Council held a properly noticed public hearing on November 18, 2010 to consider the proposed code amendment; and WHEREAS, the McCall City Council continued the public hearing to a date certain of January 27, 2011 to allow staff to make minor revisions. WHEREAS, pursuant to MCC 3.13.04, an application for the code amendment making the appropriate references to the newly created Business Park Zone was initiated by the City of McCall on January 24, 2011; and WHEREAS, the McCall Area Planning and Zoning Commission held a properly noticed and regularly scheduled public hearing on March 1, 2011 to consider the code amendment making the appropriate references to the new Business Park Zone; and WHEREAS, at the March 1, 2011 meeting the McCall Area Planning and Zoning Commission recommended the code amendment making the appropriate code references to the new Business Park Zone for approval by the McCall City Council; and WHEREAS, at a regularly scheduled meeting on March 24, 2011 the McCall City Council conducted a public hearing on both of the aforementioned code amendments and recommended both amendments for approval. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McCALL, IDAHO, AS FOLLOWS: Section 1: McCall City Code Section 3.5.01 is amended with the following changes: 3.5.01: PURPOSE: The McCall area comprehensive plan identifies the importance of a variety of land uses including industrial and business park areas. It is the purpose of this chapter to implement the plan's vision through development regulations that permit industrial and business park uses that will support the diversification of a growing economy and yet are not detrimental to any abutting uses. Furthermore, industrial and business park activities shall not interfere with the operation of Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 2 of 25 March 24.2011 the airport or any transportation facility. The industrial zone and business park zone allows residential uses at a maximum of forty (40) dwelling units per acre. Section 2: McCall City Code Section 3.5.05 is created as follows: 3.5.05: BUSINESS PARK USE REGULATIONS: The intent of the Business Park Zone is to provide an ideal zone to attract and accommodate new, high-quality, stable businesses and light industries that will foster economic growth and diversify the economy of McCall. It is critical that all development within this zone be held to a level of quality that enhances the area as a whole and creates an attractive and desirable environment within the Business Park. (A) Business park subzones: To minimize the impacts of Business Park Zone activities where the zone abuts an existing residential zone, there are two sub-zones within the Business Park Zone. The BP-Exterior zone is located within the first 200 feet of the perimeter of the Business Park property where it abuts an existing residential zone. The purpose of this sub-zone is to limit uses to those that will have limited impact on adjacent properties. The more intense uses that are likely to have greater impacts of noise, vehicular traffic, and activity shall be located in the BP- Interior sub-zone which is located on the interior portion of the site and along boundaries adjacent to properties with similar permitted uses. (B) The intent of the business park use regulation is to: 1. Allow a wide variety of uses that are compatible with each other; and 2. Attract high quality businesses and industries; and 3. Encourage uses that may not be appropriate in the Central Business District, Community Commercial, or Industrial zones; and 4. Minimize impacts on adjacent residential zones. (C) Permitted And Conditionally Permitted Uses: The uses identified in table 3.5.05 of this section, uses within business park zones, shall be the primary uses allowed to occur on a property. All uses not listed in table 3.5.05 of this section require review by the Commission and a conditional use permit. The primary uses identified in table 3.5.05 of this section may be permitted or conditionally permitted as indicated: P: Where the symbol P appears, the use shall be permitted. C: Where the symbol C appears, the use may be permitted subject to the issuance of a conditional use permit in accordance with section 3.13.03 of this title. Where no symbol, or a dash, appears, the use is not permitted. Dwelling units must be part of a mixed-use project and only permitted on upper floors. The maximum allowed density is 40 units per acre. 2. Ancillary uses are secondary uses and activities that are associated with and support the primary use. They typically require a minor portion of the square footage of the space of the primary use. 3. All outdoor storage areas shall be completely screened from view from any adjacent street. Section 3: McCall City Code Section 3.5.06 is created as follows: 3.5.06: BUSINESS PARK ZONE GENERAL DEVELOPMENT STANDARDS: (A) Except as modified below, all development shall comply with the McCall City Code, Title 3, Chapter 8, General Development Standards. Allow adequate space for vehicle and pedestrian circulation 2. Allow compact development and efficient use of site 3. Protect solar access to adjacent properties 4. Orient buildings and pedestrian entrances to the street 5. Provide a transitional buffer from adjacent residential zones 6. Provide flexibility to allow for innovative and creative design solutions 7. Building height and footprint allowances in the BP-Interior subzone may be increased to the maximum indicated with the issuance of a conditional use permit. Approval of the CUP will be considered if the proposed development provides significant, attractive and functional civic space for public use and/or provides superior architectural design elements such as those recommended by Leadership in Energy & Environmental Design (LEED) or another design standard. Buildings greater than 35' are subject to the stepback standards of MCC 3.8.14. 2. Individual lots may have multiple buildings in a"campus" configuration. With a CUP the minimum front setback may be reduced to 0' to accommodate pedestrian oriented architectural features such as a store front, vestibule, open-air lobby, etc. 4. At least one primary building entrance or other pedestrian building element shall be built within fifteen feet (15') of the front property line in the BP-Interior subzone. An exception to this build-to line may be granted through design review when the project contains pedestrian amenities between the primary building entrance and the front property line. Pedestrian amenities including parks and plazas are allowed and encouraged. (C) Design review is required for all developments within the Business Park Zone as provided for in Chapter 16 of the McCall City Code. Section 4: McCall City Code Section 3.5.07 is created as follows: 3.5.07: PUBLIC IMPROVEMENTS: Except as modified below, all public improvements including streets, sidewalks, pathways, and utilities shall be in accordance with the McCall City Code, Title 9, Chapter 6, Subdivision and Development Improvement Requirements. (A) All streets and alleys within the Business Park Zone shall be constructed per City standards and shall be located in a platted public right of way. (B) A minimum 6' wide concrete sidewalk is required on both sides of all interior streets. Secondary access ways and alleys may have sidewalks where appropriate however they are not required. A minimum 10' wide asphalt multi-use pathway is required around the perimeter of the Business Park. An easement may be required if the pathway does not fit within the right of way. Crosswalks shall be provided at all intersections for all sidewalk and pathway crossings. Crosswalks may be painted or constructed of an alternate paving material such as concrete or precast pavers. (C) The following figures are typical cross sections of all improved streets within and adjacent to the Business Park Zone. These street cross sections are designed to provide: 1. Sufficient travel way for passenger cars and truck traffic 2. Adequate space for snow storage 3. Street side swales for drainage, infiltration and stormwater quality 4. KRAHN LANE CROSS SECTION (SIMILAR TO CA Tr Cr MCCALL STANDARD ARTERIAL SECTlCPI) Section 5: McCall City Code Section 3.5.08 is created as follows: 3.5.08: HOURS OF OPERATION AND NOISE RESTRICTIONS: (A) Hours of operation of businesses within the Business Park are not restricted except that any activities that produce plainly audible noise in excess of the following levels shall not be permitted. The intent of this requirement is to: 1. Reduce the impact of Business Park activities on surrounding residential areas. 2. Reduce the impact of the Business Park on other businesses and live work units within the Business Park. (B) No business activities shall produce regular or continuous noise that is excessively annoying, loud, or unusual. Noise that is produced for no more than a cumulative period of 5 minutes in any daylight hour may occur for the daytime hours (8:00 AM to 8:00 PM) Section 6: McCall City Code Section 3.5.09 is created as follows: 3.5.09 PLANNED UNIT DEVELOPMENT REQUIREMENTS: Planned unit developments are permitted in the Business Park Zone and can be applied to individual lots or a contiguous area consisting of multiple lots. Any proposed planned unit development shall be in accordance with the McCall City Code, Title 3, Chapter 10, Planned Unit Developments. Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 9 of 25 March 24.2011 Section 7: McCall City Code Section 3.5.10 is created as follows: 3.5.10 VEHICLE AND BICYCLE PARKING: Parking for vehicles and bicycles shall be provided in accordance with the McCall City Code, Title 3, Chapter 8, General Development Standards. Section 8: McCall City Code Section 3.5.11 is created as follows: 3.5.11 ARCHITECTURAL: All developments within the Business Park Zone shall comply with the "City of McCall Design Guidelines" with regard to architectural improvements. Section 9: McCall City Code 3.5.12 is created as follows: 3.5.12 LANDSCAPING: (A) Purpose: Except as modified below, all developments within the Business Park Zone shall comply with the "City of McCall Design Guidelines" with regard to landscape improvements and irrigation systems. The purpose of this section is to: 1. Reduce water use requirements on the property 2. Increase the visual interest and natural look of the Business Park 3. Provide a buffer between the Business Park and the surrounding residential areas 4. Encourage the use of native species 5. Provide infiltration capacity for the Business Park (B) Perimeter buffer strip: A landscaped perimeter buffer strip and pathway shall be provided on perimeter streets. Plant materials shall be native or adaptive species with low water requirements. The overall design shall mimic the natural landscape of the region. A variety of plant materials that include deciduous and evergreen trees and shrubs as well as native grasses and groundcovers shall be used to create an interesting and effective screen of the proposed development. Plant densities shall be sufficient to provide an effective screen within a period of five years. In general, the plant densities shall be 10 shrubs and Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 10 of 25 March 24.2011 3 trees per 1000 square feet of landscape area. Plant quantities can be reduced if larger specimens are provided. (C) Boulders: Native boulders can be added sparingly if they are placed such that they become an integral feature in the naturalistic landscape. (D) Berms: The construction of earthen berms should be considered depending on building structures and topography to add interest and additional buffering from adjacent developments. Berms shall be irregularly shaped into natural forms of varying height and width. Continuous berms of uniform height and width are not permitted. Landscaping shall be designed to blend with adjacent properties to result in a harmonious corridor. See 9.6.02 (S). (E) Gaps in buffer strip: Buffer strip landscaping need not be a continuous solid screen. Gaps and openings may be designed to highlight or frame interesting natural or architectural features or modest signage. Openings may be provided and are encouraged to allow pedestrian accesses from the pathway to pedestrian building entrances adjacent to the buffer. The following illustration shows a typical landscape buffer on perimeter streets. Street trees shall be planted a minimum of 30 feet on center along the entire length of the street. Exceptions to this standard can be considered to accommodate innovative and interesting landscape design alternatives at pedestrian amenities, building entrances, plazas, and parks. Street tree species shall be in accordance with the City of McCall approved species list. See Appendix B. (G) Irrigation: Irrigation systems shall be provided for all new landscapes. The systems should be continuously maintained in a functional condition. Low water consumption irrigation systems are encouraged. Irrigation systems for native landscapes and xeriscapes Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 11 of 25 March 24.2011 may be turned off if plants are well established and remain in a healthy and attractive condition without supplemental water. Section 10: McCall City Code Section 3.5.13 is created as follows: 3.5.13 FENCING: All fencing within the Business Park Zone shall be in accordance with the McCall City Code, Title 3, Chapter 8, General development Standards and the "City of McCall Design Guidelines". Section 11: McCall City Code Section 3.5.14 is created as follows: 3.5.14 OUTDOOR LIGHTING: Except as modified below, all lighting within the Business Park Zone shall be in accordance with the McCall City Code, Title 3, Chapter 14, Outdoor Lighting and the "City of McCall Design Guidelines." In general, site and parking lot lighting should be kept to the minimum required for function and safety. Street lighting shall be kept to a minimum and provided only at main intersections and pedestrian gathering areas such as transit stops and plazas. Consideration should also be given to the design of interior lighting so as not to produce offensive glare on adjacent exterior spaces, especially along public streets. Section 12: McCall City Code Section 3.5.15 is created as follows: 3.5.15 SUSTAINABLE CONSTRUCTION STANDARDS: Projects shall be built to sustainable construction standards. Standards may be defined by Resolution. Incentives for sustainable development that may be considered: (A) Reduced parking requirements for bicycle facilities and showers and transit stop (B) Reduced parking requirements for designated carpool only parking spaces. (C) Increase in allowable impervious lot coverage for green, sustainable practices that reduce stormwater runoff(i.e. rainwater re-use, rain gardens, green roofs). (D) Reduced building permit fees for facilities and practices that significantly reduce water consumption thus reducing the demand on City services. Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 12 of 25 March 24.2011 (E) Allow height and area bonuses for superior architecture, for providing extra civic space, recycling facility space and service or a transit stop, or for master planning two or more contiguous lots. Section 13: McCall City Code Section 3.1.06 is amended with the following changes: 3.1.06: ESTABLISHMENT OF ZONING DISTRICTS: In order to carry out the provisions of this title, the following zones and overlay zones are created for the city of McCall, and the lands within the city are placed into one or more of these zones as depicted on the zoning map or, in the case of overlay districts, as defined in this title. The provisions of this title respecting an overlay district are cumulative with, not in lieu of, the provisions respecting the underlying zoning district. In the event there is a difference between the provisions of this title applied within an overlay district and the provisions of this title applied within the underlying zoning district, the more restrictive provisions will apply. (A) Rural Residential (RR) Zone: See chapter 3, "Residential Zones And Standards", of this title. (B) Residential, Estate (RE) Zone: See chapter 3, "Residential Zones And Standards", of this title. (C) Residential, One Dwelling Unit Per Acre (R1) Zone: See chapter 3, "Residential Zones And Standards", of this title. (D) Residential, Four Dwelling Units Per Acre (R4) Zone: See chapter 3, "Residential Zones And Standards", of this title. (E) Residential, Eight Dwelling Units Per Acre (R8) Zone: See chapter 3, "Residential Zones And Standards", of this title. (F) Residential, Sixteen Dwelling Units Per Acre (R16) Zone: See chapter 3, "Residential Zones And Standards", of this title. (G) Neighborhood Commercial (NC) Zone: See chapter 4, "Commercial Zones And Standards", of this title. Section 14: McCall City Code Section 3.7.032 is amended with the following changes: 3.7.032: REQUIREMENTS FOR DEVELOPMENT: (D) Setbacks: All structures in subdivisions platted after March 16, 2006, are to be set back from the property line not less than seventy five feet (75'), except that where the lot is within any residential zone, commercial zone, airport (AP) zone, business park or industrial zone, the setbacks provided for such zone shall govern instead. The setback requirements for parcels along South Third Street (Highway 55) from Deinhard Lane to the south boundary of the impact area are as follows: 1. Adjacent to, or within, three hundred feet (300') of a street intersection, the setback will be ten feet (10'). 2. Otherwise, the setback will be thirty five feet (35'). Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 14 of 25 March 24.2011 Section 15: McCall City Code Section 3.8.05 is amended with the following changes: 3.8.05: TEMPORARY STORAGE AND MERCHANDISING FACILITIES NOT TO BECOME PERMANENT: (A) No owner shall maintain a temporary storage or merchandising facility, as defined in section 3.2.02 of this title, upon any property in the planning jurisdiction for a period of time in excess of twenty four (24) days during any sixty (60) day period, unless within such twenty four (24) days such facility is brought into compliance with all standards of the relevant zone, including without limitation setbacks for structures, and parking requirements (whether or not such facility otherwise meets the definition of"structure"). No such facility shall be used in lieu of usable interior working space of a commercial business park or industrial land use for more than eighteen (18) months during construction of a permanent building. Section 16: McCall City Code Section 3.8.06 is amended with the following changes: 3.8.06: PARKING PROVISIONS, DRIVEWAYS AND LOADING AREAS: (A) Parking and Loading Spaces Required: No building or structure shall be erected, or any residential use changed to commercial, business park or industrial use, unless maintained off street parking and loading spaces have been provided in accordance with the provisions of this chapter. Even where the new use involves no additions or enlargements, there shall be provided as many such spaces as may be required by this chapter. (B) Altered Or Enlarged Building, Compliance With Current Provisions: No building or structure shall be substantially altered, added to or enlarged, or its use changed permanently unless there is provided as many such spaces as may be required by this title with respect to the square footage as to which alteration, addition, enlargement, or change of use has occurred. (C) Surfacing Requirements: Parking and/or storage of otherwise legal and licensed vehicles of any kind, except upon properly surfaced and approved driveways or parking aprons, is prohibited. Parking of such vehicles on lawns, patios, garden area, or naturally wooded terrain is expressly forbidden at any time, except in an emergency such as fire, flood, earthquake, etc., or to facilitate approved construction work. (D) Location Of Parking Spaces: The following regulations shall govern the location of off street parking spaces and areas: Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 15 of 25 March 24.2011 1. Parking spaces for all detached residential uses shall be located on the same lot as the use which they are intended to serve. 2. Parking spaces for commercial, business park, industrial or institutional uses shall be located not more than three hundred feet (300') from the principal use and shall be located behind or beside the use. 3. Parking spaces for apartments, condominiums or similar residential uses shall be located not more than two hundred feet (200') from the principal use on the same developed property. 4. In all zones, if a new single-family residential structure is built without a garage, space shall be provided for the lawful addition of future covered parking. 5. No parking lot pavement edge for a commercial or industrial use may be located closer than five feet(5') from the right of way of a public street. Section 17: McCall City Code Section 3.8.061 is amended with the following changes: 3.8.061: PARKING AREA DEVELOPMENT STANDARDS: (A) Surfacing: 1. Parking and loading spaces for commercial, business park and industrial uses shall have an improved surface including asphalt, concrete, paving stones or bricks. 2. Parking and loading spaces for residential uses may use other materials (such as gravel) that provide a stable driving surface under all weather and moisture conditions and during ordinary use by wheeled vehicles which prevents the raising of road dust or other like particulate matter into the air. Section 18: McCall City Code Section 3.8.064 is amended with the following changes: 3.8.064: DRIVEWAYS: (A) The minimum driveway width in the commercial, business park, industrial and civic use zones shall be twenty feet (20') for two-way traffic and fourteen feet (14') if there is one- way traffic. For residential driveways, refer to section 9.6.03 of this code. Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 16 of 25 March 24.2011 Section 19: McCall City Code Section 3.8.07 is amended with the following changes: 3.8.07: ANIMALS: (B) Farm Animals, Large: Animals such as horses, cows, goats, pigs, sheep or other typical farm animals or any large or domesticated wild animals shall not be boarded permanently or temporarily in any residential, industrial, business park or commercial zone except as specifically provided in the chapters respecting such zones. Section 20: McCall City Code Section 3.8.09 is amended with the following changes: 3.8.09: PROVISION FOR TRASH STORAGE, COLLECTION AND DISPOSAL: It is unlawful and a nuisance to discharge waste matter onto the surface of the earth outside of a building or sight obscuring fence, other than into a waste container, and unlawful and a nuisance to discharge waste matter into any stream or lake or other water body. It is recommended that all trash be collected by a community trash collection facility. An enclosed, or sight obscuring, structure is required for all trash collection containers, unless these containers are kept in a building. Sight obscuring structures, if in a commercial, business park or industrial zone, are subject to administrative approval of the enclosure design. If the collection containers are outside of a building, then they must be designed to be animal=proof, especially against bears, raccoons, and other animals. Section 21: McCall City Code Section 3.8.10 is amended with the following changes: 3.8.10: FENCING: This section applies to all individual parcels. (G) A sight obscuring fence or other suitable screening is required where a commercial business park or industrial use abuts the side or rear yard of any property in a residential zone. Such fence shall be six feet (6') in height except in the street setback area, where it shall be not more than four feet (4') in height. Section 22: McCall City Code Section 3.8.13 is amended with the following changes: 3.8.13: LANDSCAPING, SCREENING AND BUFFERING: Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 17 of 25 March 24.2011 (A) Landscaping: The following standards are intended to ensure the preservation and enhancement of McCall's natural resources and amenities. 2. Industrial, business park, commercial and civic use sites shall: (a) Provide landscaping on all areas not actually utilized for required off street parking, minimal roads, and buildings, unless otherwise provided in a site plan approved by the planning commission under the procedures applicable to a conditional use, but without public hearing. (b) It is the purpose of such a site plan to determine the area reasonably needed for operations, and the landscape treatment of the site in the light of that need. 3. Residential development shall provide usable yard in the amount of one hundred (100) square feet per bedroom in excess of one per dwelling unit. In the RR, RE, R1, R4, and R8 zones, at least thirty percent (30%) of the total parcel area shall be: (a) Maintained in a manner that preserves existing natural vegetation; or (b) Landscaped with plant species native to similarly situated lands. See title IX, chapter 7, "Special Subdivision And Development Provisions", of this code, and appendix B on file in the office of the city clerk. 4. Landscaping of parking areas shall be in accordance with subsection 3.8.061(E) of this chapter. 5. Nothing in this section shall be read to require the landscaping of exposed rocks and sands in undisturbed riparian and littoral areas. 6. The commission may require that the developer prepare for approval a landscaping plan. (B) Screening: Parking areas, mechanical equipment, waste collection containers, fuel tanks and other similar appurtenances shall be fenced or screened from public view. A sight obscuring fence or other suitable screening may be used to screen for commercial business park or industrial uses where they abut the side or rear yard of any property in a residential district. Such fence or screen shall be at least four feet (4') but not more than six feet (6') in height except in the street setback area, where it shall be not more than four feet(4') in height. Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 18 of 25 March 24.2011 (C) Buffering: In order to enhance the rural and natural environment and maintain community character and aesthetics, when abutting a residential zone, a commercial,. business park, industrial, or civic use shall have buffering from the residential area from noise, vehicle headlight glare, dust or other impacts using walls, fences or vegetative barriers sufficient to mitigate those impacts. Prior to the issuance of a building permit for construction on such abutting commercial, business park or industrial zone, a site plan for buffering shall be submitted to the administrator for approval; an approved buffering plan shall be a condition of the building permit; its approval may be combined with the approval of a subdivision or of a zoning map amendment. The buffers may also be designed to provide for an area for the storage of snow or rain runoff. (D) Setbacks: Setbacks greater than those of chapters 4 and 5 of this title may be required to provide sufficient space for buffering and screening and to maintain compatibility between commercial, business park or industrial and residential uses. Section 23: McCall City Code Section 3.9.02 is amended with the following changes: 3.9.02: DEFINITIONS: DEVELOPMENT COMPLEX SIGN: A freestanding sign identifying a multiple-occupancy development, such as a shopping center, business park or planned industrial park, which is controlled by a single owner or landlord, approved in accordance with section 3.9.03 of this chapter. Section 24: McCall City Code Section 3.9.03 is amended with the following changes: 3.9.03: SIGN STANDARDS BY ZONE: (D) Industrial and Business Park , Zone I and BP: 1. General: The regulations and specifications set forth herein shall apply to the industrial (I) and business park zones. 2. Size: There shall be permitted in this zone, for each business park or industrial establishment, one identity sign for each building with a street frontage, each with a maximum area of one square foot for each linear foot of building frontage, or one-half(1/2) square foot for each linear foot of property frontage, whichever is greater, but not exceeding one hundred (100) square feet. Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 19 of 25 March 24.2011 3. Location: Requirements shall be the same as specified for the commercial zones. 4. Content: Signs permitted in this zone shall be identification signs only. 5. Changeable Signs: Changeable signs are not permitted except to advertise the pricing of fuels and event hours. A conditional use permit is required as well as following the design review procedure of chapter 16 of this title. No more than fifty percent (50%) of any given sign face may include a space for changeable letters. Permitted changeable signs shall be of a high quality, and the letters used on such signs shall be of a durable material such as Lexan® or acrylic plastic, with a minimum thickness of 0.08 inches and a height not to exceed nine inches (9"). 6. If special conditions and circumstances unique to the type of business, the land, or structure, make compliance with subsection (D)5 of this section an undue hardship, then the commission may take into consideration the products or services offered by the establishment; the requirements for a conditional use permit (see chapter 13 of this title) will be applied. (E) Public Zones And Special Districts1: 1. Agriculture And Forest (AF) Zone: Apply the same standards as for the residential zones. 2. Civic Use (CV) Zone: Apply the same standards as the commercial zones. 3. Airport (AP) Zone: Signing to be located within the AP (airport) zone requires an administrative permit, except for the signage required by authorities for safety or security purposes. Otherwise, the same standards apply as the industrial or business park zones. 4. Special Districts: Apply the same standards as for the zone in which the district falls. Section 25: McCall City Code Section 3.9.07 is amended with the following changes: 3.9.07: PROHIBITED SIGNS: (K) Changeable signs in residential zones, except where permitted by a conditional use permit for a commercial, business park or industrial use. Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 20 of 25 March 24.2011 Section 26: McCall City Code Section 3.10.01 is amended with the following changes: 3.10.01: PURPOSE: The planned unit development (PUD) process provides an opportunity for land development that preserves natural features, allows efficient provision of services, and provides common open spaces or other amenities not found in traditional lot by lot development. The procedure may allow a combination or variety of residential, commercial, office, technical, business park and industrial land uses. It also provides for the consistent application of conditions of approval for the various phases of the planned unit development. A planned unit development is intended to: (A) Permit greater flexibility and, consequently, more creative design for development than generally is possible under conventional zoning regulations. (B) Retain and preserve natural scenic qualities and topographic features of open spaces; promote aesthetics; prevent disruption of natural drainage patterns. (C) Promote the creation and efficient use of open space and park area. (D) Provide a harmonious variety of neighborhood development and a higher level of urban amenities Section 27: McCall City Code Section 3.10.07 is amended with the following changes: 3.10.07: DEVELOPER BENEFITS: (F) Buildings may be clustered to preserve open space. Clustering of dwelling units, commercial, business park and industrial uses are encouraged as long as buffer yards, open space and emergency access are adequately planned. Buffer yards shall be required to separate different uses in order to eliminate or minimize potential interference and nuisances on adjacent properties. The city may require clustering to avoid development in river areas, floodways, foothills, wetlands, or other environmentally sensitive areas as, or to preserve tree groves. Section 28: McCall City Code Section 3.10.08 is amended with the following changes: 3.10.08: DEVELOPMENT STANDARDS: Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 21 of 25 March 24.2011 (I) Landscaping: Industrial, business park., commercial, and technological uses shall be developed in park like surroundings including landscape as buffers to screen lighting and parking areas. Section 29: McCall City Code Section 3.10.09 is amended with the following changes: 3.10.09: APPLICATION PROCEDURE: (C)2.(b) An outline of the proposed PUD stating: 1) land use allocation by type, including the amount of land for housing, density, open spaces, roadways and parking; 2) the number and type of housing units, commercial, business park or industrial uses; 3) how necessary services will be provided; and 4) whether services are publicly or privately owned and operated. Section 30: McCall City Code Section 3.16.02 is amended with the following changes: 3.16.02: APPLICABILITY: Design review approval is required for any development that is a commercial, business park, industrial, public or semipublic (including private clubhouses or recreational facilities) development, all developments within the CV, AF, or AP zones, accessory dwelling unit, multi- family residential project of three (3) or more units, single-family dwelling unit with living area greater than three thousand five hundred (3,500) square feet, and any sign within the city of McCall and the area of city impact. Design review is also required in the shoreline and river environs zone and the scenic route zone as provided for in chapter 7 of this title. Section 31: McCall City Code Section 9.3.05 is amended with the following changes: 9.3.05: ALLEYS: (A) Alleys shall be provided in commercial, business park and industrial zones, and may be provided in other zones, except that the council may approve other types of service access for off street loading, unloading and parking consistent with and adequate for the uses proposed. Section 32: McCall City Code Section 9.4.05 is amended with the following changes: Ordinance No. 885—Code Amendments—New Business Park Zone and References Page 22 of 25 March 24.2011 9.4.05: OTHER MOBILE HOME/MANUFACTURED UNITS: (C) Use Of Mobile Home Or Commercial Coach As Temporary Office: A mobile home or commercial coach may be used for a temporary office in commercial, business park and industrial zones by conditional use permit granted by the commission. The unit must be connected to the city water and sewer systems, if restroom facilities are provided. A building permit must be obtained prior to installation. (D) Commercial Coach For Temporary Classroom: (E) Mobile Home/Commercial Coach As Portable Lab: A specially equipped mobile home or commercial coach may be used for portable laboratory purposes in the R1, R4, R8, and R126 zones and commercial, business park and industrial zones subject to approval of a conditional use permit by the commission Section 33: McCall City Code Section 3.8.13 is amended with the following changes: 9.6.02: IMPROVEMENT REQUIREMENTS: (A) Streets: All streets in the subdivision must be platted and developed with a width, alignment, and improvements such that the street is adequate to accommodate existing and anticipated vehicular and pedestrian traffic and meets city standards for the appropriate functional classification. Streets shall be aligned in such a manner as to provide through and efficient access from and to adjacent developments and properties and shall provide for the integration of the proposed streets with the existing pattern. Streets shall be aligned consistent with the comprehensive plan and applicable master plans. 1. Installation: Street, utility and requisite on_site and off-site improvements, as hereinafter listed, shall be installed in each new subdivision at the subdivider's expense, or their later installation at subdivider's expense as provided for in the development agreement. 2. City Acceptance: The city shall not accept the dedication of any public rights of way, any easements shown on the plat, or any appurtenant facilities lying therein which are not improved, or construction thereof guaranteed in accordance with the provisions of this title, or with policies, standards, designs and specifications set forth in the road and street specifications adopted by the city, county, or state. Paving And Dedication: The subdivider shall construct paved streets in residential, commercial, business park or industrial subdivisions. All streets and alleys within any subdivision shall be dedicated for public use. (C) Street Lighting: Street lighting shall be placed at all intersections with arterial streets and within industrial, business park and commercial zones. Streetlights in residential areas are required at intersections with collector or arterial streets. All street lighting is to be in accordance with title III, chapter 14, "Outdoor Lighting", of this code. (T) Perimeter Fencing: Perimeter fencing is fencing which encloses a property with more than two (2) residential units. Perimeter fencing which surrounds, or substantially surrounds, a residential subdivision shall be primarily constructed of natural materials, such as log poles or split rails. Perimeter fencing for residential developments shall have periodic openings to allow for the movement of larger wild animals, such as deer and elk, and shall be constructed so that the height of the top rail is no more than forty two inches (42") above grade and the minimum gap between the bottom rail and grade is fifteen inches (15"). Perimeter fencing proposed for a residential development is subject to the approval of the commission either as a part of the proposed subdivision or requested via a conditional use permit. Fencing, including gates, enclosing industrial, business park and commercial developments, or units within an industrial and business park zones, shall require a conditional use permit. Perimeter fencing in zones CC, CBD, BP and I is not permitted except as a screen abutting residential properties and when conditionally approved to provide security for hazardous materials or operations. Section 34: McCall City Code Section 9.6.05 is amended with the following changes: 9.6.05: PRIVATE STREETS: (D) Construction: 1. In no case shall a gate be placed across private or public streets, except in: (a) Those cases where the street serves no more than two (2) residential units, or where, under the current zoning designation for the property, it could be developed or subdivided for no more than two (2) residential units; or (b) Those cases where a perimeter fence is approved for an industrial, business park or commercial development (see subsection 9.6.02(T) of this chapter).
