HomeMy Public PortalAboutM 1949-10-04 - CC3~ REGULAR :MEETING OCTOBER ~, 1949 The City Council of the City of Lynu-ood met in a regular session in the City Mall, 11331 Plaza Street, on above date at 7:30 p.m. Mayor Willard in the chair. _ Councilman Jensen was absent. Councilmen Bruner, Stroh, Willard, and Williams answered the roll call. It was moved by Councilman Williams, seconded by Councilman Bruner that the minutes of the previous regular meeting of September 20, 199 be approved as written. All members present voting aye, the Mayor declared the motion duly carried. I'he hour of 8:00 P. M. having arrived, said hour being the time fixed to sell at public sale certain public lands (Fernwood Property), to-S,Tit: Parcel 1: Lot b, '~ract 5709, Boo$ 65, Page 23 of Maps, in the office of the County Recorder. Parcel 2: That portion of the Bullis Land in the Rancho San Antonio, Book 3, Page 39° of Miscellaneous Records, in the off ice of the County Recorder, described as follows: Beginning at the most east- erly corner of Tract 10503, as per map recorded in Book 158, Pages 3 and ~ of T~Iaps; thence South 70° 53' East parallel with the Northerly line of Tract No. 9235, as per map recorded in Book 129, Pages 10 and 11 of Ma s, 705.73 feet, more or less to the :westerly line of Caress Street, ~0 feet wide; thence South 19~ 12' 30" West 16.50 feet to the most easterly corner of said ~'ract No. 9235, thence along the northerly line of said Tract No. 9235, North 700 53' West 7Q5.69 feet, more or less, to the most Northerly corner of said r'ract; thence North 190 0~' East 16,50 feet, more or less, to the point of beginning. - Excepting therefrom treat portion of Parcel 2 lying westerly of the easterly line of T1iuriel Drive (55 feet wide), and Excepting theref rom that portion of Ps,rcels 1 and 2 lying between the northerly prolongation of the easterly line of the first alley uresterly of Caress Street and a line 180 feet westerly of and parallel to said last described prolonged line, and Excepting therefrom that portion of Parcels 1 and 2 lying northerly of a line ~0 feet southerly of, measured at right angles, and parallel to the southerly line of the Pacific Electric Railway Company's Private Right of Way, the Mayor inquired if there were any present wishing to make an offer on said land. Whereupon, NIr. D. J. Carse bid X3200.00. The Mayor inquired if there were any others present ~rishing to bid on said property. There was no response. It ~*as moved by Councilman Williams, seconded by Councilman Stroh, that said bid be accepted and escrow be entered into and the Mayor and City Clerk authorized to execute the necessary documents. - Roll Call: Ayes: Councilmen Bruner, Stroh, Willard, and tnTilliams. Noes: None. Absent: Councilman Jensen. The Mayor inquired if there were any oral communications. Whereupon, NIr. H. Bear, 11329 Long Beach Blvd., addressed the Council in request for a parade permit for October 29, said parade to be held in conjunction with the opening of the new armory. It was moved by Councilman Stroh and seconded by Councilman Bruner, that said permit be granted through channels. All members present voting aye, the Mayor declared the motion duly carried. A communication was read from the T~iatthews Advertising Com- pany offering to place trash receptacles through the City, free of charge for the privilege of maintaining advertising on the aides of said containers. There was discussion wherein Mr. Searles of the ad- vertising company explained in more detail his plan and answered several questions in regard to the proposed contract for same, Whereupon, it was moved by Councilman Bruner and seconded by Councilman Stroh, that said offer be accepted subject to approval of the City Attorney. All members present voting aye, the Mayor declared the motion duly carried. Communication from the Compton-Lynwood Realty Board was read in regard to a realtors' code of ethics as.it applies to a recent ease in question in Lynwood. McNeal Jr., 3128 Fernwood Avenue, on the City for alleged damges, said claim being aecornpanied by a communication indicating that J. F~ Quigley, Attorney, represents said claimant. It r~Tas moved by Councilman Bruner, seconded by Councilman Williams, that the claim be acknoT~Tledged and the Manager be instructed to take the necessary action with the in- surance carrier. It was moved by Councilman Bruner, seconded by Councilman ~Rlilliarns, that further reading ~he waived. All members present voting; aye, the i~iayor declared the motion duly carried. RESOLUTION N0. 2237 entitled "RESOLUTION OF THE CITY COUN- CIL OF Z'HE CITY OF LYNkJ00D APPROVI'r~iG REPORT OF THE CITY EPIGINEER AND FIXING TIME OF HEARING IPi THE IAT~'ER OF Z'HE PROP.DSED IMPROVEMENT ~~~ OF ORCHARD AVENUE" was read. It was moved .by Councilman Williams, seconded by Councilman Stroh, that said resolution be adopted. Roll Call: Ayes: Councilmen Bruner, Stroh, Willard, and Williams. Noes: None. Absent: Councilman Jensen. Mrs. Barbee asked several questions in regard to the proceed- ings ~rhich were answered by the City Engineer. The hour of 8:00 P. Pd. having arrived, said hour being the time fixed to hear any and all objections to the proposed vacation of Pendleton Avenue from Lewis Road to Standard Avenue, the Mayor inquired if there were any present in regard to said hearing.here was no re- sponse. ti~hereupon, RESOLUTION D30. 2237A entitled "RESOLUTION OF ORDER OF VACAT20N FOR CERTAIN PORTIONS 0~~' PENDLETON AVEI~3UE IN THE CITY OF LYNWOOD" was read. It was moved by Councilman Stroh, seconded by Coun- cilman Williams, t7iat said Resolution be adopted. Roll Call: Ayes: Councilmen Bruner, Stroh, Willard, and Williams. An ordinance entitled "AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, RECREATING THE WATER DEPART~IEi~iT; ESTABLISHING WATER RATES AND REGULATIONS FOR THE USE AND SERVICE OF WATER; AND REPEALING OR- DINANCES 382, 412, 435, 43~, ~~~, and 478 OF THE CITY OF LYNWOOD, AND FIXING A PENALTY FOR THE VIOLATION OF THE PROVISIOPIS OF THIS ORDINAI~ICE" was read for the first time. It was moved by Councilman Williams, seconded by Councilman Bruner, that said ordinance be accepted as read for the first time and pass to the second reading. An ordinance entitled "AN ORDINANCE OF THE CTTY OF LYNWOOD Ai~:ENDIJG DRDINANCE N0. 418 BY ADDING A NEW SECTION 7:`~iERETO TO BE DESIG- NATED SECTIOPI 26(b)" was read for the first tune. It was moved by Councilman Stroh, seconded by Gouncilman Bruner, that said ordinance be accepted as read for the first time and pass to the second reading. Roll Call: Ayes: Councilmen Bruner, Stroh, Willard and Williams. Noes: None. Absent: Councilman Jensen. Report from the Engineer as requested, on the condition of Agnes Street east of Bullis Road was read. It was moved by Councilman Williams, seconded by Councilman Bruner, that said report be filed. All members present voting aye, the I~~iayor declared the motion duly carried. Report from Chief Kerr in regard to traffic conditions at Bullis and Carlin Avenue, including a sample traffic count, was pre- sented. The Chief recommended that a four-way strop be established at said intersection. It was moved by Councilman Bruner and seconded by Councilman Stroh, that said recomr~~endation be approved. All members present voting aye, the Mayor declared the motion duly carried. Communication from Chief Kerr in regard to reinstatement of A. A. Van Dien as Clerk-Dispatcher ~ra.s read wherein the Chief recom- mended reinstatement as request for same had been received prior to expiration of 30-day period. The Chief placed on file report from phy- sician on the condition of Mr. Van Dien. It was moved by Councilman Bruner and seconded by Councilman Williams, that the Chiefs recommendation be approved and Mr. Van Dien be reinstated. All members present voting aye, the Mayor declared the motion duly carried. Resignation of Kay Creathbaum as Policewoman was presented, Frith the Chief's recommendation of acceptance. Whereupon, it was moved by Councilman Stroh, seconded by Councilman ~~illiams, that said resig- nation be accepted with regrets, effective October 5, 199. All members present voting aye, the l~iayor declared the motion duly carried. Recommendation from the Engineer that H. J. Fish be appointed permanent with the appropriate salary of $195.00 plus cost of living adjustment, effective September 16, was presented. It was moved by Councilman '~~illiams, seconded by Councilman Stroh, that said appoint- ment be ordered. All members present voting aye, the Mayor declared _:_ ~' the motion duly carried. _ Councilman Stroh brought up the matter of traffic regu- lation along Birch Street in the City Park, stating the need for con- trol of traffic entering the park area on the east-west streets, namely, Mulford and Beechtrood. There was a discussion wherein it was moved by Councilman Bruner, seconded 'oy Councilman Stroh, that the Chief be instructed to investigate the traffic conditions at the park and report thereon. All members present voting aye, the Mayor declared the motion duly carried. It was regularly moved by Councilman Williams, seconded by Councilman Bruner, tklat the demands presented at the meeting of October ~, 19~g, having been regularly audited, are hereby allowed and approved and warrants ordered drawn on the City Treasurer there- for in accordance ~Tith and to the payees named and the funds indi- cated in the several denands hereby approved.
