Ot REGULAR Tu1EETING APRIL 20, 1948 The City Council of the City of Lynwood met in a regular session in the City Hall, 11331 Plaza Street on above date at 7:30 P. M. Mayor Doty in the chair. ' Councilmen Doty, Jensen, Shrock, 'vVillard, and Williams answered the roll call. It was moved by Councilman Shrock and seconded by Council- man t~dillard, that the minutes of the previous regular meeting of April 6, 1948 be approved as varitten. All members of the City Council voting aye, the R~ayor declared the motion duly carried. It waas moved by Councilman Shrock, seconded_ by Council- man Williams, that the Council proceed with the canvass of the vote. All members of the City Council voting aye, the Tv~ayor de- clared. the motion duly carried. `Thereupon, the a'Iayor appointed Councilman Williams and Councilman Shrock ~as Tellers and they proceeded to canvs,Qs the vote. It was moved by Councilman Shrock, seconded by Councilman V'Jilliams, that said resolution be adapted. Roll Call: Ayes: Councilmen Doty, Jensen, Shrock, Willard, and Williams. Noes: None. Thereupon, the City Clerk delivered to Councilman Percy Lynwood Bruner, Jr., Councilman Herman 0. Stroh, and. Councilman J. Ja,ek ',Hillard certificates of election and administered to them the oath of office as required by law. "!hereupon, they were inducted into office. Thereupon, the retiring members of the City Council vacated their seats at the Council table and. the newly elected members of the City Council took their seats at the table and pro- ceeded with the business at hand. Thereupon, Councilman Williams nominated Councilman 'a'lillard for the office of r~Iayor of the City of Lynwood. Whereupon, Councilman Stroh nominated Councilman Williams for the office of Mayor of the City of Lynwood. Councilman ;Hilliams stated his with that his name be with- drawn as a nominee, stating that his employment would not allow him to give the time he felt necessary to said office. 'YVhereupOn, Councilman Bruner nominated Councilman Jensen to the office of Iti~ayor of the City of Lynwood. tiJhereupon, it was moved by Councilman '!lilliarns, seconded by Councilman Stroh, that nominations be closed. Roll Call: Ayes: Councilmen Bruner, Jensen, Stroh, `"lillard, and Williams. IJoes: None. Councilman Stroh inquired as to the legality of the Clerk acting as temporary Chairman. The Attorney advised that State law calls for permanent organization of the Council first and does not allo~rr for temporary organization. Thereupon, the Clerk requested a vote on the nominees for the office of ~,~Iayor of the City of Lynwood in the order of their nomination, as follows: Councilman `~"r'illard: Roll Call: Ayes: Councilmen Williams, Jensen, Willard. V`lhereupon, Councilman Willard took the chair and proceeded with the business at hand. The Mayor inquired if there were any oral communications. Frlr. Curtis N. Hamby, 12.7 N. Boyle Avenue, Los Angeles, representing the Church of the Brethern, addressed the Council with a request for permission to erect a fire-proof tent for Sunday School purposes between State and Long Beach Boulevard on Wisconsin Avenue. Councilman Williams stated that previously similar requests had been allowed. It v~ras moved by Councilman Stroh, seconded by CoL~ncilman Bruner, that permission be granted. All members of the City Coun- cil voting aye, the I~'la.yor declared the motion duly carried. Mr. L. C. ~3rowning, 12226 Santa Fe Avenue, addressed the Council requesting that action be taken to abolish the office of City Manager. There ensued considerable discussion wherein Councilman Stroh stated his opinion of the need of the office. Mr. Daty, 11125 Pine Avenue, addressed the Council *.~- __ ...._.. .... _. ------ stating his opinion as to the value and need of the office. ~~2r. Shrock, 3535 Josephine Street, expressed his opinion that a business as large as th.e City of Lynvrood needs a manager. Councilman Bruner stated he felt that there was a definite need for the office, if but for purchasing alone, and that- as a new member would need more time to study the question before any action could be taken. WRITTEN COPvi~d~iTNICATIONS: A communication from the American Legion Auxiliary was read wherein they request permission to conduct poppy sales•~J.ay 21 and 22. It was moved by Councilman Williams, seconded by Go~ancilman Stroh, that permission be granted to the American Legion and_ the V.F.W. to conduct said poppy sales. .411 members of the City Council voting aye, the ,Mayor declared the motion duly carried. ~„, The Clerk presented the following Quitclaim Deeds: Quitclaim Deed dated April 3, 1948 and signed byC. W. Davidson and Luverne Davidson whereby they convey to the City of Lynwood for street purposes their interest in and to the southerly 2,0 feet of Lot 38 and the southerly 20 feet of the west 20 feet of Lot 39, Block 3, Tract 6436; Quitclaim Deed dated April 19, 1948 and signed by Robert D. It was moved by Councilman `Nilliams, seconded by Councilman Bruner, that said deeds be accepted and that the City Clerk be directed to cause said instruments to be recorded in the office of the Recorder of Los Angeles County, California. The Clerk presented a request from Alan Brown, City painter, for-leave of absence and vacation, said request having been approved by the City Engineer under whose direction the painter works. It was moved by Councilman ~~'illis.ms, seconded by Councilman Jensen, that the request be approved and leave of absence of 30 days, without pay, be allowed following said vacation, said leave to commence T,;ia.y 10, 1948. '' The Clerk presented a request from Chief Kerr that in order ~ to have all of the Police Department employees functioning under one ordinance, that the classification of Poiiee Secretary be established and-er ordinance No. 229 and the Civil Service Commission requested to prepare an eligible list. It was moved by Councilman 'oVihliams and seconded by Council- man Bruner that said recommendation be approved and classification established. All members of the City Council voting aye, the Rliayor declared the motion duly carried. Resignation of Frederick A. Graham, Clerk-Dispatcher, effective April 14, 1948 was presented. It was moved by Councilman Williams, seconded by Councilman Stroh that said resignation be accepted. All members of the City Council vatin~; aye, the ~1a.yor declared the motion duly carried. It was recommended by Chief Kerr that Austin A. Noes: None. The Clerk presented Commission that Eugene Libner period as Recreation Director of X260.00 per month plus the Ma.y 1, 1948. It was moved by Councilman Jensen, that said recommended. Jensen, Stroh, Willard, and a recommendation from the Recreation be appointed for the probationary. of the City of Lynwood at a salary cost of living adjustment, eff eetive Councilman Bruner, seconded by probationary appointment be made as Ayes: Councilmen Bruner, Jensen, Stroh, Willard, and Williams. Noes: None. A recommendation was presented from the Recreation Commission that Lorine G. Reed be appointed to the position of Assistant to the Recreation Director for the probationary period effective April 26, 1948 at a salary of X175.00 per month plus the cost of living adjustment. It eras moved by Councilman Williams, seconded by Council- man Jensen, that said probationary appointment be made as recommended. Roll Call: Ayes: Councilmen Bruner, Jensen, Stroh, Willard, and Williams. Noes: None. The Clerk presented the home occupation application of Trig Svensan to conduct the occupation of press and commercial photographer at his residence, 3163 Carlin Avenue, as allowed by Ordinance I~?o. 443. The Clerk stated that conditions of the ordinance had been met and that no objections had been filed. `~~hereupon, it was moved by Councilman Stroh, seconded by Councilman Jensen, that said application be approved. All members of the City Council voting aye, the Mayor declared the motion duly carried. The Clerk presented tine home occupation application of Otto D. Laursen to conduct the business of real estate and business opportunity broker at his residence, 4015 Imperial Highway. The Clerk stated that all provisions of Ordinance No.443 had been carried out and there were no objections filed. It was moved by Councilman Jensen, seconded by Councilman Bruner, that said application be approved. All members of the City Council voting aye, the P+gayor declared the motion duly carried. The Clerk presented a recommendation from Chief Kerr that a. WALK-WAIT signal be installed at the intersection of Platt Avenue and Long Beach Boulevard. Said recommendation was sub- stantiated with the result of a one-week pedestrian check at said intersection. It was moved by Councilman 'Williams and seconded by Councilman Stroh that the matter be referred to the Engineer for study and report as to the feasibility of an effective installa- tion. All members of the Cit~r Council voting aye, the AZayor declared the motion duly carried. The Clerk presented Tentative I~.ap of Tract 15325 (Yaffe), stating that the Planning Commission had given its approval subject to an improved alignment of Palm Avenue. It was further explained that this subdivision is not a part of Lynwood as yet;-however, annexation is anticipated. `~Jhereupon, it was moved by Councilmen Bruner and seconded by Councilman Williams, that approval be given to said proposed Tentative Map. All members of the City Council voting aye, the Mayor declared the motion duly carried. ORDI.:vANCE N0. 475 entitled "AN ORDINAi~CE ESTABLISHING SAFETY AN:~ FIRE REGULATIOI~TS IN ATTACHED GARAGE AND HOUSING OVER E~ARAGES IN THE CITY OF LYN'WOOD, EIti?FORC~.?E?~TT THEREOF AND PENALTIE5 FOR ITS VIOLATION" was read for the second time. It vaas moved by Councilman~Williams, seconded by Councilman Jensen, that said ordinance ~be adopted as read_ the second time, finally pass, and r,r~ be published as required by Roll Call: Ayes: Councilmen law . Bruner, Jensen, Stroh, Willard, and tilliams. Noes: None. The Clerk presented a report from the Engineer as requested at a previous meeting as to the cost of an installation to control the signals at ?~Sulf ord and Long Beach Boulevard from the Fire Station. The Engineer stated that the cost would be approximately X450.00, further stating that it could be reduced by approximately 50~o by making use of telephone control circuit; however, the telephone company will have no circuit open until approximately June 21,-1948. After some discussion as to the danger involved at the intersection, it was moved by Councilman Williams, seconded by Councilman Stroh, that the Engineer proceed with installation of said control. All members of the City Council present voting aye, the Mayor declared the motion duly carried. The Clerk presented a recommendation of the Engineer that a refund be made of a deposit of ~2-60.00 made February 2, 1948 by Pro~~mie's Plumbing for the installation of a water meter at the Roosevelt School. The Engineer stated that the deposit was made in error as the elementary schools of the City of Lynwood pay only a flat rate water charge ~.nd no meter is necessary. It eras moved by Councilman Williams, seconded by Councilman Bruner, that said refund be approved and that a warrant be drawn on the City Treasurer in the amount of X260.00 payable to Brownie's- Plumbing Company. Roll Call: Ayes: Councilmen Bruner, Jensen, Stroh, Millard, and Williams. Noes: None. The Clerk presented the Engineer's report on the garbage and trash contract bids. After some discussion, Councilman `~Nilliams stated his opinion as to the need for investigation along the line of incinerator installation in cooperation with neighboring cities. Councilman Bruner requested additional time to consider the matter. Whereupon, it was moved by Councilman Williams, seconded by Councilman Jensen, that action be held for further study until the next meeting. It was regularly moved by Councilman Williams, seconded by Gouncilman Jensen, that the demands presented to the Council at its meeting of April 20, 1948 having been regularly audited, are hereby allowed and_ approved and warrants ordered drawn on the City Treasurer therefor in accordance with and to the payees named and the funds indicated in the several demands hereby approved.
