Mayor tiVillard in the chair, Councilmen Bruner, Daetweiler, Sneddon, Stroh, and Willard answered the roll call. It was moved by Councilman Daetti~reiler, seconded by Council- man Sneddon, that the minutes of the previous regular meeting of May 16th be approved as written. All members voting aye, the 1iayor de- clared the motion duly carried. A communication from the LynT~-ood 20-30 Club t~ras read request- ing permission to use posters and sound. trucks to advertise their benefit dance June 17th, proceeds to go to the Rhev~aatic Fever Fund. There was discussion j.'rlerein it was -moved by Councilman Bruner, seconded by Councilman Stroh, that the request as presented be approved, subject to police regulations. All members voting aye, the Mayor de clared the motion duly carried. A communication from the Los Angeles County X-Ray Survey Foundation was read wherein they requested an appropriation to their foundation from the City of Lynwood in the amount of vp3 12°.00. There was discussion wherein Councilmen Daetweiler and Stroh advised the Council on the matter as it had been reported on at the last League Directors meeting. tiVhereupon, it was moved by Councilman Daetweiler, seconded by Councilman Stroh, that the request be denied on advise of the Board of Directors of ,the League, Los Angeles County Division. All members voting aye, the Mayor declared the motion duly carried. The City Attorney pointed out, in support of tl~.is motion, that the City is unable to give away public funds in this matter. A letter from the City Treasurer requesting permission to refund overpayment of sales tax by Walter A. Wilson and J. L. Hemphill in the amounts of ~~~.01 and X12.50, respectively, eras read. It was pointed out that the payments had been made in error on non-taxable items. It was moved by Councilman Bruner, seconded by Councilman Stroh, that the recommendation of the Treasurer be concurred in and refunds be authorized as stated above. Roll Call: Ayes: Councilmen ~?runer, Laetweiler, Sneddon, Stroh, and Willard. Noes: None. RESOLU'1'IOTJ N0. 227° entitled "RESOLUTION IN REGARD TO PER- 50NAL PROPERTY TAX" was read. It Baas r~loved by Councilman Bruner, seconded by Councilman Daetweiler, that the resolution be adopted. Roll Call; Ayes: Councilmen Bruner, Daet~~reiler, Sneddon; Stroh, and Willard. Noes: None. The hour of 8:00 p. m. having arrived, said hour being the time fixed to condu et continued public hearing on proposed annexa- tion of Wright Road Annex Na. 3, the Mayor inquired if there ~rere any present in regard to said hearing. There was no response. The Manager stated that the petition as filed at the first hearing has been checked with the Registrar of Voters offsoe and disclosed no registered voters on the list that ~rould be affected in the annexation. Whereupon, it was moved by Councilman Bruner, seconded by Councilman Daetweiler, that a hearing having been had under the Annexation of Uninhabited Territory Act in the matter of the annexation of Wright Road Annex IvTo. 3, NOW, THEREFORE, IT IS RESOLVED: 1. That the territory proposed to be annexed is uninhabited territory; 2. That tti*ritten protests have not been filed in the manner required by Section 32312 of the Government Code, State of Calif ornia; 3. 'That no protests of any type have 'peen made by the o~mers of one-half of the value of the territory proposed to be annexed as shown by the last equalized assessment roll; said annexation is therefore approved and all objections are denied. Roll Call: Ayes: Councilmen Bruner,Daet~~reiler,Sneddon, Stroh, and Willard. ,} Noes: None. ~~ ti~hereupon, ORDINANCE N0. 534 entitled "AN ORDINANCE OF THE CITY OF LYNWOOD APPROVING THE ANNEXATION OF THAT CERTAIN PROPERTY IN THE COUNTY OF LOS ANGELES LYING 6~1ESTERLY OF THE LOS ANGELES COUNTY FLOOD CONTROL CHAr1NELp was read for the second time. It was moved by Councilman Stroh and seconded by Councilman Sneddon, that said ordin- ance be adopted as read for the second time, finally pass, and be pub- lished as required by law. Roll Call: Ayes: Councilmen Bruner, Daetweiler, Sneddon, Stroh, and Willard. Noes: None. _ At tY~is time the t~jayor announced the conflict of the Council meeting with the court session scheduled for the Council Chambers. Whereupon, it was moved by Councilman DaetUreiler,_seconded by Councilman Bruner, tl~~at the meeting be ad,j.ourned to reconvene immed- iately in the office of the Gity Clerk in the City Mall. All members present voting aye, the Mayor declared the motion duly carried. - Whereupon, the Council moved and situated itself ~.n the City Clerk's office, Room 2, City Hall, and the Mayor declared the meeting duly reconvened as all members were present. The Mayor inquired if there were any other oral communications. There was no response. Whereupon, the Glerk read the City Attorney's .report as re- quested at the last meeting, in regard to compensation to the various Commissioners of tale City of Lynwood. The Attorney's report stated that the only Commissioners that could possibly be paid ~7ould be the Planning Commissioners. After discussion, it was moved by Councilman Sneddon, seconded by Councilman Daetweiler, that the Attorney's report be accepted as read and placed on file. AlI members voting -aye, the Mayor declared the motion duly carried. The Clerk then read the City Attorney's report on the pro- posal that the Personnel Board and the Civil Service Board meet only on call, as requested at the last meeting. There was discussion wherein the Manager explained the pro- blem of maintaining the interest of the Commissioners when meetings were held without buriness to be conducted. Councilman Stroh questioned as to the maintenance of_sufficient eligible lists to fill all the .necessary classifications of city employees. The Manager stated that this is being done. Whereupon, Councilman Daet~reiler explained the operation of the .Commission as he knew it and that in his op~.nion an ion callp method should prove sufficient to provide the necessary function to the City and its employees. Whereupon, it was moved by Councilman Daetweiler, seconded by Councilman S~ieddon, that_the Attor- ney's report be accepted and that the Manager_'s recommendation be approved, and the Attorney directed to draw the necessary amendment to the Rules and Regulations effecting the change to "on call" meetings by the Civil Service and Personnel Boards. All members voting aye, the Mayor declared the motion duly carried. The Cler'_~ presented the renewal of the contract with the County of Los Angeles to conduct health service for the City of Lynwood for the coming year, stating that the only Chan a was an increase in the rate from X1.63 per unit per inspection to 1.72, the Clerk further stating the City Attorney had examined the contract and found it to be acceptable. Whereupon, it was moved by Councilman Bruner, seconded b y Councilman Sneddon, that the contract be approved and the Mayor and City Clerk authorized to execute same on behalf of the City of Lynwood. Noes: None. ~ The. following quitclaim deeds from the United Stags of America, General Services Administration, wherein it conveys to the City of Lynwood its right, title, and interest- in and to a perpetual easement and appurtena aces tYierein, as follows: The southerly 40 feet of Fernwood Avenue from the westerly line of Santa Fe Avenue to a point 375 feet, more or less, south- easterly from and parallel to the southeasterly line of Imperial High- Uray, Santa Fe Avenue from the southerly line of Fernti,Tood Avenue to the Southerly line of Lynwood Road and Lyntrood Road from the easterly line of fianta Fe Avenue to a point 21 feet easterly from the East line of Commerce Tract as recorded in Boob. 1~i6, Pages 49 and 54, Records of _ L Los Angeles County; and the folloitiTing perpetual easement and appur- tenances therein: Santa Fe Avenue from the southerly line of Fern rood Avenue to the southerly line of Lyn~~-ood Road, and Lynurood Road from the easterly line of Santa Fe Avenue to a point 21 feet easterly from the East line of tine Commerce Tract as recorded in Boolt l~'.6, Pages ~~~ and 50, Records of Los Angeles County. A corporation grant deed dated l•1ay 29, 1950, signed by Pacific Iron and Steel Company's President and Secretary, wherein they convey to the City of Lynwood the westerly ~!-0 feet of the J. J. Bullis 11.30 acre tract, being a portion of Bullis land as pei^ map recorded in Book 3, Page 399, Miscellaneous Records of Los Angeles County, extending from the southerly boundary line of the City of Lynwood to the southerly line of land conveyed to the City of Lyn~Tood by Deed No. 226 recorded in Book 32911, Page 310, Official Records of said County, for street purposes, and to be lcno~rn as Alameda Street. It was moved by Councilman Stroh., seconded by Councilman Daettrei~ler, to accept the Pacific Iron and Steel Company deed. The Manager reported on the proposed annexation of property westerly of Alameda Street, stating that one of the properties had not filed its petition as yet for annexation and recommended that the matter be held over until the next meeting at which time he felt that the petition would_ be on filed. It was moved by Councilman Daett~Teiler, seconded by Council- man Stroh, that the proposed annexation of land lying ~resterly of Ala- meda Street be held over to the next meeting. A ll members voting aye, the Mayor declared the motion duly carried. The ~Jlanager resented the final subdivision plat of Tract No. 16bLr2 ~Myers~ stating that the map was substantially in conformity with the tentative map and recommended acceptance of the tract subs e ct to filing of the f ai thful performa nce bond of 7, 200.00 covering cost of constructing curbs, gutters, pavement and sidewalks, After discussion, it was moved by Councilman Stroh, seconded by Councilman Bruner, that the subdivision be approved and the streets and alleys offered for dedication be accepted sub,j e ct to filing of a faithful. performance bond in the amount of X7,200.00 as recommended by the City Engineer. The ~ia.nager reported on the renewal of the contract for the auditor of the City of Lynn*ood for the coming year, stating that Per. W. R, Wright's services leave been especially good throughout the past several years and that his offer was for same fee of X300.00 a t e~ per quarter and recommended continuation of the agreement. Whereupon, it was moved by Councilman Bruner, seconded by Councilman Sneddon, that Auditor W, R, Wright be retained as auditor for the coming year 1950-51 at a f ee of X300.00 per quarter for audit services. Roll Call: Ayes: Councilmen Bruner, Daetweiler, Sneddon, Stroh, and Willard. Noes: None. The P~anager reported on a request of the ti1'ater Department to destroy stubs of receipted water payments to the City of Lynwood that are over five years old. The Manager reported that the retention of the stubs serve no useful purpose and that investigation with the City Attorney' reveals that the lahT allows said destruction. Whereupon, it was moved by Councilman Bruner, seconded by ,.. Councilman Daetweiler, that permission be gra nted to make such des- ~ truction as per the Manager's recommendation. All members voting aye, the T~ia3Tor declared the motion duly carried. The Manager reported on the request and recommendation of the Chief of Police as to the appointment of Ralph E. Darton as Sergeant of Police. The Manager reported that Ralph Darton is No. 1 on the eligible list resulting from the promotional examination condu cted for the position of Sergeant of Police and that there is a vacancy in said classification. The Chief of Police recommended that said appointment be made effective June 1, 1950, at a salary of X240.00 per month plus X10.00 motor officer allowance, plus the current cost of living adjust-. went. ' ~~Thereupon, it was moved by Councilman Stroh, seconded by Councilman Daetweiler, that the Chief of Police and Manager recommenda- tions be approved as presented, and appointment be made as set forth above. ~ Roll Call: Ayes: Councilmen Bruner, Daetweiler, Sneddon, Stroh, and ~~' illard. Noes: None. The Manager reported that Officer Carlsted resigned from the force effective June 22, 1950 to accept employment elsewhere, Where- upon, it was moved by Councilman Bruner, seconded by Councilman Daet- weiler that the resignation be accepted Urith regret and a letter of appreciation for past service be sent. All members voting aye, the I~iayor declared the motion duly carried. Mr. Cherry of Cherry Food riarket addressed the Council in regard to an extension of time on bond to provide for enclosure of the~food market as required by later. There was a discussion on the problem by the Council wherein it was decided that the matter be held over. It was moved by Councilman Stroh, seconded by Councilman Bruner, that the matter be held over for report by the Building Inspector and the City Manager at the next meeting. All members voting aye, the Mayor declared the motion duly carried. There was a discussion as to the need of the publication of demands wherein it was pointed out that it resulted in confusion as there was no indication as to what the payments were for, unit prices, quantities, etc., and therefore served no useful purpose and that the complete information could be obtained ley calling at the City Mall. "^ It was moved by Councilman Sneddon, seconded by Councilman Daetweiler, that the procedure of publication of the demands be stopped and that they be publicly posted on the City Hall bulletin Board. All members voting aye, the Mayor declared the motion duly carried. It was regularly moved by Councilman Sneddon, seconded by Councilman Bruner, that the demands presented at the meeting of June 7, 1950, having been regularly audited, are hereby allowed and approved and warrants ordered drawn on the City Treasurer theref or in accordance with and to the payees named and the funds indicated in the several demands hereby approved.
