HomeMy Public PortalAbout19981005REGULAR COUNCIL MEETING OCTOBER 5 1998 1 CALL TO ORDER The Regular Council Meeting was convened on October 5, 1998, at 7:30 P.M. by Mayor Duane Schreimann. Prayer was offered by Councilman Steve Nelson, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for roll call: Present: Blaney, Haake, Jackson, Jaynes, Landwehr, McDowell, Nelson, Nilges, Stella and Vincent Absent: None A quorum was declared present. PUBLIC HEARINGS Rezoning of 2821 S. Ten Mile Drive from RS -1 (Single Family Residential) to C -O (Office Commercial - Keith DeVault, Planning & Code Enforcement Director, made a presentation outlining the background of the requested rezoning. Following the presentation, Mayor Duane Schreimann gave an opportunity for members of the public to speak on the issue. No one present wished to speak in favor of, or opposition to, the proposed rezoning. Mayor Duane Schreimann announced the public hearing concluded. PRESENTATIONS FROM THE GALLERY Sidewalk issue Peg Craft, 1922 Hayselton, spoke on the issue of city sidewalks. She stated she believes that Bill 98 -54 is so compromised that it is essentially ineffective. Celeste Koon, 1017 Holly, spoke in favor of Bill 98 -54 (city sidewalks). Susan Burks, 1016 Fairmount Court, spoke in favor of Bill 98 -54 (city sidewalks). Following the above three presentations, Mayor Duane Schreimann asked for citizens present who favored Bill 98 -54 to stand. Several people in the auditorium stood. No one stood to show their opposition to Bill 98 -54. Algoa Prison Relocation issue Jim Frank, 4113 Old Shamrock Road, spoke in opposition to relocating the Jefferson City Correctional Center (JCCC) facility at the proposed Algoa site. He stated it was his opinion that the railroad crossing in the area would make it unsafe REGULAR COUNCIL MEETING OCTOBER 5 1998 2 for the facility to be at that location. Mr. William Norton, 1702 Osage Hickory, Osage City, also spoke in opposition to relocating the Jefferson City Correctional Center (JCCC) facility at the proposed Algoa site. He stated that he has documentation to show that the proposed site has archaeological value, and will provide that documentation to the Mayor and City Council. Mr. Randy Rackers, 3605 Route J, spoke in opposition to relocating the Jefferson City Correctional Center (JCCC) facility at the proposed Algoa site. He stated that the ground at the site of the facility itself would have to be built up about five feet to prevent flooding, which, in his opinion, would cost approximately $5 million. Ms. Shirley Vanderfeltz, 7640 Algoa Road, also spoke in opposition to relocating the Jefferson City Correctional Center (JCCC) facility at the proposed Algoa site. Her reason for her opposition was that she believed a prison facility that close to her home would render her home unsafe. Mr. Darrell Dunafon, 1921 Sarah Court, spoke in opposition to Bill 98 -102 (contract with Cole County and Jefferson City Area Chamber of Commerce for prison relocation). He stated he believed it would be improper for the city to spend any taxpayer money for any land acquisition utilizing the condemnation process. Following the presentations on the Algoa JCCC site, Mayor Duane Schreimann asked for citizens present in opposition to the site to stand. Several people in the auditorium stood. No one stood in favor of the issue. CONSENT AGENDA The following items were present for approval on the Consent Agenda: a. Minutes of September 21, 1998, Regular City Council Meeting b. Bid 1779 - Snow Removal Services, Public Works Dept. c. Bid 1780 - Parking Meter Mechanisms, Public Works Dept. d. Bid 1781 - Office Supply Discount, All City e. Authorizing Conditional Use at 1803 W. Main Street on Ella f. Authorizing Conditional Use at Cherry Street between Hwy. 50/63 and E. Elm A motion was made by Councilman Steve Nelson for approval of the Consent Agenda as presented, seconded by Councilman Rick Nilges and approved with Councilman Carl Jaynes abstaining on Item "b" (Bid 1779). BIDS OVER $25,000 Bid 1782 - Automotive Parts & Supply Discount, Public Works Dept. - Councilman Charles REGULAR COUNCIL MEETING OCTOBER 5 1998 3 Jackson stated he is concerned about the process of obtaining bids and then using the City - issued credit cards to purchase the items. Following Councilman Jackson's comments, a motion was made by Councilman Carl Jaynes for approval of Bid 1782, seconded by Councilman Steve Nelson and approved with Councilman Charles Jackson voting "Nay." Bid 1784 - Sodium Chloride, Public Works Dept. - A motion was made by Councilman James Haake for approval, seconded by Councilman Steve Nelson and approved unanimously. MAYORAL ANNOUNCEMENTS Mayor Duane Schreimann announced that an Open House would be held on October 13 and 14 from 6:30 -9:00 P.M. at the Jefferson City Police Department classroom to allow the public to meet the consultant rewriting the zoning and sign ordinances. Public Works & Planning Committee, September 24 BILLS INTRODUCED Bill 98 -94, sponsored by Councilmen Jackson and Landwehr, entitled: AN ORDINANCE CODIFYING AS PART OF CHAPTER 25 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, HOUSING REHABILITATION GRANT GUIDELINES UNDER THE CITY'S STATE COMMUNITY DEVELOPMENT BLOCK GRANTS AS ADOPTED BY ORDINANCES 12530 AND 12531, AND AMENDING CHAPTER 25 TO REFLECT 1998 GRANT CHANGES. Bill 98 -95, sponsored by Councilmen Jackson and Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE REGULAR COUNCIL MEETING OCTOBER 5 1998 4 MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH BURNS & MCDONNELL FOR WASTEWATER STUDIES PERTAINING TO ALGOA AREA. Councilman Carl Jaynes stated he believed that introducing Bill 98 -95 was premature based on the fact that it is contingent on approval of the issues that are contained in Bills 98 -101 and 98 -102 which have not yet been approved. Bill 98 -96, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH S & V CONSULTANTS, INC. FOR CSM FACILITY CONSTRUCTION SERVICES. Bill 98 -97, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE AGREEMENT WITH BURNS & MCDONNELL FOR CONSULTANT SERVICES FOR DESIGN OF WEST EDGEWOOD DRIVE. Councilman Carolyn McDowell requested information about the cost of including a median in this project. Mayor Duane Schreimann asked Marty Brose, Public Works Director, to provide a rough estimate of that at the next Council meeting. Councilman Steve Nelson also requested that Mr. Brose look into the fact that there is no signage on one side of Edgewood Drive to tell people what street they are on. Bill 98 -98, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING THE RIGHT -OF -WAY FOR A PORTION OF EAST MILLER STREET AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE APPROPRIATE DOCUMENTS ASCERTAINING THE VACATION THEREOF. Bill 98 -99, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MISSOURI DEPARTMENT OF TRANSPORTATION FOR A CHAPTER 53 (5311) OF TITLE 49 OPERATING GRANT. FOR HOUGH PARK STREET SIDEWALK IMPROVEMENTS. REGULAR COUNCIL MEETING OCTOBER 5 1998 5 Bill 98 -101, sponsored by Councilmen Landwehr and Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE STATE OF MISSOURI FOR PRISON RELOCATION. Following a presentation on the background of the issue given by City Administrator Rich Mays, Councilman Carl Jaynes stated he did not believe any city money should be spent on land, and that Bills 98 -101 and 98 -102 be amended to reflect that. Following discussion, Councilman Rick Nilges requested that the rules be suspended and Bill 98 -101 placed on third reading and final passage. The majority of Council Members objected to the request for suspension of the rules, which prevented the Bill from being placed on final passage. Councilman Carol Blaney requested that a special Council session be held to discuss the issue before the next Council Meeting. Mayor Duane Schreimann suggested that Councilman Nilges call a special Finance Committee Meeting for that purpose. Councilman Rick Nilges stated that he would call a Finance Committee meeting for Monday, October 12 at 7:30 P.M. in either the Conference Room or Council Chambers, depending on the number of persons attending. Councilman Carolyn McDowell requested that the archaeological information spoken of by Mr. Norton earlier in the meeting be provided prior to that time, as well as any environmental impact study information. Mr. Nilges stated that a period of ten to fifteen minutes may be set aside at the meeting to allow one person representing those opposed to the site to speak. Councilman John Landwehr requested that Bill 98 -54 be removed from the Informal Calendar and placed on final passage. Councilman John Landwehr moved to accept the substitute bill as distributed to Council at this meeting, motion was seconded by Councilman Charles Jackson and approved unanimously. Councilman John Landwehr stated that if the bill passed, he would be willing to bring the issue back to the Council in six months to a year for discussion to see how it was working. Following a lengthy discussion, Substitute Bill 98- 54 was then defeated by the following roll -call vote: Aye: Blaney, Jackson, Landwehr, Nelson and Vincent Nay: Haake, Jaynes, McDowell, Nilges and Stella Mayor Votes "Nay" to break tie Following the vote on Bill 98 -54, Councilman John Landwehr stated that perhaps another bill could be drafted for introduction in the future that would also include arterial and connector streets, as well as address some of the concerns about who should pay for the sidewalks. REGULAR COUNCIL MEETING OCTOBER 5 1998 9 Bill 98 -59, sponsored by Councilman Jackson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 17 (LICENSES, TAXATION AND MISCELLANEOUS BUSINESS REGULATIONS) OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI BY ADDING A NEW SECTION 17 -1 PERTAINING TO RESTRICTED HOURS FOR COLLECTION AND DELIVERY IN RESIDENTIAL AREAS. Councilman Charles Jackson requested the Bill 98 -59 remain on the Informal Calendar where it dies at this time. Bill 98 -66, sponsored by Councilman Jaynes, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING APPROXIMATELY 87 ACRES OF LAND IN NORTH JEFFERSON CITY, CALLAWAY COUNTY, IN THE SOUTHWEST PART OF SECTION 15 AND IN THE NORTHWEST PART OF SECTION 22, TOWNSHIP 44, RANGE 11, FROM RU RURAL TO M -1 LIGHT INDUSTRIAL. Councilman Carl Jaynes requested that Bill 98 -66 remain on the Informal Calendar at this time. Bill 98 -70, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, SECTION 19 -401, (STREETS AND HIGHWAYS), SCHEDULE B (LEFT TURNS PROHIBITED; RIGHT TURNS PROHIBITED), SUBPARAGRAPH (A), BY REMOVAL OF THE INTERSECTION AT HIGH STREET AND MADISON STREET. Councilman Carolyn McDowell requested that Bill 98 -70 remain on the Informal Calendar at this time. RESOLUTION RS98 -15 Ellis Porter Pavilion Upgrade (Vincent) — A motion was made by Councilman Carolyn McDowell for adoption, seconded by Councilman Len Stella and approved unanimously. NEW BUSINESS City Administrator Rich Mays made an announcement regarding the impending flood of the Missouri River and stated that persons who do live in flood areas should be prepared to evacuate before Thursday's river crest. He also announced that the River Rendezvous Arts and Heritage Festival scheduled for the weekend of October 10 was going to be relocated REGULAR COUNCIL MEETING OCTOBER 5 1998 10 to the Jaycees Cole County Fairgrounds. Councilman Carolyn McDowell requested that the petition process for sidewalks be brought up for discussion in the near future. Councilman Carolyn McDowell requested that the issue of overgrown brush in the Wears Creek area be looked into. Councilman Carolyn McDowell stated that the issue of animals defecating on private property has resulted in numerous constituent calls. Keith DeVault, Planning & Code Enforcement Director stated that pet owners can be fined for such a violation, but that enforcement staff have to witness the incident before they can issue a violation. UNFINISHED BUSINESS There was no unfinished business to come before the Council at this time. COUNCIL LIAISON REPORTS Councilman Rick Nilges reminded Council that a Finance Committee meeting will be held Monday, October 12 at 7:30 P.M. to discuss the issue of JCCC relocation issue. Councilman Larry Vincent announced that the Solid Waste Committee meeting has been postponed until November. GO INTO EXECUTIVE SESSION A motion was made by Councilman Carl Jaynes to go into Executive Session for the purpose of discussing real estate, litigation and personnel, seconded by Councilman Larry Vincent and approved unanimously at 9:15 P.M. by the following roll -call vote: Aye: Nay: Blaney, Haake, Jackson, Jaynes, Landwehr, McDowell, Nelson, Nilges, Stella and Vincent None
