Ab~:;eazxt: Nr~n~~, 7l The Clerk presented a communication from the City of Los Angeles requesting the city's cooperation in allevj.ati.ng the smog condition by changing the burning hour; throughout Los Angeles County from a.m. to p,m, on a 90-day trial basis. The Clerk also presented a communication from the County Board of Supervisors requesting that all rubbish burning be prohibited. Councilman Willard moved that the City Attorney be instructed to amend our pr°esc~nt ordinance to permit burning from x:00 to 7:00 p.m, only. This motion f~.il.ed for lack of a ""'~ second. After c~~nsiderable discussion regarding the existing smog condition in this area, i.t was moved by Councilman Pender, seconded by Councilman Pearson, that said communicatians be accepted and filed. All members voting aye, the Mayor declared the motion duly carried. The Clerk presented a communication from the City of Glendale requesting the cityts cooperation in urging the State Legislature to enact perm3.ssive legislation to allow counties to levy a sales tax. The Clerk stated that at the League of California Cities conference a similar resolution was approved that requested the State Legislature to enacf, a uniform sales tax program. It was moved by Councilman Willard, seconded by Councilwoman McMeekin, that said communication be accepted a.nd filed. A11 members voting aye, the Mayor° declared the motion duly carried. It was moved by Councilman Pearson, seconded by Council- man Pender, that the C1.erk be instructed to prepare copies of said sales tax resolution ~,nd .resolution of the County Board of Supervisors regarding same for their study. The Clerk presented a communication from the Lynwood Chapter of the Disabled American Veterans requesting permission to sell forget-me-Hots from Taovember 4 to Novemb~ar 7 inclusive. The City Manager stated that the State Division of Highways had approved plans and specifications for installation of traffic signals a.t the int~'rsection of Long Beach Boulevard and Euclid Avenue and requested authorization to advertise for bids for installation of same. It was moved by Couneilman Pearson, seconded by Councilman Pender, that said authorization be granted, All members voting aye, the Mayor declared. the motion duly carried. The City Manager stated that the State of California Department of Public Health has recently requested the Cify of Lynwood to apply for a permit to operate a domestic water company as provided for in the Health and Safety Code. The Manager further recammend.ed that the Cj_ty comply with this request. It was moved by Councilman Pearson, seconded by Councilwoman McMeek~.n, that the Manager be authorized to sign and file said application with the State Board of Public Health, All members voting aye, the Mayor declared the motion duly carried. The City Manager stated that the County administrative officers have requested that the City of Lynwood enter :into an agreement with Mr. Arthur Froehlich, architect for the furnishing of plans and specifications for the construction of the library structure which is to be leased to the County after completion. The Manager stated that he has, along with the City Attorney, prepared. the necessary agreement and recommended that said. contract be approved, It was moved bar Councilman Willard, seconded by Councilman Pender, that the City Council concur in 'the recommendations of the City Manager in the approval of said contract and authorize the Mayor a.nd Clerk to execute same on behalf of the City. The City Manager stated that revisions are necessary in the agreement with the State Division of Highways for the expenditure of gas ta.x monies and wished to present the first supplemental memorandum of agreement for the expenditure of said moneys. Whereupon, RESOLU`1'ION N0. 2571 entitled "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADOPTING BUDGET AND APPROVING FIRST SUPPLEMENTAL MEMORANDUM OF AGREEMENT FOR THE EXPENDITURE OF GAS TAX ALLOCATION FOR MAJOR CITY STREETS" was presented. The City Manager presented a communication from the Lynwood Police Office~~as R¢3~.ief and Welfare Association wherein they requested permission from the Council to sponsor a program (barbecue ) to be offered .r~ thy. City Park on Sunday, October 31 for the purpose of promot;in~ farads to complete playground facilities at the Rancho Los Amigos for use of polio patients. It was moved by Councilman Pe~lder, seconded. by Councilman Willard, that said permission be granted, A11 members voting aye, the Mayor declared the motion duly carried, The City Attorney wished to call the Gouncil.~s attention to the previously approved architectis contract for. the library in that there is no penalty clause for fa?lur~~ to complete plans and specifications within t-he required sixty day period. After discussion, it was moved by Councilman Pender, seconded by Councilman W:i~l.lard., that the City Attorney be authorized to prepare an amendment to said contract that would provide a penalty clause for failure to perform and other provisions a.s he deemed necessary to protect the cityfs interests.
