HomeMy Public PortalAbout19990201REGULAR COUNCIL MEETING FEBRUARY 1, 1999 1 CALL TO ORDER The Regular Council Meeting of February 1, 1999, was convened at 7:30 P.M. by Mayor Duane Schreimann. Prayer was offered by Rev. Ed Hawkins, Western Hills Assembly of God, followed by the Pledge of Allegiance ROLL CALL The following Council Members were present for the roll call: Present: Blaney, Jackson, Jaynes, Landwehr, McDowell, Nelson, Nilges, Stella and Vincent Absent: None A quorum was declared present. SEATING OF NEW COUNCILMAN City Clerk Phyllis Powell administered the oath of office to Catherine Haake to fill the unexpired term of the late Councilman James Haake as Ward Two City Councilman. PRESENTATIONS FROM THE GALLERY Mr. Joe Wilson, 422 Oberman Place, made a presentation regarding the City's ordinances regarding animals, and specifically bill 98 -160 which is on the agenda as a pending bill. Mr. Wilson stated his opposition to the amendments currently being proposed. CONSENT AGENDA The following items were presented for approval on the Consent Agenda: a. Minutes of January 19, 1999, Regular City Council Meeting b. Proposal 1666 (RENEWAL) - Towing of Abandoned Vehicles, Police Dept. Councilman Carl Jaynes requested that information be given to the Council regarding item (b) to explain Chief Johnsen's memo about the towing issue. City Counselor Allen Garner stated that he would put something in writing to give to the Council. A motion was made by Councilman Steve Nelson for approval of the Consent Agenda as presented; motion was REGULAR COUNCIL MEETING FEBRUARY 1, 1999 2 seconded by Councilman Charles Jackson, and approved unanimously. MINUTES AND REPORTS RECEIVED & FILED Mayor Duane Schreimann announced that the following reports have been received and are on file in the City Clerk's Office: a. Housing Authority Board of Commissioners, Dec. 17, 1998 b. Planning & Zoning Commission, Dec. 10, 1998 c. Public Works & Planning Committee, Jan. 19, 1999 MAYORAL APPOINTMENTS Introductory Police Officer - John Strobel: A motion was made by Councilman Charles Jackson to approve the recommended appointment, seconded by Councilman Larry Vincent and approved unanimously. The following appointment was made by Mayor Duane Schreimann which did not require Council approval: Housing Authority Board of Commissioners - Evelyn Loethen (reappointment). BILLS INTRODUCED Bill 98 -162, sponsored by Councilman Nelson, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A PORTION OF THE RIGHT -OF -WAY OF CITY VIEW DRIVE LYING ADJACENT TO AND EAST OF THE EAST LINE OF LOT NO. 6 OF RE -LOCK ESTATES. Bill 98 -161, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ESTABLISHING ADDITIONAL PROCESSES FOR ISSUANCE OF ECONOMIC ASSISTANCE LOANS AND AUTHORIZING A CONTRACT WITH THE CHAMBER OF COMMERCE TO EFFECTUATE THE PROGRAM. Bill 98 -161 was read third time by title and placed on final passage. Following discussion, Councilman Rick Nilges moved that a Substitute Bill 98 -161 be accepted as previously distributed to Council in their packets. Motion to substitute was seconded by Councilman John Landwehr and approved unanimously. Substitute Bill 98 -161 was then passed by the following vote as Ordinance 12884: Aye: Blaney, Haake, Jackson, Jaynes, Landwehr, McDowell, Nelson, Nilges, Stella and Vincent Nay: None INFORMAL CALENDAR Bill 98 -147, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE ACCEPTANCE OF GIFT OF CERTAIN REAL ESTATE. Councilman Vincent stated he would like Bill 98 -147 to remain on the Informal Calendar until Council receives assurance from professionals other than Ameren UE about the environmental quality of the site. Bill 98 -151, sponsored by Councilman Jaynes, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING ARTICLE VII OF CHAPTER 18 (MISCELLANEOUS PROVISIONS AND OFFENSES) OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI BY ADDING A NEW SECTION 18 -119 PERTAINING TO THE SALE AND POSSESSION OF LASER POINTERS. Councilman Carl Jaynes requested that Bill 98 -151 be removed from the Informal Calendar for third reading and final passage. After third reading, Councilman Jaynes moved that a Substitute to Bill 98 -151 be accepted as previously distributed to the Council in the packets. Following discussion, a motion was made by Councilman Charles Jackson to amend Section 2, (Subparagraph E.) of the substitute bill by deleting language as follows: E. Exceptions. The prohibition of subsection C of this section shall not apply to the use of laser pointers • • • , . • • ith the permission and REGULAR COUNCIL MEETING FEBRUARY 1, 1999 6 supervision of a person 21 years of age or older. The motion to amend was seconded by Councilman Carol Blaney and approved with Councilman Carl Jaynes voting "Nay." Substitute Bill 98 -151 was then passed, as amended, by the following roll -call vote as Ord. No. 12885: Aye: Blaney, Haake, Jackson, Jaynes, Landwehr, McDowell, Nelson, Stella and Vincent Nay: Nilges NEW BUSINESS Councilman Carolyn McDowell brought up the subject of beacon lights and crosswalks at Thorpe Gordon School. Following discussion, a motion was made by Councilman Carol Blaney that the Council direct staff to begin the process of obtaining flashing beacons, but not to install crosswalks. The motion was seconded by Councilman Carolyn McDowell and approved unanimously. Councilman Carolyn McDowell brought up the subject of crossing guards at Dunklin & Jackson Streets. Interim Police Chief Jim Johnsen stated that due to the low pay and limited number of hours of the job, it is difficult to fill the position of crossing guard. Councilman McDowell suggested the city consider increasing the pay so the positions could remain filled. Councilman Carol Blaney brought up the subject of pedestrian crossings on Missouri Blvd. and on Highway 50. She asked the City to request the state to look into what can be done to alleviate the problem. Councilman Carl Jaynes made comments regarding correspondence received by the Council from Vicki Arcobasso regarding the exhibition hall area in the proposed convention center. He stated that Ms. Arcobasso raised some valid points regarding the number of square feet proposed and suggested that the City take into consideration the issues she addressed. Councilman Rick Nilges requested that City staff look into repairing a "pothole" on W. McCarty near Sho -Me Coach Lines. UNFINISHED BUSINESS There was no unfinished business that came before the Council at this time. COUNCIL LIAISON REPORTS REGULAR COUNCIL MEETING FEBRUARY 1, 1999 7 Councilman Larry Vincent announced that a Solid Waste Committee meeting will be held 5:30 P.M. on Monday, February 15 (prior to the City Council Meetings). APPROVAL OF EXECUTIVE SESSION MINUTES Minutes of the January 19, 1999 First Executive Session and January 19, 1999 Second Executive Session — A motion was made by Councilman Larry Vincent for approval of the minutes as presented, seconded by Councilman Carolyn McDowell and approved unanimously. GO INTO EXECUTIVE SESSION A motion was made by Councilman Carl Jaynes that the Council go into Executive Session at this time to discuss matters pertaining to real estate, litigation and personnel. Motion was seconded by Councilman John Landwehr and approved by the following roll -call vote at 8:50 P.M. Aye: Blaney, Haake, Jackson, Jaynes, Landwehr, McDowell, Nelson, Nilges, Stella and Vincent Nay: None ACTIONS TAKEN IN EXECUTIVE SESSION PERSONNEL: Finance Director: City Administrator Rich Mays made a presentation regarding the process by which the Finance Director search committee reached unanimous consensus on a nominee. Following his presentation, Mr. Mays recommended that Steve Schlueter be hired as Finance Director at a salary of $60,000.00. After discussion, a motion was made by Councilman Carl Jaynes to accept the recommendation, seconded by Councilman Steve Nelson, and approved unanimously by the following roll -call vote: Aye: Blaney, Haake, Jackson, Jaynes, Landwehr, McDowell, Nelson, Nilges, Stella and Vincent Nay: None
