ADJOURNED REGULAR MEETING APRIL 24, 1956
The City Council of the City of Lynwood. met in an
adjourned regular session in the City Hall, 11330 Builis Road,
on above date at 3:00 p.m.
Mayor Compton in the chair.
Cauncilmen Compton,. Finch, McMeekin, Pend.er, and.
Summers answered the roll call.
It was moved by Councilwoman McMeekin, seconded by
Councilman-Summers, that the minutes of the previous regular meet-
ing of April 17, 1956 be approved as written. All members voting
aye, the Mayor declared the motion duly carried.
The City Clerk presented. a communication from Mr. J. Jack
Willard. concerning the request of R. Y. OtShaughnessy for reinstate-
ment to the Lynwood Police Department. He expressed. his personal
views concerning the request and appealed to the Council not to
rescind. the original resignation of Mr. OiShaughnessy.
Whereupon, it was moved by Councilman Pend.er, seconded.
by Ca;.~ncilman Finch, that said letter be accepted, and filed. All
.members voting aye, the Mayor declared the motion duly carried.
The Clerk presented. a communication from Calvert E.
Williams, 4235 Brewster, also concerning the request of R. Y.
OtShaughnessy for retirement. He expressed his personal views
regarding the request and. hoped that the Council ~Tou1d. see fit
to reinstate him to his former position. It was moved by Council-
woman-McMeekin, seconded. by Councilman Summers, that said communi-
cation be received and filed. All members voting aye, the Mayor
declared. the motion du~.y carried.
-The Clerk presented a copy of a communication from the
Citizens Interim Committee to Protect Police Officers which was
addressed to Mr. J. Jack Willard.. The Clerk stated. that the
letter went into great detail concerning recent suspensions and
personnel hearings. It requested the Council to deal with Mr.
OxShaughnessy~s request in a fair and efficient manner. It was
moved by Councihvaman McMeekin, seconded by Councilman Finch,
that said letter be accepted and. filed. All members voting aye,
the Mayor declared the motion duly carried..
The City Attorney read his report concerning the .request
for reinstatement of R. Y. OtShaughnessy. The Attorneys opinion
was that the letter of March 5, 1956, legally constituted. a res-
ignation by Captain OtShaughnessy of his position as a member of
the Lynwood. Police Department. It was moved by Councilman Pender,
se~.~onded. by Councilwoman McMeekin, that said report be accepted.
and. filed. All members voting aye, the Mayor declared. the motion
duly carried.
The Manager stated. that the Metropolitan Water District
is requesting the City Council to indorse Proposition "W" which
is to appear on the June fifth ballot. The proposition would.
enable the Metropolitan Water District to issue bonds in the amount
of $50,000,000 to finance needed. construction. The Manager
further stated. that should. the proposal receive a favorable vote
in June,it would not result in increased taxation, and. recommended.
adopting a resolution indorsing Proposition "W."
Thereupon, RESOLUTION N0. 2645 entitled."RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF LYNWOOD ENDORSING PROPOSITION
"4d" TO APPEAR ON THE JUNE 5, 1956 PRIMARY ELECTION BALLOT" was
presented.. It was moved by Councilwoman McMeekin, seconded by
Councilman Summers, that said resolution be adopted..

T~~.e Mayor inquired if there were any oral communications.
Mr. Charles Taylor, 629 South Hill Street, representing
Mr. R. Y. O4Shaughnessy, asked if the Council was going to take
any action on the application for reinstatement of Mr. 09Shaughnessy.

The Manager stated. that pursuant to the provisions ~
of the personnel ordinance, requests for reinstatement must be
made to the Chief of Police.
Mr. Frank Heller, also representing Mr. O~Shaughnessy,
addressed the Council regarding the interpretation of Mr.
OtShaughnessy4s letter of resignation.
The City Attorney stated. that said. letter d.id. constitute
a resignation and that the Council has no jurisdiction in the
matter.
Mr. John Koenig, 3254-A Palm, addressed. the Council
regarding the Courzcil~s jurisdiction in accepting and rescinding
said. resignation.
Mr. George Kennedy addressed the Council stating he
felt it was the duty of the Council to determine whether or not
the letter was a resignation or an application for retirement.
Mr. Willis Carter, 11254 Atlantic, asked the Council
if the former Council had. authority to .accept the resignation,
why this Council had not the same jurisdiction.
The City Attorney explained. the authority to Mr. Carter.
There was considerable discussion by both the Council
and the attorneys representing Mr. O~Shaughnessy regarding his
request.
Mr. R. Y. O~Shaughnessy, 3656 Virginia, addressed the
Council and. stated. that at the time he submitted. his letter he
told the City Manager it was not a resignation; it was an
application for disability retirement, as so stated in the letter.
The City Manager stated. that he didnit see any
difference between a resignation and. a retirement.
The City Attorney stated. that in view of the statements
by the City Manager and Mr. OtShaughnessy, he believed the Council
should. use its subpoena power and. set this matter for hearing
to bring out all the facts.
It was agreed by the members of the Council that at
the next regular meeting of the City Council proceedings shall
be held. to d.etermir~e whether the letter filed. by Captain R. Y.
O~Shaughnessy did or did not constitute a resignation.
It was moved. by Councilwoman McMeekin, seconded by
Councilman Pender, that the meeting be adjourned. All members
voting aye, the Mayor declared. the mot'
