HomeMy Public PortalAboutM 1956-05-31 - CC SPECIAL MEETING MAY 31,.1956 The City Council of the City of Lynwood met in a special session in the City Ha11, 11330 Bullis Road, on above date at 8:00 a.m, Mayor Compton in the chair. Councilmen Compton, Finch, and. Pender.answered the roll call. r^ Councilwoman McMeekin and Councilman Summers were .absent. The Mayor explained that the purpose of calling this special meeting was to consider misconduct of Officer Bailey, and the administrative action taken by Captain O~Shaughnessy in said matter, and to take disciplinary action against said officers, if found necessary.. The Mayor explained that the Council had met as an exe-~ cutive body and had considered both oral and written testimony regarding the conduct of said officers. After considerable discussion, it was moved by Councilman Finch, seconded by Councilman Pender, that Officer Bailey be sus- pended for a period of three days without pay for conduct unbecoming an officer and that the-Chief of Police be directed to bring said suspension about so as not to coincide with off-duty time.. Roll Call: .Ayes: .Councilmen Compton, Finch, and. Pender. Noes: None. Absent: Councilwoman McMeekin and Councilman Summers. It was moved. by Councilman Pender, seconded by Council- man Finch, that Captain R. Y. O~Shaughnessy be suspended for a period. of three days without pay for violation of specific instructions contained in the report to the Police Department by the City Council, dated. May 2, 1956., The City Attorney stated that the suspensions should. be made in conformance with the provisions of the Personnel Ordinance. ~ ~Counciirnan Pender withdrew his motion and Councilman Finch withdrew his second. It was moved by Councilman Finch, seconded by Councilman Pender, that the previous action concerning Officer Bailey be res- cinded. to consider rephrasing .the motion. All members present voting aye, the Mayor declared the .motion duly carried. It was moved by Councilman Pender, seconded. by Council- man Finch,,. that the Council recess for a period. of five .minutes. All members present voting-aye, the Mayor declared the motion duly carried. After the recess, the Mayor called the meeting to order. Councilman Summers arrived. and took his place at the table. There .was a discussion as to the advisability of having the two officers under discussion present wherein the officers were invited to attend. the meeting. The Mayor inquired. of Officers Bailey and 0~ Shaughnessy whether the executive meeting held Tuesday, May 29 regarding their misconduct was sufficient for the Council to take whatever action they deemed advisable, or whether the .officers wished to have a public hearing on the .matter. Officers Bailey and OtShaughnessy stated. they-were satisfied. with the present procedure, and. waived the right to a public hearing. Thereupon, it was moved by Councilman Pender, seconded by Councilman Summers, that Officer Bailey be suspended for three days without pay for conduct unbecoming an officer and that said. suspension shall commence within a two~day period .and. during regular working days. Roll Call: Ayes: Councilmen Compton, Finch, Pender, and Summers. Noes: None. Absent: Councilwoman McMeekin. It was moved by Councilman Finch, seconded by Councilman Summers, that .Captain O~Shaughnessy be suspended for a period. of three .days for failure to follow the chain of command and for ,~ 4 violation of specific instructions contained.. in the report to the Police Department by •t he City Council, dated. Absent: Councilwoman McMeekin. Captain OtShaughnessy stated that he felt the penalty was unjust and. too severe for his action in said matter.
