AN CROINANCE AMENDING- CHAPTER 27, MCA.B CITY CODE 1965
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOAB,
UTAH:
Thatection 02.0708, Chapter 27 Moab City Code 1965 be, and the
same is, hereby amended to read as follows:
:27-4-3
"02.0703 NON -CONFORMING LOTS OF RECORD
Even though a lot fails to meet the area or width requirements for one -
family dwellings within a zone, a one -family dwelling may be permitted
on such a lot in any zone in which dwellings are permitted, provided the
lot was on record in the office of the County Recorder at the time of the
passage of this Ordinance and the :subdivision in which it is located has
had substantial development. Where two (2) or more contiguous lots of
record are owned by the same person in a swbdivision approved after
January 1, 1975, the land included in the lots shall be considered to be
an undivided parcel, and after January 1, 1975, no -portion of such parcel
shall be used as a dwelling :site or sold which does not meet the area and
width requirements of the zone in which the lot is located. Yard dimen-
sions and other requirements not involving .area or width shall, conform
to the regulations of the zone in which the lot is located except when
granted a variance by the Board of Adjustments."

That Section 02:-e554,443, Chapter 27, Moab City Code 1965, be, and
and the same is, hereby amended to read as follows:

"An area of not less than nine thousand (9000) square feet shall be provided
and maintained for each one -family dwelling and uses necessary thereto«
For two-family dwellings, child day care centers, and foster family care '•
homes; the building site shall contain at least ten thousand (10,000) .
square feet.
An area of not less than five (5) acres shall be provided and maintained
for each planned unit development except that there shall be no area
requirements for additions to an approved planned unit development.
An area of not less than two (2) acres shall be provided and maintained
for each main church building."
This Crdiriance shall become effective twenty (20) days after publication.
Paasad by a unanimous vote of all members of the City Council of Moab
