HomeMy Public PortalAboutM 1957-12-26 - CC407 SPECIAL MEETING DECEMBER 26, 1957 The City Council of the City of Lynwood. met in a special session in the City Hall, 11330 Bullis Road., on .above date at 2 p.m. Mayor Compton in the chair. Councilmen Compton, Finch, McMeekin, Pender, and Summers answered. the roll call. The Mayor stated. the purpose of the special meeting: to discuss and possibly take action on amending the procedure for con, ducting personnel hearings; to discuss passing a new personnel sys- tem ordinance which would. repeal the present ordinance, lyo. 609, for submission to the electorate at the general municipal election to be held. on April 8, 1958 The City. Clerk informed the Council that the last day for pl~~sing said. proposed, ordinance on the April ballot would. be February 13, The Mayor stated that the Personnel Board has prepared for the Councilis study a recommended. personnel system ordinance. Chairman of the Personnel Board, Louis Reggiardo, presented to each member of the City Council a copy of the proposed ordinance and. explained. the contents of the Board+s recommendations. He stated. that there are several important changes frcun,the present ordinance, some of which are: 1. Method of appointing the chief of the Police and Fire Department, respectively, so as not to restrict the appointment ~o the members of the department. 2. Clarification of procedures for reinstatement of former employees. 3. The appointing authority for all departments shall be the City Council, City Manager, and the department head. 4. Provide for temporary appointment of Board. members in cases of extreme emergency. 5. Provide for method of contracting with outside agency to eond.uct hearings, at request of Board. 6. Provide that written charges, when requested. by employee,. shall be made within 5 da~rs from date of discharge. 7. Clarification of matters which may be appealed. by employee to Board.. After considerable discussion regarding matters which may be appealed. to the Board, it was moved by Councilman Summers, seconded. by Councilwoman McMeekin, that the words "discriminatory action" be deleted.from Section 10 (Right of Appeal) of the recommended personnel system ordinance. All members, except Councilman Finch, voting aye, ' the Mayor declared. the motion .duly carried.. It was moved. by Councilman Finch, seconded. by Councilman Pend.er, that Section 9, Paragraph (a) (Cause for Disciplinary Action) of said recommended ordinance be amended to read. as follows:.. "Any person in whom is vested appointing authority shall have the right of removal, demotion, and suspension of employees, subject to the employees right of .appeal as herein provided.." All members voting aye, the Mayor declared the motion duly carried. Mr. George Kennedy, attorney representing the American Legion, Veterans of Foreign Wars, and. Disabled American Veterans organizations of Lynwood., requested. that Section 6, Paragraph (b) (Veterans+ Credits) be expanded. to include additional credits for disabled veterans and widows of veterans, similar to the credits given veterans under the Federal Civil Service laws. The Mayor asked. Mr. Kennedy to submit his- recommendations to the Personnel Board, and a7.so requested. the Personnel Board to conduct an investigation of the accepted. practice in granting veterans additional credits in examinations. Mr. James Riley and. Mr. Eldon Pierce, members of the .Fire Department, addressed the Council expressing their views and general opposition to the proposed. ordinance, particularly the section which would. permit selection of chiefs from outside of the department. Councilman Summers excused. himself from the meeting. Mayor Compton stated. that the Council would be pleased. to meet with the members of the Fire Department and. discuss the proposed. ~4 0 $ ordinance. The City Attorney presented. to each member of the City Council his suggestions relative to shortening personnel hearings and. placing conduct of the proceedings more effectively under con- trol of the Board . It was moved. by Councilman Finch, seconded. by Councilman Pend.er, that action on the suggestions submitted. to the Council by the Attorney be held. over to allow the Council further study.
