HomeMy Public PortalAbout19970407 NEW COUNCILREGULAR COUNCIL MEETING APRIL 7, 1997 (NEW COUNCIL) CALL TO ORDER The Regular Council Meeting was called to order on April 7, 1997, 8:00 PM with Mayor Duane Schreimann presiding. ROLL CALL The following Council Members were present for roll call: Present: Byrd, Haake, Jackson, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Absent: None A quorum was declared present. ELECTION OF PRESIDENT PRO TEMPORE Councilman Carolyn McDowell nominated Councilman Charles Jackson. A motion was made by Councilman Bill Byrd that nominations cease and that Councilman Charles Jackson be elected by acclamation, seconded by Councilman Steve Nelson and approved unanimously. Councilman Charles Jackson was elected President Pro Tempore for the 1997 -98 City Council. ELECTION OF PLANNING AND ZONING COMMISSION REPRESENTATIVE Councilman Carolyn McDowell nominated Councilman Carl Jaynes. A motion was made by Councilman Charles Jackson that nominations cease and that Councilman Carl Jaynes be elected by acclamation, seconded by Councilman Bill Byrd and approved unanimously. Councilman Carl Jaynes was elected Planning & Zoning Representative for the 1997 -98 City Council. PLANNING & ZONING ALTERNATE: Councilman Carl Jaynes nominated Councilman John Landwehr. Councilman Charles Jackson moved that nominations cease and that Councilman John Landwehr be elected by acclamation, seconded by Councilman Steve Nelson, and approved unanimously. Councilman John Landwehr was elected Alternate Planning & Zoning Representative for the 1997 -98 City Council. MAYORAL APPOINTMENTS REGULAR COUNCIL MEETING APRIL 7, 1997 (NEW COUNCIL) Mayor Duane Schreimann announced the following appointments to Council Committees for the 1997 -98 City Council: Finance Committee: All Councilmen Public Works & Planning Committee: All Councilmen Solid Waste Committee: Councilmen Larry Vincent, John Landwehr, Steve Nelson, Carolyn McDowell and Carl Jaynes Appointments Review Committee: Councilmen Charles Jackson, Randy Kammerdiener, James Haake, Rick Nilges and Bill Byrd Ad Hoc Annexation Committee: All Council Members Ad Hoc Committee to Study Subdivision Ordinances: All Council Members Council Representatives to boards & commissions: Cable Quality Commission - Councilman Randy Kammerdiener Historic Preservation Commission - Councilman Bill Byrd Parks & Recreation Commission - Councilman Larry Vincent Transportation & Traffic Commission - Councilman Carolyn McDowell USS Jefferson City Submarine Committee - Councilman Carl Jaynes E -911 - Councilman Rick Nilges Following the Mayor's announcement, a motion was made by Councilman Larry Vincent to approve the appointments, seconded by Councilman Carl Jaynes and approved unanimously. Mayor Duane Schreimann stated that immediately following the April 21, 1997, City Council Meeting, the Council Committees would convene for the purpose of electing their chairmen and co- chairmen. PUBLIC HEARINGS Rezoning 2.04 acres located in Neutzler's Early American Subdivision, Section One, from RS -2, Single Family Residential, to RD, Two - Family Residential (Bill 97 -1). A presentation was made by Keith DeVault, Director of Planning & Code Enforcement, to explain the background of the request for rezoning. The following persons spoke in favor of the proposed rezoning: Larry Scheppers, President, Capital Savings Bank The following persons spoke in opposition to the proposed rezoning: Gary Maienschein, Yorktown Drive REGULAR COUNCIL MEETING APRIL 7, 1997 (NEW COUNCIL) Roland Tackett, 2407 Yorktown Drive Duane Cossey, 2304 Plymouth Rock Drive Keith Henderson, 2324 Yorktown Drive Cindy Tandy, 2400 Yorktown Drive David Sylvester, 2325 Yorktown Drive Joe Pinkston, 1900 Bunker Hill Don Lock, 1900 Pilgrim Court Mrs. Don Lock, 1900 Pilgrim Court Gloria Cossey, 2304 Plymouth Rock Following comments by the public, Councilman Rick Nilges requested that he be provided with minutes of the 1992 and 1993 Planning & Zoning Commission meeting minutes, as well as the March 17, 1997, meeting minutes. Councilman Rick Nilges requested that the Law Department draft ordinances necessary to ensure that a rezoning public hearing is not held the same night as a bill pertaining to that rezoning is introduced. Councilman Carolyn McDowell requested that staff consider putting up signs about rezoning and going beyond the 185' limitations prescribed by state statute. Councilman Carl Jaynes stated that he wished to withdraw both Bills 97 -1 and 97 -3 at this time. RECESS: At the conclusion of the public hearing, Mayor Duane Schreimann called a five - minute recess. Following the recess, Council was reconvened by Mayor Duane Schreimann at 9:35 PM. PUBLIC HEARINGS CONTINUED: Rezoning property located at northeast corner of W. Edgewood Drive & Diamond Ridge, from C -1, Neighborhood Commercial, to C -2, General Commercial (Bill 97 -2). A brief background of the rezoning request was presented by Keith DeVault, Director of Planning & Code Enforcement. No one present wished to speak in favor of, or opposition to, the proposed rezoning. Mayor Duane Schreimann declared the public hearing concluded. CONSENT AGENDA The following items were brought before the Council on the Consent Agenda: a. Permissive Use at Dupont Circle & Truman Blvd. b. Conditional Use at 1716 Jefferson Street A motion was made by Councilman Carolyn McDowell to approve the Consent Agenda as REGULAR COUNCIL MEETING APRIL 7, 1997 (NEW COUNCIL) presented, seconded by Councilman Bill Byrd, and approved unanimously. ANNOUNCEMENTS BY MAYOR There were no announcements by the Mayor at this time. MAYORAL APPOINTMENTS Lead Telecommunications Operators - Sherry Scrivner, Doug Keeney and Donna Alieksaties. A motion was made by Councilman Randy Kammerdiener to approve the appointments, seconded by Councilman Bill Byrd, and approved unanimously. NEW BUSINESS Date for Brandhorst Appeal Hearing - Councilman Carolyn McDowell moved that the hearing be set for the April 21, 1997, City Council meeting, seconded by Councilman Larry Vincent and approved unanimously. Councilman Carolyn McDowell commented on a letter recently written to TCI by Associate City Counselor Donna White. She requested that Ms. White find out what the administrative charge means which is shown on the customers' bill. Parks & Recreation Department Director Bill Lockwood made comments regarding the Request for Proposal for the new golf course. Councilman Charles Jackson announced that the ad hoc committee to study subdivision ordinances will meet at 7:00 PM on April 17. Councilman Carolyn McDowell thanked the Public Works Department and Police Department for their participation in the recent IC3 Flexliner train event in the City. Councilman John Landwehr announced that a public hearing has been called for the Ventura Area annexation on April 21, 1997, at 5:30 PM, and the Algoa Area on May 19, 1997, at 5:30 PM. EXECUTIVE SESSION Councilman Charles Jackson moved that the Council go into Executive Session at this time for the purpose of discussing real estate, personnel, and litigation. Motion was seconded by Councilman Carl Jaynes and approved by the following roll -call vote at 10:10 PM: Aye: Byrd, Haake, Jackson, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, and Nilges and Vincent Nay: None
