It was moved by Mayor Finch, second.ed'.by,Councilman Rowe,
that the minutes of the regular meetin~Ao~f= Januarjy 20, 1r~59
be approved. as written. All members present voting aye,
the :~~iayor declared. the motion duly car~~i~d.,
The report of the City Attorney concerning th.e request Alpha Beta
of the Alpha Beta Market to conduct a free circus and Market v
carnival ad.~jacent to their market at 351 Century Boule® Request for
v.~d~d. was presented., wherein he stated that :lf the Council Circus or
f:~nds that the proposed entertainment is not a circus but Carnival
~ carnival, and. that it constitutes an "accessory" use
(a`s d.efined by the zoning ord.inance), then the special
permit provisions of the business license ordinance would.
not apply and. the general business license would. cover the
operation.
Mr. R. 0, Kabot, representing Kabot Enterprises, explained.
the proposed entertainment program.
After considerable d.iscussian regarding the method of
operating this entertainment program, it was moved. by
Cora.nc:ilman English, seconded by Councilman .Finch, that the
Courscil finds that the type of entertainment that the
rraarket proposes is not a circus but a carnival.

Absent: Councilmen Pender and. Summers.
Following discussion as to whether or not the promotional.
activities are incidental to the primary uses of a superm
market, it was moved by Councilman .English, seconded by
Councilman Finch, that the City Council finds that the
performance is accessory to the primary uses of a super-
market, and. that the special permit provisons of the
business license ordinance (Subd.ivision 3 of Section 5.03)
d.o not apply.

The Manager presented a communication from the City Employees9
Employees Association wherein they request the Council to Association
give consideration to increasing by $2.00 per employee per Request for
