HomeMy Public PortalAbout2007.05.15 VARHA LeaseTHIS AGREEMENT is made and entered into this I D tk day of Mau, 20D7, by and between the City of McCall, a municipal corporation of the Statejof Idaho, hereinafter referred to as "Lessor" and _Valley Adams Regional Housing Authority_, hereinafter referred to as "Lessee." Recitals That the Lessor, for and in consideration of the rents, covenants and agreements hereinafter mentioned on the part and behalf of the said Lessee to be paid, kept and performed, does by these presents grant, demise and lease unto the Lessee, and the Lessee does by these presents hire, rent and take from the Lessor, the following described equipment (hereinafter the "property"), to -wit: One used Dell laptop computer and case, model Latitude D600 s/n 89nwc51, with installed operating system. 1. TERM: This Lease shall be from Y�xto year basis terminable by either party upon thirty (30) days written notice. The term commences upon the _Fifteenth day of May , 2007. 2. RENTAL: Lessee covenants and agrees to pay rent for said equipment in the surn of $ 10.00 per _year—, payable upon the _First_ day of each and every �_ term. erm. If the tenancy is terminated at any time before the month/year, no part of the rent will be returned. 3. USE OF PROPERTY: Lessee covenants and agrees that the leased equipment shall be used for lawful purposes, and any other business that is compatible therewith, and shall not be used for any other purpose or purposes without the prior written consent of Lessor. 4. MAINTENANCE: Lessee agrees to maintain the equipment in as good condition as the same is in at the time Lessee shall take possession of the equipment, reasonable wear, tear and damage by the elements excepted. 5. COMPLIANCE WITH LAW: Lessee agrees to comply with all municipal, state and federal laws, rules, regulations and ordinances and to do all things necessary to stay in compliance. 6. LIABILITY: Lessor shall not be liable for any injury or damage which may be sustained by any person or property of the Lessee or any other person or persons resulting from the condition of said equipment or any part thereof, or from any other source or cause whatsoever, nor shall the Lessor be liable for any defect in the equipment, latent or otherwise, and Lessee agrees to indemnify and hold harmless Lessor from such liability. LEASE - 1 7. SURRENDER OF POSSESSION: Lessee agrees to surrender possession of said leased equipment to Lessor at the expiration of this Agreement, or any extension thereof, in the same condition as when the same was received by Lessee, wear and tear, reasonable use and occupancy and damage by the elements excepted. 8. WAIVER: No waiver of any provision of this Agreement shall be valid unless in writing and signed by the party to whom compliance is owed. 9. SEVERABILITY: If any portion or portions of this Agreement shall be, for any reason, invalid or unenforceable, the remaining portion or portions shall nevertheless be valid, enforceable and carried into effect, unless to do so would clearly violate the present legal and valid intentions of the parties hereto. 10. SITUS: This Agreement shall be subject to and governed by the laws of the State of Idaho.
