AN ORDINANCE TO AMEND THE CODE OF ORDINANCES
TO AMEND SEC. 3 -050, OBSTRUCTION TO VISION AT STREET INTERSECTIONS,
FOR THE CITY OF TYBEE ISLAND, GEORGIA
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia
to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of
the citizens of Tybee Island, Georgia, and
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is the Mayor and Council thereof, and
WHEREAS, the governing authority desires to adopt ordinances under it police, zoning,
and home rule powers, and
WHEREAS, the City of Tybee Island so as to amend Section 3 -050 of the Land
Development Code pertaining to unsafe structures; and
NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee
Island that Sec. 3 -050 is amended so that it will hereinafter read as follows:
Sec. 3 -050. Obstruction to visions at street intersections.
Intersection requirements are intended to provide better vehicle safety on the public roads. A
clear sight triangle gives motorists a view of other oncoming motorists when approaching a road
intersection.
On all corner lots, no fence, shrubbery or other obstruction to traffic sight vision, except utility
poles or light or sign standards, shall encroach into an area as measured from three feet above the
level of the adjacent driving surface to ten feet above the level of the adjacent driving surface,
within a triangular area formed by the intersection of the right -of -way lines of two streets and a
diagonal line which intersects the right -of -way lines at two points, each 25 feet distance from the
intersection of the right -of -way lines or, in the case of a rounded corner, from the point of
intersection of their tangents except where site conditions require greater or lesser setbacks as
determined by a traffic engineer. See Illustration 1 for visual clarification.

It is understood that if this permit is granted the builder will at all times comply with the zoning, subdivision, flood control, building, fire,
soil and sedimentation, wetlands, marshlands protection and shore protection ordinances and codes whether local, state or federal, including
all environmental laws and regulations when applicable, subsequent owners should be informed that any alterations to the property must be
approved by the issuance of another building permit. Permit holder agrees to hold the City of Tybee Island harmless on any construction
covered by this permit.
This permit must be posted in a conspicuous location in the front of building and protected from the weather. If this permit is not posted
work will be stopped. The building contractor will replace curb paving and gutter broken during construction. This permit will be voided
unless work has begun within six months of the date of issuance.

setback requirements are met. I understand also that a certified plot plan showing elevation must
be attached to this application and that an as -built elevation certification is due as soon as the
