The applicant, Mark Marsh of Digby Bridges, Marsh & Associates, P.A., as agent for Harry and Deborah Sargeant, is seeking approval to demolish an existing home, create two lots and construct a new single family home and accessory structures on one of the lots (Lot 11) on a parcel of property described as Lots 11 and 12 of the McLouth subdivision. The nature of the request requires a recommendation to the Town Commission for a Subdivision Review, a Land Clearing Permit, a Variance to retain an existing non -conforming accessory structure and a Level 3 Architectural/Site Plan Review. No other Board actions are necessary. Please note that the applicant originally applied for an additional setback Variance for the dock but has since requested to withdraw it Project Description Demolition The applicant proposes to demolish the existing Gulf Stream -Bermuda style home, which is approximately 6,500 square feet in size. The property then will be subdivided and two new homes constructed. Demolition will begin shortly after receiving Town approval, and construction begun on the new houses immediately thereafter. The existing home was not identified by the 1990 Historic Site Survey as having historic potential. The demolition will include all existing improvements with the exception of a 310 square foot storage shed located near the northwestern corner of the property. The request to Architectural Review & Planning Board Members ARPB File #97-02 February 21, 1997 Page 2 retain this accessory structure requires approval of a Variance, which is covered later in this report Subdivision The existing property originally was platted as two separate lots (Lots 11 and 12). However, the lots were automatically unified when the existing house was built across the property line separating the lots. Accordingly, even though the applicant wishes to revert to the original lot configurations, approval of a subdivision is required. Both of the proposed lots are crossed by a private road, which significantly reduces the Effective Lot Area of each. Lot 11 has a platted lot area of 60,198 square feet, but an Effective Lot Area of only 52,111 square feet Likewise, Lot 12 has a platted area of 51,382 square feet; but an Effective Lot Area of only 40,900 square feet The Effective Lot Area is used to calculate the maximum Floor Area and setbacks. Both lots have an irregular shape. On average, though, Lot 11 is about 200 feet wide and 300 feet deep. Lot 12 averages about 225 feet of width and is about 225 deep. Home Lot 11 is the subject of this application. Lot 12 is the subject of ARPB File #97-03, which consists of a proposed new home for Mr. Sargeanrs brother Dan. Because the lots are to be developed simultaneously, and because the owners are related, the site designs and landscaping have been jointly developed. On lot 11, the applicant proposes to construct a two-story home with six bedrooms and six full- and two half -baths. Other structures include an attached three -car garage, a detached pool house with a half -bath, and the existing storage shed. The total living area is 9,315 square feet and the gross floor area, including the living area, garage and covered patios, is 12,998 square feet The gross floor area also includes the "bridge" connecting the garage to the house as well as the double -counting of the floor area of the living room and entrance foyer, which are open to the second floor. A colored rendering will be presented at the meeting. While the Venetian Mediterranean style has similar design elements and features to the Spanish -Mediterranean style, it differs significantly in the form of the building itself. Spanish -Mediterranean architecture is characterized by asymmetrical, rambling building forms. In contrast, the Venetian Mediterranean style consists of highly symmetrical, simple blocks. This results in a formal appearance more typically associated with Colonial -type architecture (i.e. Georgian and Bermuda) than with Mediterranean -type architecture. The proposed home has a first floor elevation of +8.5 feet NGVD. First floor eave lines are at 10', with the second finished floor level set at 13' above the first floor. The second floor eaves are set at 22'-4". Roof heights for one-story elements vary, with the highest being about 18' over the garage. The second floor roof reaches a peak of about 29', with the chimneys extending to 35'. All roof areas have a 4/12 slope. Other proposed improvements to the site include a terraced patio and pool and deck area at the rear of property. In addition, a dock is planned for most of the frontage along the cove. In the front, a driveway leads from the east end of the property to a large, circular brick motor court located in front of the main entrance. The driveway then passes under the "bridge", changes to concrete and turns in front of the garages. It then changes back to brick and leads back out to the street just west of the center of the property. Site Vegetation and Elevations The applicant proposes to save and/or relocate much of the existing significant vegetation throughout the property. As discussed, the landscape plans and overall site plans for both Lots 11 and 12 have been designed together. Accordingly, a master landscape plan for both is included in the packet along with a more specific plan for the subject lot. These are augmented by minimum lot size and dimensional requirements for the zoning district found in Article IV., Section B. of the Design Manual. Based on the materials submitted by the applicant, staff finds the two parcels, as proposed, to be consistent with all applicable subdivision criteria. Both lots exceed the minimum 30,000 square foot size requirement, and both have widths of greater than 100 feet along the adjacent private road. Land Clearing Permit Chapter 58, Article VI of the Town Code of Ordinances provides criteria for the issuance of a Land Clearing Permit In general, a Land Clearing Permit is required for both the removal of significant vegetation and the addition of fill. As discussed, most of the existing significant vegetation will be saved or relocated, and little fill will be needed. Based on the information submitted by the applicant; staff finds the proposed vegetative relocations/removals and addition of fill to be consistent with all applicable Land Clearing permitting criteria with the condition that all remaining or relocated vegetation be adequately protected during construction. Variance to Retain Accessory Structure without a Primary Structure Chapter 66, Article V.2. of the Town Code of Ordinances provides the criteria for reviewing Variances. For a Variance to be approved, the applicant must prove that his request meets all of the criteria. As discussed, the applicant wishes to retain an existing shed after the existing home is demolished. Article III of the Gulf Stream Design Manual permits accessory structures only if they are subordinate to primary structures. Accordingly, a Variance is necessary to maintain the shed after the main house is torn down and the new house is constructed. Side Setback Variance for the Dock The late date of the applicant's request to withdraw this portion of his application requires Board approval of the withdrawal. Staff recommends the Board do so without prejudice. Level 3 Architectural/Site Plan Review Chapter 66, Article V.1. of the Zoning Code enumerates the 12 standards applicable to applications for a Level 3 Architectural/Site Plan Review. These standards include those for demolition as well as consistency with all applicable sections of the Gulf Stream Design Manual. Based on the materials submitted by the applicant, staff finds the project minimally consistent with all applicable Level 3 Architectural/Site Plan Review standards, including those contained in the Gulf Stream Design Manual, with the conditions noted below. The use of Mediterranean elements on the proposed home does diverge from the predominantly Gulf Stream -Bermuda -type elements found on the other homes in the McLouth subdivision. However, the massing and form of the building is similar to the Gulf Stream -Bermuda style and the other homes in its use of symmetry and simple block structure. While designing the home in the Gulf Stream- Bermuda style would help to soften the contrast created by the difference in size, staff does not believe this should be a requirement. It is staffs opinion that the form of the home and use of a very light color are adequate to achieve an acceptable degree of compatibility with the surrounding homes. Accordingly, staff recommends approval of the design subject to a final review of the proposed color. Staff also recommends approval of the site design and other site improvements, with the same conditions pertaining to the exiting shed as noted earlier in this report In addition, staff also recommends the length of the dock be reduced to no more than 80 feet and preferably less. The proposed dock is over 140 feet long — far longer than any other dock on the cove. The intent of the Town's dock regulations (section 66.369 of the Red Book), is to keep docks simple and to permit docks for functional, not aesthetic, purposes. While the basic structural design of the proposed dock is simple, its length is unnecessary and inconsistent with surrounding docks. Recommendation 1. A motion to recommend approval of a two -lot Subdivision as requested, based on a finding that the plans and documents submitted by the applicant meet all applicable Subdivision Review standards. 2 A motion to recommend approval of a Land Clearing Permit based on a finding that the plans and documents submitted by the applicant meet all applicable permitting standards with the condition that all remaining or relocated vegetation shall be adequately protected during construction. 3. A motion to recommend approval of a Variance to retain an existing accessory structure in the absence of a primary structure based on a finding that the plans and documents submitted by the applicant meet all applicable standards with the following conditions: a) Within one year of demolition of the existing house, the applicant shall either remove the shed or obtain and maintain a valid building permit for a new primary residence. b) The shed shall be repainted to match the new residence. c) The shed shall be completely screened from off -premise view once the new landscaping is installed.
