December 10, 1963 from Mr. Compton, <~.ddressed to the Planning Commissior_., which requested a 30 day 1or.ti~:uance of the hear3ing on his request for a variance to construct multiple units on the s°abject property in order that his proposal for financial assistance may be presented. to the ~~ n ~~ 1 t ~~ l~ ~ tU..rl C:'..L i . The City Attorneys report stated the Council could discu~s,the request prior to final action by the Pla:r.Y~ing Commission; 'ghat the city cannot contribute financial assistance to the subdivision and the city has no responsibility to donate its services. The report further stated the owner could construct a private street providing the Planning Commis- sion finds that proper and adequate provision has been made for access to the individual parcels. The City Attorney also stated the City cauld not construct a private street on private property. After considerable discussion, it was agreed by the Council that t;he Planning Commission should make its determination and. be advised of the Councilgs legal position.
