HomeMy Public PortalAboutM 1964-06-16 - CC,- ~59' REGULAR MEETING JUNE 16, 1964 The City Council of the City of Lynwood met in a regular session in .the City Hall, 11330 Bullis Road, on above date at 7:30 p,m, Mayor McMillan in the chair. Councilmen Duncan, Finch, Ham, McMillan and Siokos answered the roll call. It was moved by Councilman Siokos, seconded by Councilman, Finch, that the minutes of the regular meeting of June 3, 1964, be approved as written, All members voting aye, the Mayor declared the motion duly carried. RESOLUTION N0. 64-44 entitled: "RESOLUTION OF THE CITY Res. 64-44 COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE Demands DEMANDS PRESENTED AND ORDEI~~~C~ 'WANRANTS DRAWN THEREFOR." was presented. It was move by Councilman Ham, seconded by Councilman Duncan, that skid resolution be adopted. Roll Call: Ayes: Councilmen Duncan, Finch, Ham, McMillan, Siokos. Noes: None, Absent: None. The.. hour of 7:30 p.m, having arrived, said hour being the time fixed for public hearing on the confirmation of assessment for the repair of certain sidewalks in the city, under the Improvement Act of 19.1, the Clerk presented the Street Superintendents affidavits of serving notice to repair and posting notices to repair, and the affidavit of mailing notices of costs of said repairs, and notice of public hearing. The Clerk stated that no written protests have been filed against the proposed assessments. The Mayor inquired if there were any present in the audience wishing to ~ro'test•~~said proposed assessments. There being. no response, it was moved by Councilman Ham, seconded by Councilman Finch, that said hearing be con- cl~a.ded. All members voting aye, the Mayor declared the :r~oti.on duly carried. Whereupon, RESOLUTION N0. 64-45 entitled:"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, CON- FIRMING THE REPORT OF THE SUPERINTENDENT OF STREETS OF SAID CITY DATED JUNE 16, 1964, RELATING TO CERTAIN SIDEWALK REPAIRS." was presented. It was moved by Councilman Ham, seconded by Councilman Finch, that said resolution be adopted. Roll Call; Ayes: Councilmen Duncan, Finch, Ham, McMillan, Siokos. Noes; None. Absent: None. The Clerk presented an ordinance repealing the provisions for city health .permit fees, and stated that with the rner.ger of the Los Angeles City Health Department and the c",our~ty Health Department, effective July 1, 196.4, the Board of Supervisors has adopted a county public health license ordinance which provides for health license feed to be collected within areas served by the County Health Officer. The Clerk further stated that rescinding the cityts fee provisions will avoid payment of duplicate fees by the business establishments, He also read the list of fees to be charged by the county. Atlantic The Clerk stated that in connection with Atlantic Avenue Ave, Annex Annexation No. 4, the proponents have published the affidavit No. 4~ of publishing the required "Notice of Intention to Circulate Petition," and it would now be in order to adopt a resolution approving the circulation of the annexation petition. Res. 64-4~ Whereupon, RESOLUTION N0. 64-47 entitled: "RESOLUTION Approving APPROVING THE CIRCULATION OF PETITIONS REQUESTING THE ANNEXA- Circulation TION OF ATLANTIC AVENUE ANNEXATION N0. 4 TO THE CITY ~7F of Petitions LYNWOOD." was presented. P.C.Res.282 The Clerk presented Planning Commission Resolution 1Vro. 282 Alameda ##5 recommending the establishment of zone in the recently zoning annexed Alameda Street Annexation No, 5 as M-2 (heavy manu- fac$uring)zone. Whereupon, an ordinance entitled: "AN ORDINANCE AMENDING ORDINANCE N0, 570 FOR THE PURPOSE OF CLASSIFICATION OF CERTAIN PROPERTTES AND THE ADOPTION GF AN AMENDED SECTION OF THE ZONING MAP WHICH IS A PART OF SAID ORDINANCE N0. 57G." was presented for first `reading. It was moved by Councilman Ham, seconded by Councilman Finch, that further reading be waived. All members voting aye, the Mayor declared the motion duly carried. It was moved by Councilman Duncan, seconded by Councilman Ham, that said ordinance be approved as read for the first time, and passed to the second reading, Roll Call: Ayes: Councilmen Duncan, ~'iriCh, Ham, McMillan, Siokos. Grdinance - Alameda Annex #5 - zone establishment Councilman Ham suggested that the Planning Commission "R-A" zone investigate the possibility of creating a new zone classi- suggested for fication such as "R-A." (residential-agricultural), to certain newly provide comparable usage for areas that are annexed to annexed areas the city, thereby not requiring more restrictive zoning after annexation. The Mayor directed that said suggestion be referred to the Planning Commission for their investigation and report. The Cle~'k presented a communication from the National Multiple Sclerosis Society, Southern California Chapter, requesting permission to conduct a fund raising campaign in the City of Lynwood during the month of August. The Clerk stated that the organization does not plan a resi- dential campaign this year, and that they will be approaching business firms and prominent citizens only fo:r contributions. The Clerk also stated that the City of Los Angeles Department of Social Services has issued the necessary approvals. Whereupon, it was moved by Councilman Finch, seconded by Councilman Siokos, that said permission be granted, .All. members voting aye, the Mayor declared the motion duly carried, The Clerk presented a corr~munication from the local Chapter of tr'ie Beta Sigma Phi Sorority requesting permission to sei.l fireworks at 11911 Alameda From June 28 to July 4, 1964, license free, Following discussion of the possible traff ic=problems created at said location, it was moved by Councilman Finch, seconded by Councilman Duncan, that said permission be granted, license free, subject to the rules and regulations governing the sale of safe and sane fireworks in the city, from June 28 to July 4, 1964. All members voting aye,. the Mayor declared the motion duly carried, The Clerk presented a communication from the American r""" Legion Fost No. 85 requesting permission to sell fireworks on the south side of Imperial Highway east of Santa Fe ~'- Avenue, from June 28 to July 4, 1964, license free, The Clerk, as License Collector, recommended the granting of said exemption. It was moved by Councilman Siokos, seconded by Council~xnan Duncan, that the Council grant said permission, license free, subject to the rules and regulations governing the. sale of safe and sane fireworks ire the city, from June 28 to July 4, 1964. Census The Manager advised the Council that the State Department estimate of Finance has officially certified the population of the report. City of Lynwood to be 35,800, effective April 1, 1964, according to their estimates. Long Beach The Manager stated that no complete bids were received for light modi- furnishing the necessary materials to modify the street fication lighting system on a portion of Long Beach Boulevard, and bids therefore, requested authorization to purchase said materials rejected-- without formal bidding. open market purchase Whereupon, it was moved by Councilman Finch, seconded by approved. Baseball The Manager presented a report on providing food concession Association service for the summer baseball events wherein he recommended agreements the city enter into an agreement for such food concession approvedo service with the Lynwood Baseball Association, and in turn, authorize the Association to sublease the concession to the Downey Concession and. Supply Company. The Manager stated that the concession company will pay the Association ~2-1/2~ of the gross receipts for such concession privileges, arzd the Association will use the funds to purchase equipment for their baseball program. Absent: None. 2ahr parki~^~g the Manager reported that the Parking Commission, at its restriction. last regular meeting, voted to abandon the 2-hour parking lifted, restriction on the city-owned parking lot at Mulford and c "~ 4~' Plaza Street, and allow all-day parkings subject to Council approval, The Manager recommended. that the Council concur in the Parking Commissionis action to remove the 2-hour parking restriction on said off-street parking lot, It was moved by Councilman Finch, seconded by Councilman Duncan, that the Council concur in the recommendations of the Parking Commission and Manager in removing said parking time restriction. All members voting aye, the Mayor declared the motion duly carried. The Clerk stated he had been handed a communication from John S. Butera, representing Chico1s Pizza, 12120 Long Beach Boulevard, wherein he requested a 90-day permit to conduct teen-age public dancing on "'Friday and Saturday nights from 8 p.m. to 1 a.m., for groups 16 through 21 years of age. He further stated that no alcoholic beverages are served in.that portion of the restaurant and the necessary reserve police officers would be employed as deemed necessary by the Chief of Police. Mr. Butera addressed the Council, stating that such request has been made to him by various youth groups and that such added activity is necessary for the economic survival of the business. On inquiry by Councilman Finch, the Chief of Police stated that a trial period could determine the extent of the police problems that would be created. The City Attorney advised the Council that minors under 18 years of age are not permitted to attend public dances, in accordance with the adopted city ordinance. The applicant stated he would comply with all city require- ments. Dance permit requested There followed a discussion with the applicant and Council Recess concerning the request. The Mayor declared a 5-minute recess, Following the recess, the Mayor called the meting back to order. Following further discussion, it was moved by Councilman Teen-age danc Finch, seconded by Councilman Siokos, that the Council permit grante grant Chico~s Pizza, 12120 Long Beach Boulevard, a temporary Chicots permit for teen-age (18 through 21 years of age) dancing on Friday and Saturday nights for a period of 90 calendar days from June 19, 1964, subject to the payment of the required permit and license fees, and regulations of the Chief of Police. Absent: None, It was moved by Councilman Finch, seconded by Councilman Dance Ham, that the City Attorney be instructed to submit for ordinance the Council's study an ordinance that would revise the revision present dance ordinance to permit dancing where alcoholic requested, beverages are served, and establish standards for the issuance of such dance permits. All members voting aye, the Mayor declared the motion carried. The Mayor inquired if there were any oral communications. There was no response.
