HomeMy Public PortalAboutResolution 2020-04-02 Declaring Disaster Emergency Due to Covid-19 RESOLUTION 2020-04-02 RESOLUTION DECLARING DISASTER EMERGENCY DUE TO CORONAVIRUS (COVID-19) AND AUTHORIZING THE MAYOR TO SIGN ANY NECESSARY DOCUMENTS WHEREAS, the Board of Trustees of the Town of Fraser, Colorado, pursuant to Colorado statute, is vested with the authority of administering the affairs of the Town of Fraser, Colorado; and WHEREAS, pursuant to C.R.S. §§ 24-33.5-701, et. seq. (the "Colorado Disaster Emergency Act), and Title VI of PL 93-288, as amended, The Robert T. Stafford Disaster Relief and Emergency Assistance Act, citizens, businesses, schools, and government institutions suffering damage as a result of such disasters may qualify for Federal Disaster Relief, as long as the Board of County Commissioners and/or the Fraser Board of Trustees declares that there exists in Grand County and the Town of Fraser a disaster emergency; and WHEREAS, on March 11, 2020, the World Health Organization declared COVID-19 a global pandemic; and WHEREAS, on March 13, 2020, President Donald Trump declared a national emergency in response to COVID-19; and WHEREAS, on March 10, 2020, Governor Jared Polis, by Executive Order, declared a statewide disaster emergency due to the presence of COVID-19 in the State of Colorado. The Executive Order identifies the potential for community spread, and, activates disaster response and recovery efforts applicable to state, local and intergovernmental disaster emergency plans; and WHEREAS, on March 18, 2020, the Grand County Health Department reported at least one confirmed case of persons with COVID-19 in Grand County, Colorado. The Grand County Public Health Department reports that the virus is spread through respiratory droplets an infected person expels when coughing, sneezing, or talking. The incubation period from time of exposure to onset of symptoms is 2-14 days. The current outbreak is occurring during a time of year when respiratory illnesses from influenza and other viruses, including other coronaviruses that cause the"common cold," are highly prevalent. There is currently no FDA approved vaccine or treatment for COVID-19 and focus is on alleviation of symptoms; and WHEREAS, the Board of Trustees consider this a state of disaster emergency due, in pertinent part, on the bases that person to person contact causes COVID-19 to spread rapidly. The area of disaster includes all areas within the border of Fraser, Colorado. COVID-19 imposes challenges to the Town that the Town must be able to address on an emergency basis. Every effort must be made to preserve the Town's ability to respond to public service challenges arising from the rapid spread of COVID-19. NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of Fraser, Colorado, that a state of disaster emergency is in effect within the incorporated areas of Fraser, Colorado. BE IT FURTHER RESOLVED by the Board that it requests the Governor of the State of Colorado to do whatever is necessary to seek said Federal funds for disaster emergency relief for the Town of Fraser and its citizens, and to derive funds from the State of Colorado for emergency disaster relief which may be in excess of limitations contained in Article X, Section 6 and Article X, Section 20 of the Colorado Constitution (TABOR). BE IT FURTHER RESOLVED that the Mayor be, and hereby is, authorized to sign any and all documents for the purpose of defining and communicating the existence of said disaster emergency. This declaration shall be given prompt and general publicity, filed with the Town Clerk, and distributed to the Grand County Office of Emergency Management and the Colorado Office of Emergency Management. This declaration shall expire on April 30, 2020, unless extended or otherwise amended by the Fraser Board of Trustees. The above and foregoing Resolution was, on motion duly made and seconded, adopted on the 1st day of April 2020.
