REGULAR MEETING NOVEMBER 17, 1864
The City Council of the City of Lynwood met in a regular
session in the City HaII, 11330 Bullis Road, on above date
at 7:30 p.m.
Mayor McMillan in the chair.
Councilmen Duncan, Ham, McMillan, Siokos, Smith answered
the roll call.

.Smith, that the minutes of the regular meeting of
November 4, 1864, be approved as written. All members
voting aye, the Mayor declared the motion duly carried.

by Councilman Ham, seconded by Councilman Smith, that

The City Attorney stated that the electrical permit fees Electrical
must be revised to be equal to or greater than the fees permit. fees
established by the State Division of Housing regulations;. be amended

The Clerk presented a claim filed by Thomas H. and Inez
Marks for damages arising out of the erection of an illegal
building. It was the City Attorneyts recommendation that
said claim be rejected and. ref erred to the cityts insurance
carrier for disposition. It was moved-by Councilman Ham,
seconded by Councilman Smith, that said Maim be rejected
and referred to the insurance carrier as recommended by
the City Attorney. All members voting aye, the Mayor
declared the motion duly carried.

Chamber The Clerk presented a communication from the Lynwood Chamber
suggestions of Commerce suggesting that the county residents adjacent to
re Lugo Park the city be allowed to participate financially in the com-
pletion of Lugo Para., as previously proposed by the Chamber.
It was moved by Co~a.ncilmar. Hann, seconded by Councilman Smith,
that said communication be accepted and filed. All members
voting aye, the Mayor declared the motion duly carried.
St.Annets The Clerk presented a c:~mmunication from St. Annets Episcopal
Church-= 'Church expressing appreciation to the City Council for grant- ,...~,
letter of ~ ing a license for a thr~,ft shop. It was moved by Councilman

be accepted and filed. All members voting aye, the Mayor
declared the motion duly carried. -
Planning The Clerk presented a communication from the law,~,firm of
Commission Block, Toler, Bullock &. Biggerstaff, representing the Southern
decision re California Association of Seventh-Day Adventists, appealing
Adventist the Planning Commission. action which recommended denial of
zone change the Associations application for a change of zone from R-2
appealed to C-2 of a portion of their property on Imperial Highway.
CRes. 291) The communication stated their reasons for making such appeal,
and suggested that tree city conduct a study as to whether or
not traffic problems would be created to the inconvenience
of the citizens .
The Clerk stated that the applicants had appealed the Planning
Commission decision within: the time prescribed, and it would
be in order for the Council to set a date for public hearing
before the City Council.
Whereupon, it was moved by Councilman Ham, seconded by
Councilman Duncan, that the Council set and establish
December 15, 1964, at 730 p.m. in the' Council Chambers of '~
the City Hall as the date, time and place for conducting a --*~
public hearing on the appeal of the Planning Commissionts '3
decision as requested by the applicant, and~that'~the Clerk;
be directed. to make the rre:,e.ssar°y posting and publications

Following considerable discussion of the applicants request
for a traffic study and the reasons the Planning Commission
recommended denying the requested change of zone, it was
moved by Councilman Siokos, seconded by Councilman Smith, that
the City Manager present are informational report concerning
the affect on property valuations in the surrounding neighbor-
hood, resultant traffic problems, and statements contained in
the General Plan regarding commez°cial development, all as they
would relate to the req°aested change of zone.

P.C.Res.287 The Clerk presented Planning Commission Resolution No. 287
Dupree recommending the denial of the application of Amelda N.. Dupree
variance for variance to permit the .deviation of sideyard setb~~~~~
denial, requirements of Section 6,03 of Ordinance 570 to allow the
continued use of a buildir~.g addition constructed within said
setback area on the west 40 feet of Lot 173, Tract 5222 (3327
Tenaya). It was moved by Councilman Duncan, seconded by
Councilman Ham, that the C~u.ncil concur to the action of the
Planning Commiss ion in der:yir!g said request. All members
voting aye, the Mayor declared the motion duly carried.
P.C.Res.288 The Clerk presen ted Planning Commission Resolution No. 288
Area 5 recommending the change of zone of Lots 504, 505, 506, 507,

508, 509, Tract No. 2551 (Area 5 zone study, as part of
the implementation of the General Plan, intended to bring
zoning and usage into conformity;. It was moved by
Councilman Siokos, seconded by G°cuncilman Duncan, that
the Council concur in the recommendation of the Planning
Commission. All members voting aye, the Mayor declared
the motion duly carried.

The Clerk presented Planning Commission Resolution No. 289
recommending the establishment of zone in recently annexed
Fernwood Avenue Annexation No. 3 as P-l. (Lot 9, Tract
8716). It was moved by Councilman Duncan, seconded by
Councilman Smith, that the Council concur in the recommen-
dation of the Planning Commission, All members voting aye,
the Mayor declared the motion duly carried.
An ordinance entitled: "AN ORDINANCE AMENDING ORDINANCE
-- N0, 570 FOR THE PURPOSE OF CLASSIFICATION OF CERTAIN PRO-
PERTY AND THE ADOPTION OF AN .AMENDED SECTION OF THE ZONING
MAP WHICH IS A PART OF SAID ORDINANCE N0. 570." was pre-

The Clerk presented Planning Commission Resolution No. 290
recommending the establishment of zone in recently. annexed

No. 6728, and a portion of the Division of-Lot 1, Slauson
Tract). It was moved by Councilman Duncan, seconded by
Councilman Ham, that .the Council concur in the recommenda-
tion of the Planning Commission. All members voting aye,
the Mayor declared the motion duly carried.

Duncan Ave. The Clerk presented the Pian.ning Commissionts report on the
Annex No. 1 proposed annexation of inhabited territory known as "Duncan
approval Avenue Annexation No, 1" wherein they recommended that the
recommended Council proceed with sack annexation, It was-moved by
by Plan.Com. Councilman Ham, seconded by Councilman Siokos, that said
report be accepted. All members voting aye, the Mayor
declared the motion duly carried.
Res. 64-83 Whereupon, RESOLUTION N0. 64-83 entitled: "A RESOLUTION OF
Duncan Ave. THE CITY COUNCIL OF THE CITY OF LYNWOOD CONSENTING TO THE
Annex No. 1 COMMENCEMENT OF AlV'NEXATION PROCEEDINGS (DUNCAN AVENUE

Ham, seconded by Councilman Siokos, that said resolution be
adopted.

Trash col- The Clerk presented a report and survey of trash and rubbish
lection collection fees charged by surrounding municipalities wherein
license fee it was recommended that the fee be established on a per truck
reduced to basis, with the minimum fee of $100.00 per year per truck.
$300 per year
Following considerable discussion on establishing the license
fee on a per truck basis, necessity of reducing the present
annual fee and enforcement problems, it was moved by Councilman
Ham, seconded by Co°uncilman Duncan, that the present business
license fee for collecting and disposing of refuse and rubbish
remain at $400.00 per year.

Whereupon, it was moved by Councilman Ham, seconded by
Councilman Siokos, that the annual license fee for refuse and
rubbish collection be established at $300.00 per year. All
members voting aye, the Mayor declared the motion duly carried.
Tree The Manager presented his report on the bids received for
removal - r~,o~3- of approximately 1:7.7 hazardous trees, from"various'' t
Contract t.r~ locations in the city wherein he recommended that the contract-~'
Davenport b.e awarded to-Lee .Davenport, the low bidder, at $4,350.00.
It was moved by Councilman Duncan, seconded by Councilman
Ham, that the Council concur in the recommendations of the
Manager in awarding said contract, and authorize the Mayor
and Clerk to execute said agreement on behalf of the City of
Lynwood.

Recess. The Mayor declared a .j~minute recess. Following the recess,
the Mayor called the meeting to order.
Recreation The Mayor stated that this was the time set for considering
Commission the appointment of a Ynember of the Recreation Commission to
appointment fill the unexpired term left by Mr. Guy Smithts appointment
to the City Council.. The Mayor declared that nominations
for appointment to said Commission would now be accepted.

The Mayor declared Mr. E. L. Morris appointed to the
^~ Recreation Commission for the unexpired term of Mr. Guy
Smith.
The Mayor inquired if there were any oral communications.
Mrs. Mary King, 3959 Le Sage, inquired if additional evi- Inquiry re

Mrs, Anita Birkholm expressed her gratitude for being con-
sidered as an appointee to the Recreation Commission.
Mr. Edward Fuhrman, 4219 Pendleton Avenue, suggested that
the information report requested by the Council concerning
the Seventh-Day Adventist Associationts appeal be made
available to the appropriate parties prior to the hearing.
The City Attorney stated that the reports are public records
and could be made available Zahen complete.
