Councilmen Byork, Duncan, Siokos, Smith, Stevens answered the roll call. Tt was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that the minutes of the meeting of August 16, 1966, be approved as written. Res. 66-80 RESOLUTION N0. 66-8o entitled: Demands COUNCIL OF THE CITY OF LYNWOOD DEMANDS PRESENTED AND ORDERING was presented. It was moved by by Councilman Byork, that said Roll Call: "RESOLUTION OF THE CITY ALLOWING AND APPROVING THE WARRANTS DRAWN THEREFORE." Councilman Duncan, seconded resolution be adopted. Ayes: Councilmen Byork, Duncan, Siokos, Smith, Stevens. Noes: None. Absent: None. Presentation Major William T. Macy, Marine Corps Reserve, Company G, 600 by Marine N. Alameda Street, Compton, presented the Mayor and Council Corps with a medal to commemorate their 50th Anniversary, and Mayor Reserve Smith proclaimed the week of August 29, 1966, as Marine Corps Reserve Week. PUBLIC HEARINGS Hearing - The hour of 7:30 p.m. having arrived, said hour being the Revocation time fixed for the continued hearing on the request of the of special Chief of Police for revocation of the special permit of permit to Diana Adams to conduct the business of palmistry, the Chief conduct of Police presented a report, as follows, to the Council palmistry which set out his reasons for requesting revocation of the (Diana permit: Adams) "It is respectfully requested the license issued to Dianne Adams, to conduct the business of Palmistry at 12520 Long Beach Boulevard, be revoked. "On September 30, 1965, John Adams, husband and co-operator of the business, was arrested by the Los Angeles Police Department on charges of conspriacy [sic], and bribery. It was alleged he offered a member of the L.A.P.D. $150,000 a year if he would protect the interests of the gypsies in Los Angeles. "Between August 1 and September 30, 1965, the L.A.P.D. officer accepted, with his superior's knowledge, $13,300 in bribes . "On March 25, 1966, John Adams pled guilty to one count of bribing a police officer in the amount of $750 and on April 22, 1966, was sentenced to 1 - 1~4 years in Chino, along with his co-defendant Barbara Williams (mother-in- law) (Corona). Defendant Williams was also fined $5000. "Since the sentencing date an attempt was made to gain a new trial which has recently been denied. Inasmuch as the defendant is presently serving his term and a new trial has been denied, I feel the license should be revoked immediately." The Mayor inquired if Diana Adams or her representative was present and wished to be heard. ~~ Mrs. Gladys Towles Root, Attorney for Diana Adams, 212 S. Hill Street, Los Angeles, addressed the Council. Mrs. Root stated that she represented Diana Adams only, and that Diana Adams was the only licensee. She also stated that john Adams was in no way connected with the business; and, therefore, felt that there were no sufficient grounds to warrant the revocation of the special permit to conduct the business of palmistry issued to Diana Adams. ''~ Mayor Smith asked the City Attorney if it was legally possible for the City Council to revoke the license issued to Diana Adams when it was her husband, John Adams, who was convicted of the aforementioned crimes. The City Attorney stated that the Chief of Police had legal cause to file the request for ~l~Vdcation of the special permit although the proof submitted was insufficient to prove a case, and recommended that the request for revoca- tion be denied. It was moved by Councilman Byork, seconded by Councilman Duncan, that the request of the Chief of Police for revoca- tion of the special permit of Diana Adams to conduct the business of palmistry be denied. The hour c,f:7:30 p,m.,hay:pgra~,~i,ved, said hour being the :,time fixed-,for public hearing on tie proposed improvement of Alma Avenue between~Ruth-Stree-t and Otis Avenue by the construction of curbs, gutters, driveway approaches and sidewalks, the Clerk presented affidavits of mailing notices of the public hearing and stated that no written or oral protests have been made to this proposed improvement. The Mayor. inquired. if there were any present in the audience wishing to be heard on the proposed improvement. There was no response. It was moved by Councilman Siokos, seconded by Councilman Stevens, and carried, that the hearing be concluded. RESOLUTION N0. 66-81 entitled: "RESOLUTION OVERRULING PROTESTS IN CONNECTION WITH THE HEARING ON DEBT LIMITATION FOR THE PROPOSED IMPROVEMENTS OF ALMA AVENUE BETWEEN RUTH STREET AND OTIS AVENUE BY THE CONSTRUCTION OF CONCRETE CURB AND GUTTER AND DRIVEWAY APPROACHES AND SIDEWALK, TOGETHER WITH ALL INCIDENTAL AND APPURTENANT WORK." was presented. It was moved by Councilman Byork, seconded by Councilman Stevens, that said resolution be adopted. Roll Call: Ayes: Councilmen Byork, Duncan, Siokos, Smith, Stevens. Noes: None. Progress Mr. Tom Smyth, 3653 Cedar Avenue, President of the Lynwood report on Freedom Memorial Committee, addressed the Council to give a Freedom progress report on the memorial to be erected in the Lynwood Memorial in City Park. He stated that all the plans and specifications City Park are ready and construction will begin as soon as funds are available. The total cost of the project will be approximately $11,000. The committee also requested a donation from the City Council to represent the City's effort toward the realization of this community effort. Councilman Duncan suggested that the committee make arrange- ments to meet with the City Manager to discuss from which fund the City's donation will be appropriated. Mr. Dick Bowen, 11469 Cortland, addressed the Council to describe what materials will be used in the construction of the band shell. All members voting aye, the Mayor declared the motion carried. .L+ ~ a~ The City Clerk informed the City Council that Ordinance No. 802, an interim ordinance prohibiting certain uses in a C-2 Zone (pawnshops, etc.) expires on September 12, 1966. She stated if the City Council wished to extend this ordi- nance, it would be necessary to hold a public hearing at the next regular meeting on September 20, 1966, pursuant to the requirements of the Government Code. It was moved by Councilman Siokos, seconded by Councilman r~- Byork, that a public hearing be set for September 20, 1866, for the purpose of determining whether or not Interim Ordinance No. 802 (copies of which are available in the Office of the City Clerk) be extended. All members voting aye, the Mayor declared the motion carried. Lloyd Knight, 12010 Long Beach Boulevard, President of the Festival Chamber of Commerce, addressed the Council to state that the tabled reason for the request is that it would be financially impossible for the Chamber to pay the entire license fee. Mayor Smith asked the City Attorney if it was legally possible to waive the entire fee . The City Attorney informed Mayor Smith that it was not legally possible to waive the entire fee under Section 20.36 of the City Code. However, this section does provide that a percentage of the license fee may be waived. The Attorney also stated that the exemption only applies to the Chamber of Commerce insofar as the percentage of money received by the Chamber is concerned. Mr. Knight stated that it had been suggested that a percentage basis be used for the individual concessionaires but under the agreement between the Chamber of Commerce and the City, it would not be possible to do so. It was moved by Councilman Duncan, seconded by Councilman Stevens, that the request of the Lynwood Chamber of Commerce for waiver of the $100 per day license fee for the "Fall Festival" be tabled until further studies can be made and a meeting can be arranged between the City Manager, City Attorney and the Chamber of Commerce. All members voting aye, the Mayor declared the motion carried. The City Manager presented a report on the bids received for installation of traffic signal systems at Bullis Road and Cedar Avenue, and Century Boulevard and Mariposa Lane in which he stated that Steiny and Mitchel, Inc. was the low bidder, and recommended that the contract be awarded to Steiny and Mitchel, Inc. at the bid price of $8,161. It was moved by Councilman Duncan, seconded by Councilman Siokos, that the Council concur in the recommendations !^- of the City Manager and award the contract for installation of traffic signal systems at Bullis Road and Cedar Avenue, and Century Boulevard and Mariposa Lane to Steiny and Mitchel, Inc. at the bid price of $8,161. Contract f~ signals at Bullis & Cedar, Century & Mariposa awarded to Steiny & Mitchel, I~ z4 Contract for Abbott Rd. culvert awarded to Kral- Masanovich The Manager .reported on the bids received for the construction of a culvert across Abbott Road at Fracar Avenue. He stated that the low bid was submitted by Krai-Masanovich Construction, and recommended that the contract be awarded to Kral-Masanovich Construction at the bid price of $9,898. Report on The Manager presented a report on the demolition of the demolition Plaza Street buildings for the Council's information. The of Plaza report stated that on September 6th crews of the Street Street bldgs Department demolished the two buildings on the lots which the City recently purchased. He also stated that the demolition will be completed by September 8th, with the lots being completely cleared. Call for The Manager presented a report on the proposed resurfacing bids on the of Imperial Highway between Long Beach Boulevard and improvement Fernwood Avenue using 186.1 Special Gas Tax funds. It is of Imp. Hwy intended that the project will be accomplished by the L.B. Blvd. heater re-mix process. The proposed work can be charged to Fernwood against 186.1 matching funds with the City's share being 9-26-66 provided ~h~rough use of City employee labor charges. The call for bids is for the heater remix portion of the work. Tie resurfacing itself will be handled by the City Street Department. The estimated cost of the project including heater remix rent-al, remixing of street surfacing, 2800 tons of asphaltic concrete, and labor and city equipment rental if $20,325. The City Manager recommended that in order to complete the needed resurfacing, the City Council authorize a call for bids for the improvement of Imperial Highway from Long Beach Boulevard to Fernwood Avenue with bids to be received September 26, 1966. It was moved by Councilman Stevens, seconded by Councilman Duncan, that the City Council concur in the recommendations of the City Manger and authorize the call for bids for the improvement of Imperial Highway from Long Beach Boulevard to Fernwood Avenue, Roll Call: Ayes: Councilmen Byork, Duncan, Siokos, Smith, Stevens. ORAL COMMUNICATIONS Signal at Councilman Duncan stated that at Bullis Road and Imperial Bullis & Imp Highway the signal seemed to change too rapidly, and asked to be checkedif the light timing could be slowed. The City Manager stated that a new signal controller has been installed and he would have the timing checked. He also mentioned he noticed that the Welcome to Lynwood signs show an incorrect figure for the population of the City. The City Manager stated that the new budget provided for the replacing of these signs during the 1866-67 fiscal year. Mr. Ken Porter, Realtor, 11927 Long Beach Boulevard, addressed the Council to ask that the property located at `"' 11364-7o Long Beach Boulevard be considered for purchase for off-street public parking. Mr. Ronald Scott, 3993 Beechwood, addressed the Council to state that he is in favor of adopting an entertainment ordinance to prohibit the operation of entertainment establishments after a certain hour at night. He also stated that he owns rental units at 12317 Oak Street and his tenants have complained frequently of loud music and noise from a business on Long Beach Boulevard.
