Councilmen Byork, Duncan, Siokos, Smith, Stevens answered the roll call. It was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that the minutes of the meeting of September 6, 1966, be approved as written. Res. 66-84 RESOLUTION N0. 66-84 entitled: Demands COUNCIL OF THE CITY OF LYNWOOD DEMANDS PRESENTED AND ORDERING was presented. It was moved by by Councilman Byork, that said Roll Call: "RESOLUTION OF THE CITY ALLOWING AND APPROVING THE WARRANTS DRAWN THEREFORE." Councilman Duncan, seconded resolution be adopted. Ayes: Councilmen Byork, Duncan, Siokos, Smith, Stevens. Noes: None. Absent: None. At the request of the Lynwood Chamber of Commerce, Mayor Smith proclaimed Monday, October 3, 1966, as "Free Enterprise Day" in the City of Lynwood. Presentation Mayor Smith presented service pins to the following City of City employees: Bert McIntyre, 35 years; Mary Williams, 25 years; service pins Mervil Miller, 25 years; Clifford Wallace, 25 years; Tom Fox, 20 years; Eldon Pierce, 20 years; Allen McDaniel, 20 years; C. K. McHenry, 20 years; Sterling Unruh, 20 years; Leo Weber, 20 years; Maurice Wood, 20 years; Earl Yolton, 20 years. PUBLIC HEARINGS Hearing - The hour of 7:30 p.m. having arrived, said hour being the Duncan Ave time fixed for public hearing on the proposed improvement of et al Duncan Avenue, between Fernwood Avenue and Lavinia.. Avenue, improvement and on the south side of Fernwood Avenue 161.8 feet east and west of Duncan Avenue and on the north side of Josephine Street, 160 feet west and 110 feet east of Duncan Avenue, and on the south side of Josephine Street 320 feet west and 110 feet east of Duncan Avenue, and on the north side of Lavinia Avenue 206.65 feet east of Duncan Avenue, the Clerk presented affidavits of publishing, mailing and posting and stated that no written protests had been filed. The Mayor inquired if anyone present wished to be heard. As there was no response, the hearing was concluded. ORDINANCES AND RESOLUTIONS The Manager informed the Council that the Fire and Building Departments have been receiving requests for Boarding House licenses for housing of "returnees" from various State and County mental institutions. Assignment is being made by the respective agencies to locations approved by the State, but which need not be licensed such as is required bf convalescent or rest homes. As a result, this type of boarding home need not comply with any code other than that for the average i"'e ~.~.; Report on residence. When these controls were found to be unenforceable and zoning ordinance requirements were not applicable, it was felt necessary to propose an emergency ordinance restricting all rest homes or con- valescent hospitals of all kinds to a more limited zone than residential, precluding the use of houses in "R" zones for use by State and County mental patients. It was moved by Councilman Siokos, seconded by Councilman Stevens, that the ordinance be adopted and published. Mr. Hutchinson, 3125 E. Imperial Highway, operator of the Imperial Guest Home, addressed the Council to state that he was familiar with the program of placing mental patients in homes; that these patients are carefully screened for discharge from the various institutions but in many cases they have no families to whom they can return, and in some instances they have been in institutions for many years and need assistance in the transition to life outside the institution. He spoke in favor of the program and urged the Council to investigate and study it carefully. Fire Chief Riley informed the Council that the intent of the proposed ordinance is only to clarify the occupancy classification as there is presently no law pertaining to this type of occupancy. The City Manager informed the Council that this ordinance is another step in implementing the additional-benefits granted by the Council to retired-employees in the 1866-67 budget, and the Manager recommended adoption of the ordinance. It was moved by Councilman Byork, seconded by Councilman Siokos, that further r°eading be waived. All members voting aye, the Mayor declared the motion carried. WRITTEN COMMUNICATIONS A petition signed by Margaret Gasche and 16 others was Petition re presented in which they request the Council to take Gunk Shop appropriate action to eliminate the nuisances resulting from the operation of the "Gunk Shop" at 12129 Atlantic Avenue. The City Attorney informed the Council that an attempt is being made to eliminate the nuisance by civil action. It was moved by Councilman Byork, seconded by Councilman Duncan, that the petition be accepted and filed. All members voting aye, the Mayor declared the motion carried. Mr. Ted Burkett, 5167 Los Flores, one of the owners of the Gunk Shop, addressed the Council to complain that the owners were not notified that the operation of their business was to be discussed at this meeting. The City Clerk presented a proposed amendment of Section Proposed 20.83 of the Lynwood City Code concerning resumption of amendment of ~,~,, business within the City when a business licensee has Sec. 20.83 0 concluded a closing out sale, and suggested that if the Code to be ~ Council wishes to proceed with such an amendment an considered ordinance would be prepared for presentation at the next meeting. It was moved by Councilman Siokos, seconded by Councilman Stevens, and carried, that the City Clerk in- vestigate the matter further and present a proposed ordinance for the Council's consideration. The City furniture Clerk stated that the applic ation was filed pursuant to sale Section 20.103 Lynwood City Code and suggested that if the withdrawn Council approves the permit', -that it be granted for the 3 days requested only (October 19, 20, 21), that evidence be required that the applicant has permission from the owner of the property for its use, and that a $50 deposit be required to insure clean-up of the premises after its use. The Manager stated that the location under consideration is a fire and safety hazard bec ause of the underground gasoline storage tanks which are stil l there. It was moved by Councilman Byork, seconded by Councilman Siokos, that the application be denied. Mrs. Desoto addressed the Council to explain the nature of the business she contemplates operating and how it is operated, and stated that she has conducted a similar business in other cities in the area, most recently in the City of Downey. She assured the Council that the business is a legitimate and reputable one. The Manager stated that he felt the proposed location was also unsuitable because of the storm drain construction presently being done in the immediate area, and that he would want the Fire Department to investigate the location's safety . After discussion, it was suggested that Mrs. Desoto withdraw her request pending obtaining a more suitable location for the business, and that she confer with the City Manager concerning a proposed location. Mrs. De Soto withdrew her request and the motion to deny her request for a special permit to conduct an outdoor furniture sale at the northwest corner of Imperial Highway and Atlantic Avenue was withdrawn. Adams, addressed the Council to urge that the license be granted. He stated that he believed all the facts surrounding her arrest and conviction should be brought before the Council; that she was a minor of approximately 16 years of age at the time; that he believed she was put on summary probation for a number of years and served that time satisfactorily and had no subsequent difficulties; and that her application should be acted upon favorably. The CII report of Laura Adams arrest was presented by Captain Miller. Roll Call: Ayes: Councilmen Byork, Duncan, Siokos, Smith, Stevens. Noes: None. Absent: None. The application of Nancy Adams for a special permit to Nancy Adams conduct the business of palmistry at 12500 Atlantic Avenue application was presented. The Police Department investigative report for palmist ~--~ was also presented in which it was recommended the special application be denied because of a misstatement of a permit at material fact (with reference to a prior arrest). 12500.Atlnt denied Mr. Douglas Dalton, 120 Linden Avenue, Long Beach, Attorney representing Miss Adams, addressed the Council and explained that Miss Adams had been arrested and that the case had been set aside and the record expunged. He stated that Sections 12034 and 12034.5 Penal Code provide that records of minors who have been arrested can be set aside and the incident is deemed not to have occurred, and that a question concerning arrest can then be answered in the negative. In the discussion which followed, Councilman Siokos questioned the minor operating in the capacity of a palmist; and, it was moved by Councilman Siokos, seconded by Councilman Duncan, that the application be denied because of the minority of the applicant. The City Manager presented a report of Planning Commission activities at its September 13 meeting as follows: 1. Beach Market variance request (extension of conforming use in a C-2 zone to an adjoining zone). A revised plot plan was studied and approved by the Planning Commission and the new plan will be presented to the City Council at its meeting of October 4. 2. Variance request of Mr. & Mrs. Roy Stower for permission " to construct a portion of a motel in a R-2 zone. The Planning Commission held this request over pending submission of a revised plot plan. 3. A Resolution of Intention was adopted to hold hearings on the proposed establishment of zone of recently annexed territory known as Olanda Street Annexation No. 1. Report on P. C. Action 4. The request for change of zone of an 11.55 Acre portion of Home Tract in Rancho San Antonio (former S.D.A. property) was withdrawn by the applicant James Pelton. X32 ~a The City Manager also informed the Council that the City Attorney has advised him that only affirmative actions of the Planning Commission must come before the City Council, and that when the Planning Commission denies a request, it is not necessary to bring the matter to the City Council unless an appeal from the Planning Commission's decision is filed. The report outlined the duties which cannot be delegated and it was the Manager's recommendation that the City Council concur in the action of the Personnel Board by approving the delegation of the bulk of the duties of the Personnel Officer to the Administrative Assistant. After discussion of the possibility of also delegating to the Administrative Assistant the duties of the Planning Secretary at some future date, it was moved by Councilman Duncan, seconded by Councilman Byork, that the Council concur in the recommendation of the City Manager. All members voting aye, the Mayor declared the motion carried. Chamber of The Manager pr_~esented a report which recalled that at Commerce the June 8, 1966, meeting, the City Council discussed Fall Festivalwith the Chamber of Commerce a proposed "Fall Festival" agreement to be held from October 27 to 31, 1966, in the City Park approved in conjunction with the Recreation Department's annual Halloween Program. He reported that a formal agreement prepared by the City Attorney meets with the approval of the President and Secretary of the Chamber of Commerce, and it was the Manager's recommendation that the Council authorize the use of the City Park from October 27-31, 1966, for the proposed Chamber of Commerce "Fall Festival." It was moved by Councilman Siokos, seconded by Councilman Stevens, that the City Council concur in the recommendation of the City Manager. All members voting aye, the Mayor declared the motion carried. Hydraulic The Manager presented a report on the bids received for hammer bid furnishing the City with a self-propelled hydraulic awarded to hammer which indicated that the low bidder was Crook Crook Co. Company at a net price of $9,446. He stated that the low bid meets all aspects of the specifications, and recommended that the Council authorize the acceptance of the bid of Crook Company for one Arrow Model G-400 Hydraulic Hammer (plus tools) for $8,446 for immediate purchase. It was moved by Councilman Siokos, seconded by Councilman Byork, that the City Council concur in the recommendation of the City Manager.
