RESOLUTION N0. 67-12 entitled: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFORo" was presented. PUBLIC HEARINGS Res. 67-12 Demands The hour of° 7:30 p.m. having arrived, said hour being the Hearing - time fixed for the public hearing on the adoption of the Adoption of Uniform Building Code, 1964 Edition, affidavits of publication Uniform were presented and the Clerk stated that no written or Building oral inquiries had been made concerning the adoption of the Code. Code The Mayor inquired if there were any present wishing to be heard on the adoption of the Code. As there was no response, the Mayor declared the hearing concluded. The City Manager informed the Council that the area is bounded generally by Abbott Road, Century Boulevard, Stockwell Drive, Norton Avenue and San Luis Avenue, and that the Planning Commission has recommended approval of the zone change. The Manager Carlin informed the Council that the Planning Commission had considered the change of zone to CB-1 of a portion of Lot 2 on Carlin Avenue (directly west of the Robert Hall and Kinney Shoe company building on Atlantic Avenue), as well as the change of zone from R-2 of certain properties west of Cookacre Street south of Carlin Avenue. The Planning Commission recommended the change of zone of the portion of Lot 2 but voted against the proposed change of zone of the Cookacre properties. The areas in question were shown on a map displayed for the Council's study. It was moved by Councilman Stevens , seconded by Councilman Byork, and carried, that further reading be waived. The City Clerk presented the City Engineer's report on the maintenance of street lighting systems in the City of Lynwood for the period 1967 to 1970. The report indicated the annual maintenance cost would be $68,880.44, and would be assessed against the benefited properties in the City. The City Manager presented a report on the proposed southerly route of the Century Freeway in which he recalled that in March, 1866, the City Council adopted Resolution No. 66-21 requesting assistance from the Los Angeles County Board of Supervisors concerning the t~~~~ Abbott Road route. At that time the State Division of Highways had not included the proposed Compton-Lynwood boundary route and the City Council is, therefore, still on record as supporting the Abbott Road route. After discussions with the City Council, the report stated it now appears that the City Council intends to support the new southerly route and the Manager presented RESOLUTION N0. 67-18 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD SUPPORTING THE SOUTHERN MOST ROUTE OF THE PROPOSED CENTURY FREEWAY." WRITTEN COMMUNICATIONS A letter was presented from the Lynwood Coordinating Council in which they endorse the action ~f the City Council in its endeavo.~s to .rid the community of undesirable activity, ar~d also commended the efforts of the Police Department in its attempt to eliminate illegal activities in the City. It was moved by Councilman Stevens, seconded by Councilman Byork, and carried, that the letter be accepted and filed. REPORTS AND REQUESTS Res. 67-18 Support of southerly Century Freeway Rout Coordinating Council commending endeavors to rid community of undesirabl activities A request from the Lynwood Police Relief and Welfare Police Relief Association for permission to cond uct their annual Police & Welfare ~- Show and dance was presented. After discussion of the record of expenditures made by the association, it was moved by Councilman Siokos, seconded by Councilman Byork, that the request be tabled. It was moved by Councilman Stevens, seconded by Councilman Siokos, that the Police Relief and Welfare Association be requested to submit a list of receipts and expenditures. All members voting aye, the Mayor declared the motion carried. The City Manager reported that the Recreation Commission at its February 28 meeting recommended free use of Bateman Hall to the following groups: 1. The Sports Booster Club for the annual Lynwood spring Booster's dance to be held on March 11, 1967, at Bateman Hall. 2. The Rio Vista Y.M.CoA. for the Lynwood "Y" Indian Guides Tribe's dinner meeting on March 1st at Bateman Hall. 3• The Lynwood Exchange Club for the Senior Graduation Party to be held June 15, 1967, at Bateman Hall. Recreation Commission recommenda- tions for free use of Bateman Hall ~ 1. ~'~ ~. b Recreation 4. The Lynwood Council of Parents and Teachers for the Commission use of Bateman Hall on March 2, 1967, for the annual recommendations honorary life membership banquet. for free use of Bateman The Manager's report pointed out that the Commission is Hall recommending free use to any group which appears to be serving a good cause, and it was his belief that the Council should direct the Recreation Commission to establish a standard upon which to judge future requests for free use of any Recreation building, and all groups should meet criteria such as: 1. Recreation sponsored activity. 2. Activities directly sponsored or approved by the City Council. 3. School District activities specifically included in the City-School joint recreation agreement. 4. Activities sponsored and conducted by local service, civic or church organization which are community-wide in scope and participation, and preferably recreational in nature. Requests to be automatically denied might include the following: 1. Request by non-resident group s 2. Fund-raising activities for the specific benefit of the group conducting the activity regardless of its civic or religious function (any fund-raising activity should be questionable regardless of its nature). 3. Activities sponsored by groups whose activities are not open to the public. 4. Any private business or commercial exhibit. 5. Any activity prohibited by existing department policies. In discussing the matter, it was agreed that firm guidelines for free use of recreation facilities should be formulated by the Recreation Commission, subject to approval by the City Council. It was moved by Councilman Stevens, seconded by Councilman Siokos, that the City Manager confer with the Recreation Commission and Recreation Director in the formulation of standards for free use of the recreation facilities and present their recommendations to the City Council. Santa Fe Ave The City Manager reported on the bids received for bid awarded improvement of Santa Fe Avenue from the south city limits to McAmis to approximately Weber Street. It was his recommendation that the contract be awarded to McAmis Engineering, the low bidder, at a total price of $gg,077.13, to be _~ A,'1 ~ r~, financed from 186.1 gas tax funds It was moved by Councilman Siokos, seconded by Councilman Stevens, that the Council concur in the recommendation of the City Manager. The Manager reported that as authorized at the last meeting "~'~' he has obtained an appraisal of the surplus property located at Sanborn and California Avenues, and suggested that if the Council determines. to sell the property that a minimum price of $9,000.00 be established, and that the city attempt to sell the property by direct advertising. If, after a reasonable period of time it is not sold, he suggested that the Council may wish to consider listing it with the Compton-Lynwood Board of Realtors. It was moved by Councilman Siokos, seconded by Councilman Stevens, that the land be sold for $9,000 and that it be advertisied for a 30-day period. The City Manager reported that the job description for the new personnel classification of Clerk-Dispatcher recently authorized by the City Council has been approved by the Personnel Board and the Board has recommended approval of the description by the City Council, Also, upon recommendation of the Director of Recreation and Parks, the job description for Recreation Supervisor has been revised. The description has been approved by the Personnel Board and the Board recommends its approval by the City Council. The City Manager recommended approval of the two job descriptions It was moved by Councilman Byork, seconded by Councilman Siokos, that the Council concur in approving the job descriptions for Clerk-Dispatcher and Recreation Supervisor. All members voting aye, the Mayor declared the motion carried. The City Manager presented a report on the removal of driveway approaches and replaceing of curbs in locations where garages have been made a part of the dwelling and the old driveway is now being used for off-street parking. The report stated that the City Attorney agrees with his analysis of Section 21.5 of the Lynwood City Code in that if the garage doors are sealed or something is constructed in front of the doors, the driveway is no longer required as provided in said Section 21.5. In his analysis, the City Attorney suggested a procedure which would involve some discussion with the contractor who bid the job on the assumption that all driveway approaches would be closed. The suggestion is that each owner be notified by registered or certified mail to remove the driveway and restore the curb within ten days; if he doesn't comply, the contractor can be instructed to proceed to restore the curb in front of the driveway and fill the approach to the sidewalk. The report also said the only alternative would be to continue to close the approaches and driveways no longer used for parking and leave those that are being used, which would be in opposition to City Code Section 21.5. In the discussion which followed, it was agreed that there have been many violations of the subject code section ahd that in certain instances the closing of the approaches ~~ Report on would be a great inconvenience to the property owners closure of requiring the additional off-street parking. The City various Manager stated that had the project of up-grading and driveway improvement not been commenced, these violations would approaches not have come to the attention of the city, but that it would be difficult to refuse others permission to provide parking space in front yard areas if these violations are not corrected. It was moved by Councilman Byork, seconded by Councilman Stevens, that the Council concur in the suggested procedure. Mr. R. M. Robbins, 4049 Cortland, addressed the Council in objection to closing of his driveway approach and questioned the date of adoption of the ordinance requiring removal. It was determined that the ordinance was adopted in October, 1960, and to so-called "grandfather" clause would not apply to driveways abandoned prior to its adoption because ordinances affecting the public health and welfare are retroactive and removal of the driveway approaches could be required even though it was done prior to October, 1960. The City Attorney cited an instance of an elderly person falling in traversing a driveway approach which was still in existance after the garage was no longer in use as a garage. Mr. Jerry Rokos, 12217 Bullis Road, asked if the ordinance could not be amended to apply to construction since 1960 and the City Attorney informed him that it would be discriminatory Mr. Robbins again suggested that the ordinance be amended to permit those who wish to retain the driveway approaches to do so.
