A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCCALL, IDAHO,
ADOPTING A TERM SHEET, RATIFYING THE ACTIONS OF THE MAYOR, AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, The City of McCall and the Payette Lakes Recreational Water and Sewer
District have been involved in litigation since 2005, related to the ownership and
operation of the wastewater treatment facility; and
WHEREAS, both the City Council and the District Board have worked diligently to reach
an equitable settlement of the pending litigation; and
WHEREAS, the City Council and the District Board have reached an agreement in
principle regarding a settlement of the pending litigation; and
WHEREAS, the City Council and the District Board have developed a Settlement Term
Sheet, describing that agreement in principle; and
WHEREAS, the terms of that agreement are subject to approval by the Court.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF MCCALL, Valley County, Idaho that:
Section 1: The City of McCall hereby adopts the Term Sheet, dated October 21,
2010, developed by the City Council and District Board.
Section 2: The City of McCall hereby ratifies Mayor Don Bailey's signature on the
Term Sheet dated October 21, 2010.
Section 3: This resolution shall be in full force and effect on October 21, 2010.
Passed and approved this 21st day of October, 2010.
