COUNCIL MINUTES
BUDGET HEARING - SEPTEMBER 8, 1994
A Budget Hearing meeting of the Bal Harbour Village Council
was held on Thursday, September 8, 1994, in the Council Chamber at
Bal Harbour Village Hall. The meeting was called to order by Mayor
Spiegel at 5:15 p.m. The roll was called and those present were:
Mayor Estelle Spiegel
Assistant Mayor Matthew B. Blank
Councilman James E. Boggess
Councilman Andrew R. Hirschl
Councilman Sol M. Taplin
Also present: Alfred Treppeda, Interim Village
Manager/Police Chief
Jeanette Horton, Village Clerk
Richard J. Weiss, Village Attorn6y
As a quorum was determined to be present, the meeting
commenced.
2. Discussion of Proposed Tax Millage over the Rolled -Back
Millage Rate and Discussion of the Tentative Budgets:
Mayor Spiegel stated she will open a Public Hearing for a
discussion of the proposed Millage Rate over the. Rolled -Back
Millage Rate, and the tentative budgets. She further explained the
tentative millage rate must be adopted prior to the adoption of the
tentative budgets. She then proceeded to announce the proposed
millage rate is 20.2 percent over the rolled -back rate, or 3.04
mills instead of the 3.62 mills, which was previously announced.
Mayor Spiegel stated that this reduction was due to the diligence
of the Village's Interim Manager. He was assisted by Assistant
Mayor Blank, Mr. Raj Singh and the Village staff. Mayor Spiegel
then proceeded to open the Public Hearing for comments.
Dennis McGary, Bal Harbour Manor, questioned -what the millage rate
is in dollars. Mayor Spiegel explained that would be $3.04 per
$1000 of assessed valuation. Mr. McGary then questioned the
headline in the Sun Post that Bal Harbour was raising taxes by 43
percent. Mayor Spiegel explained the Village must certify a
millage rate to Dade County, but the Village can always reduce that
rate, but can not raise the rate.
Mary Hubbard, 61 Camden Drive, questioned property assessment.
Mayor Spiegel explained the proposed tax notice would show if the
property value has increased.
John Lang Looby, 220 Bal Bay Drive, stated in his opinion property
values went up this year, due to the 3 percent cap that will be
effective January 1, 1995.
Muriel Falhaber, 239 Bal Bay Drive, explained she pays double taxes
since part of her house is on the adjacent vacant lot. Mr. Weiss

explained this is an assessment issue for Dade County.
Carole Whitmoyer, 101 Biscay Drive, explained she has two lots and
she agrees with Ms. Falhaber. She further stated she takes
exception with the proposed tax increase.
Assistant Mayor Blank explained the millage rate that was paid last
year was $2.64 per $1000 of assessed valuation. He then proceeded
to explain the proposed millage rate for Bal Harbour Village.
Councilman Boggess explained for the past four or five years the
tax rate has been consistently lowered. He further explained the
Village should be able to keep this rate for a long time.
Raj Singh, 53 Camden Drive, stated although the millage rate has
gone down in the past, the assessed valuation has increased.

Virginia Dooley, 230 Bal Bay Drive, questioned how often property
can be reappraised. Councilman Hirschl replied every year by Dade
County.
Mara Marchessault, 162 Park Drive, questioned what additional
services will be offered for the increase in taxes. Mayor Spiegel
explained the different expenses that are incurred, as well as
replacing the stormdrain system in the residential section. Ms.
Marchessault was given a copy of the Budget.
Mildred Real, Carlton Terrace, stated she is concerned about the
assessment of her property. Mayor Spiegel explained she must go to
Dade County and appeal the assessment.
Richard Olsen, 224 Bal Bay Drive, explained the petition for an
appeal can be obtained at the North Dade Justice Building, 15555
Biscayne Boulevard.
There being no further comments Mayor Spiegel closed the Public
Hearing.
3. Resolution - Adoption of the Tentative Millage Rate:
The Resolution was read, by title, by the Village Clerk providing
for the adoption of a tentative millage rate of 3.04 mills. A
motion was offered by Councilman Boggess and seconded by Councilman
Hirschl to adopt this Resolution. The motion carried with the vote
as follows: Mayor Spiegel aye; Assistant Mayor Blank aye;
Councilman Boggess aye; Councilman Hirschl aye; Councilman Taplin
aye, thus becoming

4. Ordinances First Reading/Public Hearing: Tentative Budgets:
General Fund
The Ordinance was read, by title, by the Village Clerk, adopting a
General Fund Budget in the amount of $4,260,348. Mayor Spiegel
then opened the Public Hearing for comments. There being none the
Public Hearing was closed.
A motion was offered by Councilman Taplin and seconded by
Councilman Boggess to enact this Ordinance. The motion carried
with the vote as follows: Mayor Spiegel aye; Assistant Mayor Blank
aye; Councilman Boggess aye; Councilman Hirschl aye; Councilman
Taplin aye, thus becoming

ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A
BUDGET FOR THE'PERIOD OF OCTOBER 1, 1994 TO
SEPTEMBER 30, 1995 IN THE AMOUNT ,OF
$4,260,348; AUTHORIZING EXPENDITURES;
ESTABLISHING AN EFFECTIVE DATE.
Water Department
The Ordinance was read, by title, by the Village Clerk adopting a
Water Department Budget in the amount of $915,653. Mayor Spiegel
then opened the Public Hearing for comments. There being none the
Public Hearing was closed.
A motion was offered by Councilman Boggess and seconded by
Councilman Hirschl to enact this Ordinance. The motion carried
with the vote as follows: Mayor Spiegel aye; Assistant Mayor Blank
aye; Councilman Boggess aye; Councilman Hirschl aye; Councilman
Taplin aye, thus becoming
ORDINANCE NO. 393
ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A
BUDGET FOR THE WATER DEPARTMENT FOR THE PERIOD
OF OCTOBER 1, 1994 TO SEPTEMBER 30, 1995 IN
THE AMOUNT OF $915,653; AUTHORIZING
EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE.
Sanitary Sewer Department
The Ordinance was read, by title, by the Village Clerk adopting a
Sanitary Sewer Department Budget in the amount of $ 726,226. Mayor
Spiegel then opened a Public Hearing for comments. There being
none the Public Hearing was closed.
A motion was offered by Assistant Mayor Blank and seconded by
Councilman Boggess to enact this Ordinance. The motion carried
with the vote as follows: Mayor Spiegel aye; Assistant Mayor Blank
aye; Councilman Boggess aye; Councilman Hirschl aye; Councilman
Taplin aye, thus becoming

ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A
BUDGET FOR THE SANITARY SEWER DEPARTMENT FOR
THE PERIOD OF OCTOBER 1, 1994 TO SEPTEMBER 30,
1995 IN THE AMOUNT OF $726,226; AUTHORIZING
EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE.
Department of Tourism
The Ordinance was read, by title, by the Village Clerk adopting a
Department of Tourism Budget in the amount of $3,249,589. Mayor
Spiegel then opened a Public Hearing for comments. There being
none the Public Hearing was closed.
A motion was offered by Councilman Boggess and seconded by
Councilman Hirschl to enact this Ordinance. The motion carried
with the vote as follows: Mayor Spiegel aye; Assistant Mayor Blank
aye; Councilman Boggess aye; Councilman Hirschl ay,e; Councilman
Taplin aye, thus becoming

ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A
BUDGET FOR DEPARTMENT OF TOURISM FOR THE
PERIOD OF OCTOBER 1, 1994 TO SEPTEMBER 30,
1995 IN THE AMOUNT OF $3,249,589; AUTHORIZING
EXPENDITURES, ESTABLISHING AN EFFECTIVE DATE.
5. Announcement: Percentage, if any, by which the Proposed
Millage rate exceeds the Rolled -Back Millage Rate:
Mayor Spiegel announced that the proposed millage rate exceeds the
rolled -back millage rate by 20.2 percent.
6. Announcement: Next Budget Hearing Date September 22, 1994
-5:15 p.m.:
Mayor Spiegel announced that the next Budget Hearing will be held
on September 22, 1994, at:5:15 p.m.
7. Adjourn: There being no further business to come before
the Council a motion was offered by Councilman Taplin and seconded
by Assistant Mayor Blank to adjourn. The motion carried
unanimously (5-0), and the meeting adjourjed at 6:0(7 p.m.
