HomeMy Public PortalAbout19960805REGULAR COUNCIL MEETING AUGUST 5, 1996 CALL TO ORDER The Regular Council Meeting of August 5, 1996, was called to order at 7:30 P.M. with President Pro Tempore Carolyn McDowell presiding. Prayer was offered by Councilman Carl Jaynes, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for roll call: Present: Byrd, Haake, Jackson, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Absent: Mayor Duane Schreimann A quorum was declared present. PUBLIC HEARINGS Rezoning property located at 714 Wildwood Drive from RA -2, Multiple Family Residential to C -2, General Commercial (Bill 96 -64). Keith DeVault, Director of Planning & Code Enforcement, made a brief presentation on the background of the request for rezoning. No one present wished to speak either in favor of, or opposition to, the request for rezoning. PRESENTATIONS FROM THE GALLERY Special Presentation of Recognition to Mr. A. J. Eveler - A letter of commendation was presented to Mr. Eveler by President Pro Tempore McDowell for his heroic actions in the rescue of a neighbor in a burning accident. Mr. Eveler was present to accept the award in person. Nick Luetkemeyer, 811 Esther, made a presentation pertaining to the billboard ordinance (96 -53). A lengthy discussion followed Mr. Luetkemeyer's presentation, at which time Council requested that staff further clarify language in the proposed bill pertaining to maintenance and sign repair issues which Mr. Luetkemeyer brought to Council's attention. Council determined that the issue would be discussed by the whole Council at a future meeting after staff had prepared language further clarifying Bill 95 -53. Mr. Richard Groner, 1301 E. High Street, made a presentation regarding the proposed convention center feasibility study. He stated that a group of citizens would like the organization performing the study to consider the site proposed by Mr. Groner in a previous Council meeting. Councilman Larry Vincent requested that Mr. Groner provide the City by the following day with a list of the citizens to which he alluded. REGULAR COUNCIL MEETING AUGUST 5, 1996 CONSENT AGENDA a) Minutes of Meetings of July 15, 1996 Council Meeting b) Sole Source Procurement for Manhole Grout Mortar - Public Works Dept. A motion was made by Councilman Charles Jackson to approve the Consent Agenda, seconded by Councilman Bill Byrd and approved unanimously. MINUTES AND REPORTS RECEIVED AND FILED President Pro Tempore McDowell stated that the following minutes /reports have been received and are on file in the City Clerk's office: 1996 Surplus Property Auction Report; Public Works & Planning Committee, 7/18/96; Transportation & Traffic Commission, 7/11/96; Solid Waste Committee, 5/2/96; Planning & Zoning Commission, 6/13/96; Board of Adjustment, 6/11/96; Firefighter's Retirement System Board, 6/14/96; June Financial Report; Parks & Recreation Commission, 6/10/96; Mayor's Council on Physical Fitness, 7/11/96; Historic Preservation Commission, 4/23/96 ANNOUNCEMENTS BY MAYOR President Pro Tempore McDowell announced that the July Commercial Landscape Award recipient was Jefferson Bank South. MAYORAL APPOINTMENTS President Pro Tempore McDowell presented the following appointments to Board and Commissions to the Council for approval: a) Probationary Police Officer - John P. Wheeler b) Probationary Building Custodian - Arthur J. Proctor Councilman Jackson moved that the appointments be approved as presented, motion was seconded by Councilman Byrd, and approved unanimously. BILLS INTRODUCED Bill 96 -53, sponsored by Councilman Jaynes, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF REGULAR COUNCIL MEETING AUGUST 5, 1996 THE CITY OF JEFFERSON, MISSOURI, CHAPTER 3, SECTION 3- 5.A(1) BY ADDING AND DELETING CERTAIN PROVISIONS REGULATING OFF - PREMISES BILLBOARDS ON FEDERAL AND STATE DESIGNATED ROUTES WITHIN THE CITY OF JEFFERSON, MISSOURI AND ADDING A NEW ARTICLE ON THE SAME MATTER. Councilman Carl Jaynes suggested an ad hoc committee be formed to study the issue to ensure that the ordinance will not harm the billboard businesses in the City. Councilman Larry Vincent requested that staff prepare a comparison between this bill and current state laws which show where the differences in the two lie. The possibility of placing the bill on the next Public Works agenda was discussed, but not acted upon at this time. Following discussion, Councilman Carl Jaynes stated he would like to place Bill 96 -53 on the Informal Calendar at this time until staff and Council can further clarify the language in the bill. Councilman Carl Jaynes moved to correct a typographical error by amending the last line of the legal description contained in Bill 96 -51 as follows: Containing in all, 1907 19.07 acres. Councilman Rick Nilges requested that Bill 96 -44 remain on the Informal Calendar. RESOLUTIONS RS96 -9 - A RESOLUTION DETERMINING THE INTENT OF THE CITY OF JEFFERSON, MISSOURI TO SELECT LAW FIRMS TO SERVE AS BOND COUNSEL FOR MUNICIPAL BOND FINANCING ON THE CONVENTION CENTER AND GOLF COURSE PROJECTS. Councilman Nilges moved that RS96 -9 be adopted, motion was seconded by Councilman Jaynes, and approved unanimously. APPEALS Appeal of PUD Decision - President Pro Tempore McDowell stated that both parties to the appeal had requested a continuance of the appeal to the next Council meeting. A motion was made by Councilman Rick Nilges to continue the appeal until the August 19 Council meeting, seconded by Councilman Larry Vincent, and approved unanimously with Councilman Bill Byrd abstaining from discussion or voting. LIAISON REPORTS There were no liaison reports given at this time. REGULAR COUNCIL MEETING AUGUST 5, 1996 UNFINISHED BUSINESS City Administrator Rich Mays announced that the City is in need of a full -time bus driver and encouraged qualified persons interested in the position to make application. Councilman John Landwehr commended staff for the presentations that were made at the last couple of Public Works & Planning Committee meetings, and also commended the Public Works Department for its presentation on the overlay program. City Administrator Rich Mays encouraged citizens to vote in the August 6 election which contains the issues of half -cent sales tax and use tax. Councilman John Landwehr stated that the National Night Out would be the following evening, August 6, and encouraged citizen participation. NEW BUSINESS Councilman Rick Nilges asked Parks & Recreation Department Director Bill Lockwood to comment on the fact that Jefferson City recently hosted the state Softball Tournament. Mr. Lockwood presented some statistics regarding revenues the tournament brought into the City. Councilman Carl Jaynes commended the Chamber of Commerce for its contribution to the Convention Center feasibility study. Councilman Rick Nilges commented on the fact that Jefferson City recently hosted the Bowling Jamboree, and gave statistics regarding the number of persons that event brought into the City. ADJOURNMENT President Pro Tempore McDowell thanked the Council for allowing her to serve in the capacity of presiding officer at tonight's meeting. There being no further business to come before the Council at this time, Councilman Jaynes moved that the meeting be adjourned, seconded by Councilman Bill Byrd, and approved unanimously at 8:35 P.M.
