WRITTEN COMMUNICATIONS Petition re A petition signed by Mrs. Louis Leighton and twenty others barking dogs concerning barking dogs at 3311 Mulford Avenue, was presented. at 3311 The City Manager informed the Council he is aware of the Mulford Ave. situation and suggested that the Council accept the petition and refer it to the Chief of Police for appropriate action. It was moved by Councilman Siokos, seconded by Councilman Smith, that the petition be accepted and referred to the Chief of Police for action. All members present voting aye, the Mayor declared the motion carried. REPORTS AND REQUESTS American The request of the Lynwood Chapter of American Field Field Service for permission to hold their annual White Tag Service Sale on April 25, 26, 27 ar.d 28, was presented. Mrs. White Tag Angela Siokos addressed the Council to explain that sale the fund raising is in connection with the Exchange approved. Student program of the Arnericar. Field Service. It was moved by Councilman Smith, seconded by Councilman Siokos, and carried, that the request be approved. Mrs. Evelyn Lowry and Miss Paula Benbenek, Lynwood~s exchange student to Brazil, presented White Tags to the members of the City Council. Cub Scout The request of Cub Scout Pack 479C for permission to sell Easter egg candy Easter eggs from March 27 to April 13 was presented. sale It was moved by Councilman Siokos, seconded by Councilman approved. Fireworks A request from Jobs Daughters Bethel No. 58 for a fireworks stand permit stand permit at the southwest corner of Olanda and Atlantic granted Jobs Avenue was presented. It was moved by Councilman Green; Daughters, seconded by Councilman Smith, and carried, that the permit be granted. Rummage Sale A request from the Rubaiyats, Khayyam Grotto ladies auxiliary, permit - for permission to conduct a rummage sale at 3100 Imperial Rubaiyats Highway on April 6, 1868, was presented. It was moved by Councilman Green, seconded by Councilman Siokos, and carried, that the request be granted. ALSAC fund The request of ALSAC, St. Jude Children-s Research Hospital, appeal for permission to solicit funds in a door-to-door march approved, from December 7 to 14, 1868, was presented. It was moved by 1(~~ Councilman Siokos, seconded by Councilman Smith, that per- mission be granted. AlI members present voting aye, the Mayor declared the motion carried. The request of the Los Angeles County Fire Fighters Local No. 1014 for permission to conduct a charitable solicita- tion by telephone, held over from the previous meeting, roaas presented. The City Clerk informed the Council that she had requested information concerning this group .;from the Los Angeles Department of Social Service and was informed that the City of Los Angeles permits no telephone solicitation of this kind. Also presented was a letter from Earl J. Dunn, President of Local 1014, detailing the charitable activities of the organization. It was moved by Councilman Green, seconded by Councilman Smith, that the request be denied. In the ensuing dis- cussion, Councilman Smith expressed the opinion that by law telephone solicitation cannot be prohibited, and that he would prefer to delay final action until the _City Attorneys return and an opinion from him as to the legality of refusing a telephone solicitation permit. The City Manager reported that the Los Angeles County Flood Control District has submitted plans and specifications for Project 1210, construction of storm. drains in the southeast portion of the city (part of storm drain bond issued approved in 1964). The plans have been reviewed by the ~ City Engineer who finds no conflict with any proposed or existing city facilities. As required by the Flood Control District, the Manager recommended that the Council approve the specifications, authorize the District to proceed with the construction, and grant permission to use the public streets in the city for, the construction and maintenance of Project No ., 1210 st©--rrn dra-.ins, It was m©ved by Council- man Smith,-seconded by Councilman Green, that the Council concur in"the Manager~~s `recommendations. The Manager reported that plans `s rid specifications have been prepared for mod3f icati©n of the traffic signal systems at_Atlantic Avenue and Elmwood Avenue and at Atlantic Avenue and Beechwood Avenue, the upgrading to include installation of mast arm signals, X0,000 lumen mercury vapor safety lighting, and pedestrian crossing signals. The estimated cost of the proj~et, No. 149,.. is $9,000,to be pa,i,d from gas tax funds. The Manager recommended authorization to call for bids for the project, bids to be received no later than April 19, 1968, at 10 ,~.... a . m. in the City Clerks s office . It was moved- by Councilman Green, seconded by Councilman Siokos, and N carried, that the. Council concur in the. recommendations of the City Managex. The City Manager reported on the proposed annexation of a strip of land lying along the east city boundary by the Los Angeles C©unty Fire Protection District, and. said that he had attended the hearing before the Local Agency For- mation Commission on March 27. At that time the Commission postponed a decision for, sixty days pending decisions by L.A.County Fire Fighters solicitation request tabled Storm Drain Project No. 1210 approved. Bid call for Project 149 approved. Annexation of land lying easterly of city. () fi cities of South Gate and Lynwood to annex the territory. After investigating the condition of the Imperial Highway bridge, which is located in the territory, the City Manager said he now wished to rescind his recommendation to oppose the annexation by the F"ire Protection District as the cost of bringing the bridge up to standard would be so great that the annexation could not be ,justified.. He recommended that the City Council thank the Local ~igency Formation Commission for their cooperation and indicate that the city does not wish to annex the terri- tory.. Tt was moved by Councilman Smith, seconded by Councilman Siokos, and carried, that the Council concur in the recommendations of the City Manager, and the Mayor requested the City Manager to inform the Commission of the Councilrs action. Tree The City Manager presented. for the Councilrs information removal report a progress report on the city~s tree removal program, The E i . ng neering Department will have the final plans and speci- fications completed. by the next regular meeting, when a more precise cost analysis will be presented; however, preliminary cost estimate for the removal of 189 trees in the area bounded by Imperial on the north, Fernwood on the South, Bullis Road on the west, and Atlantic Avenue on the east, is $9,450• This will include cutting, stumping, and removal of debris. It is anticipated that a contract will be let for removal and replacement of curb and sidewalk at an estimated. cost ranging from $30,000 to $40,000, after uThich city crews will commerce planting approximately 223 trees at an additional cost of approximately $3,500. In discussing the tree removal program, the Manager pointed out that requests are being rece3.ved that certain trees not be removed, that the Engineering Department can determine whether or not a tree is in a hazardous condition, and asked the Council to delay action on commencing the program to allow the Capital Outlay fund to build up, Fireman - A revised fob description for the class of fireman was revised job presented by the City Manager, who reported that it has been description reviewed and recommended for adoption by the Personnel Board adapted: . Legislative -A~ analysis of legislative proposals affecting cities was analysis - presented by the City Manager, as follows: bills affecting Senate Bill 14: To provide a means for financing the cities, cons ruc on of a rapid. transit district by permitting Los Angeles County to impose a license fee up to $4 on commercial vehicles and up to $2 on other vehicles; to impose a sales and use tax on gasoline at a rate not to exceed 5~; to impose a sales and use tax not to exceed 5y on sale of natural gas and. electricity; a sales tax up to 10~ on sale and use of tires, tubes, and. lubricating oils; an admissions tax to various events in varying amounts; authorizes the Southern California Rapid Transit District to establish special assessment districts in certain areas specially benefited by construction of rapid transit. The ~,.ct provid.es that the award may not exceed $150, to be appropriated, from the General Fund., The Council may adopt rules and regulations to carry out the provisions of the section and may appoint a merit award board to determine who is to receive the benefit. With establishment of a merit awards committee and adequate rules governing number and extent of awards, the manager reported he saw no objection and would. recom- mend that the Council indicate that they favor such a bill. After discussing the difficulty of implementing and admin- istering a merit award program, no action was taken by the Council, Senate Bill 184: Workments Compensation law amendment to prov e a cart trouble conclusively arose out of and in the course of employment for police and. fire employees after ten years of employment. The. Manager recommended opposition to the bill until such time as the Legislature is prepared to include all government employees instead of singling out specific groups of employees. It was moved by Councilman Siokos, seconded by Councilman Smith, and carried, that the Council concur in the recommendation. Assembly Bill 38: Provides that each member of the Public Emp oyees e rement System be credited with all unused. sick leave in addition to his service credit at the time of retirement. As the cost of this additional benefit appears to be negligible,, the Manager recommended favoring the bill, Councilman Greens motion to concur died for lack of a second. The advisability of changing the present regulations and further investigation .of the bill was discussed, with no action being taken. Assembly Bi11 ~2: Proposes that cities be able to regulate e opera on o rubbish collection vehicles within their territorial limits. The Manager recommended favoring the bill, even .though no difficulty has been experienced with local contractors regarding the construction of their equip- ment. Assembly Bill 81: Requires the commission on peace o leers s an ards and training to establish optional minimum standards of compensation, retirement allowances, and. other fringe benefits. While the bill would. provide for subven- tion of funds to assist in paying compensation to policemen, it does not accept full responsibility to meet the total cost, and. yet it would. set that total cost for local juris- dictions. The Manager recommended against the hill because of its .infringement .upon the~philosoph~r~ of home rule, It was moved by Councilman Smith, seconded by Councilman Siokos, and carried, that the Council concur in the recommendation, Assembly Bill 79: Reaffirms legislative belief that respon- se y an au hority for law enforcement should remain under control of local law enforcement agencies, and estab- lishes that the Commission on peace officers= standards and training shall determine what equipment is necessary for police officers for their safety. Upon establishment of standards, the Commission will provide funds to local ~juris- dictions to totally underwrite the purchase of equipment. Assembly Bi11 173: Requires that the city shall purchase on y supp es ma e in California unless the supply is not made in California, or the cost of the California-made supply to the State exceeds the cost of the California-made supply to a private person, or the price of the California- made supply is excessive and unreasonable. As this bill would be prejudicial against goods of other states, would have the effect of increasing cost of goods to the city, and limit :freedom of choice to obtain the best possible American product at the least cost, the Manager recommended strongly against the bill. It was moved by Councilman Siokos, seconded. by Councilman Green, and carried, that the Council concur in opposing AB 173. Assembly Bill 200: Establishes an Astrologerts State License oar e nes astrology for the purpose of laws and. makes it unlawful to engage in the practice without a State license.. It provides for removal of an astrologerts license under certain conditions, and. prohibites treating or attempting to treat physical or mental conditions.
