Res. 69-4 RESOLUTION N0. 6g-4 entitled: "RESOLUTION OF THE CITY Demands COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR." was presented. ORDINANCE N0. 860 entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD AMENDING CHAPTER V, SECTION 5.00; CHAPTER VI, SECTION 6.07; AND CHAPTER XII, SECTION 12.04 OF ORDINANCE N0. 570 (ZONING ORDINANCE)." was presented for second reading. A letter from Mr: Rcfiard Rhine was read. Mr. Rhine expressed opposition to the adoption of the minimum floor areas and garaging requirements contained in the ordinance for the following reasons: (1) The requirements proposed would tend to lower land values; (2) Many existing R-2 and R-3 lots are of such size that they could not be developed, thus placing a hardship on those property owners contem- plating construction of additional units on their property; (3) The existing problem of the slow-down in residential construction and sales would be aggreviated by adoption of the proposed restrictions; (4) A survey of surrounding communities indicates Lynwood will have the most restrictive zoning ordinance in the area if the amendments are adopted. Mr. Rhine also suggested solving the parking and deterioration problems by enforcement of existing laws. The letter was accompanied by copies of the survey. It was moved by Councilman Byork, seconded by Council- man Green, and carried, that further reading be waived. Mr. Bob Compton addressed the Council to read a letter, previously presented to the Planning Commission during its deliberations on the amendments, opposing the proposed changes in area and garage requirements. He added that he commended the Planning Commission and Council for attempting to raise the standards but questioned whether or not the standards were too high and would discourage building. It was his view that the restrictions would require subterranean parking in future development, and suggested consideration of a different requirement for three-bedroom apartments. He commented on the freeway location and said he believed it would encourage commerce and industry, not Ord. 859 Zone change Lot 6, Lic. Surveyors Tr. (Wolfrom, 11181 Bullis Ord. 860 Amending 570 re floor area requirements 8 garage ~2 residential development. In informal discussion with the Council, he said he felt the area requirements were 100 feet too high in each instance and that the garage requirements were excessive. He concluded his remarks by suggesting that the area and garage requirements be given further study. Mr. Robert W. McCormack, associated with Ken Porter Realty, addressed the Council to cite examples of lowering of assessed valuations of a large number of R-3 properties in the area of Harris and Waldorf between Carlin Avenue and Olanda Street. Mr. Ken Porter, 3568 Louise Street, addressed the Council in opposition to the proposed amendments. He said he thought that the R-3 units under construction probably would not have been built if two garages per unit had been required, and if the ordinance is adopted, much of the R-2 and R-3 property will not be developed. He also said that before more garages are required, more should be done to require residents to use existing garages. Mr. Verne Stone, 11218 Elm, spoke in opposition to the proposed changes and said he felt the city is not ready for the type of development required under the proposed ordinance. Members of the Council commented on the professional economic survey recently completed in which it was recommended that the city's requirements be upgraded in view of the anticipated impact of the freeway on the residential, commercial and industrial development of the city. It was felt that the requirements should not be based on existing conditions but on the needs for the future. The Mayor said he thought the intent was to protect and upgrade the City in an effort to provide for tha future of the community. Roll Call: Ayes: Councilmen Byork, Green, Siokos, Stevens. Res. 69-5 RESOLUTION N0. 69-5 entitled: "A RESOLUTION OF THE CITY Authorizing COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE destruction DESTRUCTION OF CERTAIN PUBLIC RECORDS NO LONGER of public REQUIRED." was presented. The Clerk informed the records Council that permission to destroy the records has been obtained from the City Attorney as required by law. WRITTEN COMMUNICATIONS Alternate An alternate proposal for the purchase of the house and proposal for two of the city owned lots at Carlin Avenue and Bullis purchase of Road (Lautrup property) was presented. Because of his por. of inability to obtain financing, the buyer Mr. Charles Lautrup prop. Sloan, proposed he pay an additional $4,800 through presented escrow and that the Council authorize a trust deed secured by note for $22,700 in favor of the City-of Lynwood at an interest rate of 7%per cent per annum, principal and interest payable $160.45 or more per month, to continue until the principal and interest ) ~2 have been paid. Mr. Sloan addressed the Council to explain that the lending companies will not make a loan until the house is situated on the lot. He said that they are very desirous of purchasing the property but that no alternatives presented to him have been acceptable and he requested the Council's consideration of his proposal. He also said he was open for discussion of any counter-proposal. Members of the Council discussed the matter briefly and suggested that Mr. Sloan discuss his proposal with the City Manager. It was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that the request be held over for further consideration to next regular meeting on February 4, 1969. Mr. Bob Compton again addressed the Council to state that in zoning problems and such discussions as those concerning the freeway location, members of the Board of Realtors are always ready to be present to discuss the matters with the Council. REPORTS AND REQUESTS A request was presented from the Crippled Children's Crippled Children Society for permission to conduct their annual Easter fund drive March Seal campaign from March 1 to April 6, 1969. A request was presented from the City of Hope for permission to conduct its annual "Sunday Fund Drive" on June 8, 1969. It was moved by Councilman Byork, seconded by Councilman Green, and carried, that permission be granted. City of Hope fund drive June 8 A letter was presented from the City of Burbank City of Burbank requesting the Council's cooperation in a property tax request for tax reform study, and submitting a copy of the Burbank reform support resolution supporting the League of California Cities in its attempt to bring out equity with reference to County services. As this is a matter under consideration by the Independent Cities of Los Angeles County, it was moved by Councilman Byork, seconded by Councilman Green, and carried, that the letter be accepted and filed. The City Manager presented a report on the conflict between certain sections of Ordinance 570 dealing with site plan procedures in CB-1 zones. The conflict arises between Section 4(f) which provides that site plan approval by the Planning Commission is required for each use, and Section 16.20 et seq. which delegates the site plan approval to the City Manager with the right of appeal to the Planning Commission if the request is denied. In order to clarify the role of the Planning Commission in dealing with site plan applications and to expedite the site plan procedure, the Manager recommended adoption of an ordinance entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD AMENDING SECTION 7.69 OF CITY ORDINANCE N0. 570 BY AMENDING SUBPARAGRAPH Via) AND REPEALING SUBPARAGRAPH (f) THEREOF TO REMOVE A CONFLICT BETWEEN SAID SUB- PARAGRAPHS AND SECTION 16.21 OF ORDINANCE 570 BOTH CONCERNING SITE PLAN APPROVAL." which he presented for first reading. Report on conflict of sections in Ord. 570 Ord. first read Amending 570 to repeal'Sec: 7.69 (f) (site plan approval) `~ 3U It was moved by Councilman Byork, seconded by Councilman Stevens, that said ordinance be accepted as read for the first time and passed to the second reading. Report re The Manager reported that the Planning Commission, upon fence betweenreceiving a letter from the Seventh Day Adventists SDA prop & School concerning the fence separating the school Zodys property from the proposed Zodys development on Imperial Highway, discussed the matter at length at its January 14 meeting. The Planning Commission voted to suggest that the City Council amend the original agreement by requiring that a combination block wall six feet in height, capped by a 2-foot chain link extension, be erected on the east property line separating the school from the commercial development. In discussing the suggestion of the Planning Commission, it was determined that any action by the Council before a plot plan is presented would be premature, and it was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that the matter be set aside until there is further action by the parties involved. Report on A report was presented for the Council's information gutter on the petition presented by Mr. Antone Strasky, problem on 12623 Waldorf Drive, at the January 7, meeting Waldorf Dr. concerning water standing in the gutter on the west side of Waldorf Drive south of Carlin Avenue. The ponding is caused by slight rises or depressions in the curb created by tree roots in some locations and soil settling in others. The report stated that the Street Department is presently engaged in removing a two hundred foot section of gutter and replacing it at proper grade to alleviate the water problem. The expense of the project is being borne by the City from the General Fund. Report re Details of the annual renovation of the natatorium annual were described in a report presented by the City renovation Manager. The project took approximately two months of the necessitating closing of the pool from November 11 to natatorium January 13, 1969, and the City Manager suggested that special recognition should go to the aquatic supervisor, Ron Williams, and his staff for the outstanding job done . Report on Activities of the Building Department during 1968 were activities described in a report presented by the City Manager. of Bldg. The Manager concluded his detailed report by stating Dept. 1968 that all three of the inspectors have enrolled in a special building inspection correspondence training course, and should be complimented for their desire to improve their abilities and to keep pace with changing methods and materials of construction. Managers The City Manager requested authorization to attend the meeting annual spring meeting of the City Managers' Department 2/26-2/28 of the League of California Cities which will be held in Monterey on February 26-28, 1969. It was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that the request be approved. ORAL COMMUNICATIONS Mr. Ed White of Compton representing the Southwest Indian Scouts addressed the Council to request support in encouraging the fathers to join with their sons in the G activities of the Indian Scouts. Mrs. Dorothy Borsenberger addressed the Council to inquire about the ordinance requiring removal of old vehicles from private property, and asked if the ordinance is being enforced. She was told that it was and that if she has a complaint, she should contact the City Manager. ~... Mr. George Henderson of the Lynwood Press addressed the Council to comment on the recent murder of a Lynwood youth. He wished to clarify a new article appearing in the local newspaper to say that if anyone wished to contribute to the funds being accumulated for a reward for persons having information about the murder to contact Lt. Deleon of the Hollenbeck Station, Los Angeles. Councilman Stevens commented on the excellent emergency services provided by the Street Department during the recent storms. Councilman Green: asked what is being done about the sharp dip in the street on Carlin Avenue east of Bullis Road. The City Engineer said that plans for reconstruction are complete and the Manager said the work has been delayed in order that it can be done at the same time the intersection of Carlin and Bullis Road is reconstructed.
