HomeMy Public PortalAbout19961021REGULAR COUNCIL MEETING OCTOBER 21, 1996 CALL TO ORDER The Regular Council Meeting was called to order on October 21, 1996, 7:30 P.M. with Mayor Duane Schreimann presiding. Prayer was offered by Councilman Bill Byrd, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for roll call: Present: Byrd, Haake, Jaynes, Landwehr, McDowell, Nelson, Nilges and Vincent Absent: Jackson, Kammerdiener A quorum was declared present. SPECIAL PRESENTATIONS Mr. Gary Kempker, Missouri Director of Public Safety, announced Missouri's approval of the contract application from City of Jefferson and the Jefferson City School District under the Local Government /School Partnership Program. City Administrator Rich Mays introduced Mr. Nick Donze, Division Director of Park Resources, who made a presentation regarding his division's activities and responsibilities within the scope of the City's government. Mr. Sam Cook, Jefferson City, spoke in favor of the passage of Bill 96 -99 pertaining to the regulation of outdoor advertising. Ms. B. J. DeLong, 1107 Moreau Drive, introduced members of the Hawthorn Garden Club who were in attendance with her, who were also in favor of the passage of Bill 96 -99. Mr. Nick Luetkemeyer, 811 Esther, spoke in opposition to several of the sections in Bill 96 -99, which he felt did not regulate billboards, but rather prohibited them. CONSENT AGENDA The following items were brought before the Council on the Consent Agenda: a. Minutes of October 7, 1996, City Council Meeting b. Minutes of October 14, 1996, Special City Council Meeting c. Authorize Third -Year Renewal of Plumbing Services - All City REGULAR COUNCIL MEETING OCTOBER 21, 1996 d. Approval of Abatement of Special Tax Bills 14452 and 14678 e. Authorize Phase 2 of Convention Center Feasibility Study f. Renewal of Lease for Tourist Information Center Building Councilman Rick Nilges moved that Item (d) be removed from the Consent Agenda and referred to the Finance Committee, seconded by Councilman Carolyn McDowell, and motion was approved unanimously. Councilman Rick Nilges requested that Item (e) be removed from the Consent Agenda for separate consideration. A motion was made by Councilman Carl Jaynes to approve Items (a), (b), (c) and (f) of the Consent Agenda, seconded by Councilman James Haake, and approved unanimously. Item (e): Councilman Rick Nilges directed questions regarding Item (e) to staff. Following a lengthy discussion on the item, Councilman Larry Vincent moved to approved Item (e), seconded by Councilman Steve Nelson, and approved by voice vote with Councilmen Haake, Jaynes, and Nilges voting "Nay." MINUTES AND REPORTS RECEIVED AND FILED Mayor Duane Schreimann stated that the following minutes /reports have been received and are on file in the City Clerk's office: Finance Report for September, 1996; Planning & Zoning Commission, 9/12/96; Public Works & Planning Special Meeting, 9/30/96; Board of Adjustment, 9/10/96; Parks & Recreation Commission, 9/9/96; Park Resources Committee, 9/24/96; Transportation & Traffic Commission, 10/10/96; Appointment Review Committee 10/7/96 & 7/1/96 (corrected) ANNOUNCEMENTS BY MAYOR There were no announcements by the Mayor at this time. BILLS INTRODUCED Bill 96 -102, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH GEORGE BUTLER AND ASSOCIATES FOR A JEFFERSON CITY CONVENTION CENTER TRAFFIC STUDY. Councilman Haake requested that the rules be suspended, and Bill 96 -102 placed on third and final passage. There were no objections to the request. Bill 96 -105, sponsored by Councilman Jaynes, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RESCINDING SECTION 1, OF ORDINANCE NO. 11351, RELATING TO CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, OF AN APPROXIMATELY .47 ACRE TRACT OF LAND BEHIND 602 BLAIR DRIVE AND RESCINDING THE ZONING CLASSIFICATION OF PUD, PLANNED UNIT DEVELOPMENT AND REZONING THE PROPERTY TO RA -2, MULTIPLE FAMILY RESIDENTIAL DISTRICT. BILLS PENDING Bill 96 -91, sponsored by Councilman Kammerdiener, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO TEMPORARY SIGNS BY REPEALING SUBPART (C) OF SECTION 3 -6 (TEMPORARY SIGNS) OF THE CODE AND ENACTING IN LIEU THEREOF A NEW SUBPART (C) OF SECTION 3 -6 PERTAINING TO THE SAME SUBJECT. Mayor Duane Schreimann announced that since the bill's sponsor, Councilman Kammerdiener, was not at the meeting, the bill would be placed on the Informal Calendar. REGULAR COUNCIL MEETING OCTOBER 21, 1996 Bill 96 -92, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING ORDINANCE 12202 PERTAINING TO THE PERSONNEL POLICY MANUAL FOR THE MUNICIPAL SERVICE OF JEFFERSON CITY, MISSOURI, AND ENACTING A NEW ORDINANCE IN LIEU THEREOF. Following a lengthy discussion, Councilman Larry Vincent moved to call for the question, seconded by Councilman Rick Nilges requested that Bill 96 -92 be placed on the Informal Calendar. Council requested that Section 16 -6 be changed to "temporary reduction in rank or classification." Following further discussion, it was decided that each Council Member should receive a copy of the Personnel Policy Manual, containing proposed changes, from the Human Resources Department. Councilman Rick Nilges requested that a list of all the changes proposed accompany the document. Bill 96 -92 was placed on the Informal Calendar. Bill 96 -93, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ENACTING AN INVESTMENT BANKING POLICY. Councilman Rick Nilges moved that Bill 96 -95 be referred to the Finance Committee, motion was seconded by Councilman James Haake. Following a lengthy discussion, motion was defeated by voice vote with Councilmen Byrd, Haake, Jaynes, Landwehr, Nelson and Vincent voting "Nay." Following further discussion, Councilman Vincent moved to call for the question, seconded by Councilman Steve Nelson. Councilman Larry Vincent moved to amend Bill 96 -97 by restoring the funding to the Parks and Recreation Department for the two vehicles previously deleted during the budget process, and that City Staff be directed through City's Purchasing Agent and Finance Director to consider the feasibility of all departments purchasing used vehicles rather than new vehicles when applicable. Motion to amend was seconded by Councilman Carolyn McDowell, and approved unanimously. Councilman Landwehr moved to amend Bill 96 -99 by deleting paragraph 3 (Spacing of Billboards), subparagraph (c) on page 4, and relettering subsequent subparagraphs accordingly. Motion was seconded by Councilman Nelson, and approved unanimously. Councilman Carolyn McDowell requested that Bill 96 -83 remain on the Informal Calendar. RESOLUTIONS RS96 -10 Opposing Passage of Proposition A at November 5 Election. A motion was made by Councilman Rick Nilges to adopt RS96 -10, seconded by Councilman Bill Byrd, and approved unanimously. REGULAR COUNCIL MEETING OCTOBER 21, 1996 COUNCIL LIAISON REPORTS Councilman James Haake announced the Public Works Committee Meeting for October 24 at 7:30 P.M. NEW BUSINESS Councilman Carolyn McDowell made comments regarding the installation of night lights for citizens between Capitol Avenue and McCarty Street, and Lafayette and Ash, for a cost of approximately fifty cents per month. She requested that Chief Tyler Brewer investigate the possibility of doing that for other areas of the City. UNFINISHED BUSINESS There was no unfinished business to come before the Council at this time. NEW BUSINESS City Administrator Rich Mays announced that the Council will have a joint planning meeting with the Planning and Zoning Commission regarding annexation on Monday, October 28, and encouraged every Council Member to attend. City Administrator Rich Mays made an announcement about three town hall meetings which will occur in the next 30 -45 days. Councilman Larry Vincent announced that the Human Relations Task Force had a wrap -up meeting on October 17 regarding the study which was performed earlier in the year. Reports were given by Diane Spieker and Chief Tyler Brewer, and Councilman Vincent commended both of them for their outstanding representation of the City. EXECUTIVE SESSION MINUTES 1. Executive Session Minutes of October 7, 1996 Councilman McDowell moved that the minutes by approved, seconded by Councilman Jaynes, and approved unanimously.
