HomeMy Public PortalAboutMIN-CC-2014-03-11MOAB CITY COUNCIL REGULAR MEETING March 11, 2014 The Moab City Council held its Regular Meeting on the above date in the Council Chambers at the Moab City Center, located at 217 East Center Street, Moab, Utah. Mayor Pro-tem Doug McElhaney called the Pre - Council Workshop to order at 6:15 PM. In attendance were Councilmembers Heila Ershadi, Kyle Bailey, Gregg Stucki and Kirstin Peterson; City Manager Donna Metzler and City Recorder/Assistant City Manager Rachel Stenta; City Treasurer Jennie Ross, Planning Director Jeff Reinhart, Police Chief Mike Navarre, Community Development Director David Olsen and City Engineer Rebecca Andrus. REGULAR MEETING & ATTENDANCE A Presentation was made by Kara Dohrenwend regarding Fire and Flood PRE COUNCIL PRESENTATON Mitigation and Revegetation. Discussion followed. Mayor Pro-tem McElhaney called the Regular City Council Meeting to order at 7:00 PM and led the pledge of allegiance. Six (6) members of the audience and media were present. There were no minutes to approve. There were no Citizens to Be Heard. A Community Development Department Update was not given. Under Engineering Department Update, City Engineer Andrus stated that she had sent a letter to the frontage road hotels informing them that the frontage road would be renamed to Riverview Road. City Engineer also stated that she had received some input that the striping on 400 East is weird. City Engineer Andrus continued that the striping at the intersection of 400 East and 300 South was to allow visibility of bike lane travelers when vehicles are making a right turn. City Engineer Andrus stated that a Road Respect designation was being sought by staff for our community and that there would be a Road Respect/Transit Hub Opening event on May 31, 2014. Councilmember Stucki inquired if UDOT was conducting a traffic study. City Engineer Andrus stated that she was trying to get more information on that. A Planning Department Update was not given. March 11, 2014 REGULAR MEETING CALLED TO ORDER APPROVAL OF MINUTES CITIZENS TO BE HEARD COMMUNITY DEVELOPMENT UPDATE ENGINEERING UPDATE PLANNING UPDATE Page 1 of 6 A Police Department Update was not given. Under Public Works Department Update, Public Works Director Foster stated that Questar was in town and working on their utility relocation project and would be phasing their work at different locations. Public Works Director Foster also stated that he attended a preconstruction meeting for the pedestrian activated signal project on Main Street at the intersections of Uranium Avenue and 200 South. A Presentation was made by Roslynn Brain and Jeremy Lynch of Utah State University regarding Urban Water Harvesting. Discussion followed. Councilmember Ershadi moved to approve a Special Business Event License for the Youth Garden Project to Conduct the Moab Farmer's Market every Thursday from May 8 to October 16, 2014 with the conditions listed in the staff memo. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve Special Use of Swanny City Park for Youth Garden Project to Conduct the Moab Farmer's Market every Thursday from May 8 to October 16, 2014. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve a Special Business Event License for Rockwell Relay to Conduct a Cycling Relay Event at Swanny City Park June 12 and 13, 2014 with the conditions listed in the staff memo. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve Special Use of Swanny City Park for Rockwell Relay to Conduct a Cycling Relay Event June 12 and 13, 2014. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Ershadi moved to approve a Special Business Event License for Moab Valley Multicultural Center to Conduct a Flea Market Located at 100 West and 156 North from April 12 to September 13, 2014. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve a Special Business Event March 11, 2014 POLICE UPDATE PUBLIC WORKS UPDATE PRESENTATION BY USU ON URBAN WATER HARVESTING SPECIAL BUSINESS EVENT FOR MOAB FARMER'S MARKET, APPROVED SPECIAL USE OF SWANNY CITY PARK FOR MOAB FARMER'S MARKET, APROVED SPECIAL BUSINESS EVENT FOR ROCKWELL RELAY, APPROVED SPECIAL USE OF SWANNY CITY PARK FOR ROCKWELL RELAY, APPROVED SPECIAL BUSINESS EVENT FOR MOAB VALLEY MULTICULTURAL CENTER, APPROVED SPECIAL BUSINESS EVENT FOR ZOMBI 5K FUN RUN, Page 2 of 6 License for Matthew Niesen to Conduct the Zombi 5k Fun Run on the Millcreek Parkway on October 25, 2014 with the conditions listed in the staff memo. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve Special Use of Swanny City Park for Matthew Niesen to Conduct the Zombi 5k Fun Run on October 25, 2014. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Special Business Event License for Creative Solutions Group Inc., d.b.a. Chrysler to Conduct a Jeep Enthusiast Event from April 15 to 18, 2014 Located at 132 North Main Street with the conditions listed in the staff memo and a restriction that there is no through traffic onto 100 East through the lot. Councilmember Stucki seconded the motion. Councilmember Bailey moved to approve a Special Business Event License for TransRockies US LP to Conduct the Moab Rocks Mountain Bike Race and Social October 10 to 13, 2014 at Swanny City Park with the conditions listed in the staff memo. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve Special Use of Swanny City Park for Moab Rocks Mountain Bike Race and Social October 10 to 13, 2014. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Park Alcohol Permit for Kevin McDonald for Moab Rocks at Swanny City Park October 10 to 13, 2014. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Councilmember Ershadi moved to approve a Class IV Special Event Beer License for Kevin McDonald, d.b.a. TransRockies US LP to Conduct Moab Rocks at Swanny City Park October 10 to 13, 2014. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve Local Consent for a Single Event Permit for TransRockies US LP to Conduct Moab Rocks on October March 11, 2014 APPROVED SPECIAL USE OF SWANNY CITY PARK FOR ZOMBI 5K FUN RUN, APPROVED SPECIAL BUSINESS EVENT FOR CREATIVE SOLUTIONS, APPROVED SPECIAL BUSINESS EVENT FOR MOAB ROCKS MOUNTAIN BIKE RACE AND SOCIAL, APPROVED SPECIAL USE OF SWANNY CITY PARK FOR MOAB ROCKS MOUNTAIN BIKE RACE AND SOCIAL, APPROVED PARK ALCOHOL PERMIT FOR MOAB ROCKS, APPROVED CLASS IV SPECIAL EVENT BEER LICENSE FOR MOAB ROCKS, APRPOVED LOCAL CONSENT GRANTEDFOR A SINGLE EVENT PERMIT FOR MOAB ROCKS, APPROVED Page 3 of 6 10 to 13, 2014. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Ershadi moved to approve a Refund of the Special Business Event Fee by the Moab Valley Multicultural Center in an Amount Not to Exceed $290. Councilmember Bailey seconded the motion. The motion failed 2-3 nay with Councilmembers Peterson, McElhaney and Stucki voting nay and Councilmembers Ershadi and Bailey voting aye. Councilmember Peterson moved to Award the Photographic Concessionaire Bid to Perpetual Images for a three year term. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve the Photographic Concessionaire Contract. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Request for Use of City Right- of-way by John Knowles to Conduct an Annual Sidewalk Sale March 14 to 16, 2014 at 50 South Main Street. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Vendors License for City Market to Conduct a Garden Center Located at 425 South Main Street from March 17 to June 30, 2014. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Stucki moved to approve Proposed Resolution #15-2014 — A Resolution Accepting the Municipal Wastewater Planning Program Annual Self -Assessment Report for 2013. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Request for an Affordable Housing Waiver of Impact Fees by the Housing Authority of Southeastern Utah in the Amount of $956. Councilmember Bailey seconded the motion. Councilmember Bailey moved to table. Councilmember Peterson seconded the motion to table. The motion to table carried 5-0 aye. Councilmember Bailey moved to table a Request for an Affordable Housing Refund of Impact Fees by Community Rebuilds on behalf of March 11, 2014 REFUND OF SPECIAL EVENT FEE FOR MOAB VALLEY MULTICULTURAL CENTER, FAILED PHOTOGRAPHIC CONCESSIONAIRE BID AWARDED TO PERPETUAL IMAGES PHOTOGRAPHIC CONCESSIONAIRE CONTRACT, APPROVED USE OF CITY RIGHT-OF-WAY APPROVED FORJOHN KNOWLES VENDORS LICENSE FOR CITY MARKET TO CONDUCT A GARDEN CENTER, APPROVED PROPOSED RESOLUTION #15- 2014, APPROVED REQUEST FOR AFFORDABLE HOUSING WAIVER OF IMPACT FEES, TABLED REQUEST FOR AFFORDABLE HOUSING WAIVER OF IMPACT FEES, TABLED Page 4 of 6 Stephen Langello in the Amount of $478.00. Councilmember Ershadi seconded the motion. The motion to table carried 5-0 aye. Councilmember Ershadi moved to approve a Request for an Affordable Housing Waiver of Building Permit Fees for Four Corners Mental Health for the Aspen Cove Transitional Housing Project in the amount of $3,830.17. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Class III Beer License for Benton Ketel, d.b.a. RTA Canyonlands, LLC to Conduct Retail Beer Sales Located at 555 South Main Street with the conditions listed in the staff memo. Councilmember Ershadi seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to grant Local Consent for a Club Liquor License for Moab Investments LLC, d.b.a. Club Rio. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Discussion Regarding the City Vendor Ordinance Under Mayor and Council Reports, Councilmember Ershadi stated that she had attended workshop on Urban Water Harvesting and received information regarding the proposed Utah State University Moab Campus. Councilmember Ershadi stated that Utah State University had stated that a $2,000 contribution from the City could help with a project at their current location. Councilmember Ershadi requested that the City consider allocating that contribution from the Utah State University Setaside fund that was established a few years ago. Councilmember Stucki stated that he had attended a Grand County Solid Waste District meeting and that May 10, 2014 would be Hazardous Household Waste and Battery and Electronics Clean Up Day for Grand County residents. Councilmember Stucki stated that the District was working on a "Green Guide" for the community outlining waste and recycling resources. Councilmember Peterson reported that the Canyonlands Health Care Special Service District was successful in getting both legislative changes passed regarding option out of the Utah Retirement Systems and implementing a Health Care Sales Tax option. There was no Correspondence to be Read. March 11, 2014 REQUEST FOR AFFORDABLE HOUSING WAIVER OF BUIDLING PERMIT FEES FOR FOUR CORNERS MENTAL HEALTH, APPROVED CLASS III BEER LICENSE FOR RTA CANYONLANDS APPROVED WITH CONDITIONS LOCAL CONSENT FOR A CLUB LIQUOR LICENSE FOR MOAB INVESTMENTS, D.B.A. CLUB RIO, APPROVED DISCUSSION REGARDING CITY VENDOR ORDINANCE MAYOR AND COUNCIL REPORTS READING OF CORRESPONDENCE Page 5 of 6 Under Administrative Report, City Manager Metzler discussed possible meeting dates for the 2014 budget process schedule. A Report on City/County Cooperation was not given. Councilmember Ershadi moved to pay the bills against the City of Moab in the amount of $240,429.39. Councilmember Bailey seconded the motion.
