HomeMy Public PortalAbout19961118REGULAR COUNCIL MEETING NOVEMBER 18, 1996 CALL TO ORDER The Regular Council Meeting was called to order on November 18, 1996, 7:30 P.M. with Mayor Duane Schreimann presiding. Prayer was offered by Councilman Charles Jackson, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for roll call: Present: Haake, Jackson, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Absent: Byrd, Jaynes A quorum was declared present. SPECIAL PRESENTATIONS Ms. Kay Toft, 2510 Royal Air Drive, spoke to the subject of Bill 96 -113, vacating an alley on Missouri Blvd. She stated that the Park Board had voted to recommend to the Council that the alley be closed and placed in the hands of the Park Board. CONSENT AGENDA The following items were brought before the Council on the Consent Agenda: a. Minutes of November 4, 1996, City Council Meeting b. Approval of Convention & Visitors' Bureau 1997 Budget c. Approval of Sale of Surplus Bus to Stoddard County Transit System A motion was made by Councilman Charles Nelson to approve the Consent Agenda, seconded by Councilman Larry Vincent, and approved unanimously. BIDS OVER $25,000 Dental Insurance Renewal - A motion was made by Councilman Charles Jackson to approve dental insurance renewal, seconded by Councilman Steve Nelson and approved REGULAR COUNCIL MEETING NOVEMBER 18, 1996 unanimously. MINUTES AND REPORTS RECEIVED AND FILED Mayor Duane Schreimann stated that the following minutes /reports have been received and are on file in the City Clerk's office: Transportation & Traffic Commission, 11/7/96; Public Work & Planning Committee, 10/24/96; Mayor's Council on Physical Fitness, 10/17/96 ANNOUNCEMENTS BY MAYOR There were no announcements by the Mayor at this time. MAYORAL APPOINTMENTS Mayor Duane Schreimann made the following recommendations for appointments to the Council: d. Probationary Police Lieutenant - Sergeant Ray P. Bledsoe e. Probationary Police Sergeant - Officer Michael W. Smith A motion was made by Councilman Larry Vincent to approve the appointments, seconded by Councilman Carolyn McDowell and approved unanimously. BILLS INTRODUCED Bill 96 -113, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING A TWENTY FOOT WIDE NORTH -SOUTH ALLEY AND PART OF DUNKLIN STREET LYING SOUTH OF MISSOURI BOULEVARD, NORTH OF WASHINGTON PARK, AND WEST OF VIRGINIA STREET IN JONES ADDITION TO THE CITY OF JEFFERSON. Bill 96 -114, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO CIGARETTE DEALERS BY REPEALING ARTICLE III (CIGARETTE DEALERS) OF CHAPTER 17 OF THE CODE AND ENACTING IN LIEU THEREOF A NEW ARTICLE III PERTAINING TO THE SAME SUBJECT. REGULAR COUNCIL MEETING NOVEMBER 18, 1996 Bill 96 -115, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI BY ADOPTING A NEW SECTION 2 -355 PERTAINING TO APPROPRIATIONS. Councilman Rick Nilges requested that Bill 96 -110 be placed on the Informal Calendar. Bill 96 -111, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE JEFFERSON CITY AREA CHAMBER OF COMMERCE FOR THE CONVENTION AND VISITORS BUREAU. Bill 96 -111 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12554: Aye: Haake, Jackson, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Nay: None Bill 96 -112, sponsored by Councilman McDowell, entitled: REGULAR COUNCIL MEETING NOVEMBER 18, 1996 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 1 -13 (GENERAL PENALTY; CONTINUING VIOLATIONS), SUBPARAGRAPH (E), OF THE CODE OF THE CITY OF JEFFERSON BY THE ESTABLISHMENT OF NEW MINIMUM FINES CERTAIN OFFENSES, AND INCREASING EXISTING MINIMUM FINES FOR CERTAIN OFFENSES. Councilman Carolyn McDowell moved that a substitute to Bill 96 -112 be offered at this time in lieu of the previously read Bill 96 -112, seconded by Councilman Charles Jackson, and motion was approved unanimously. Councilman Carolyn McDowell then requested that Bill 96 -112, as substituted, be placed on the Informal Calendar. INFORMAL CALENDAR Bill 96 -83, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 3 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY THE ADDITION OF A NEW SECTION REGULATING UNLAWFUL SIGNS ERECTED ON CITY RIGHT -OF -WAY ON JANUARY 1, 1991. Following a brief discussion, Councilman Carolyn McDowell requested that Bill 96 -83 remain on the Informal Calendar, where it died. Bill 96 -92, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING ORDINANCE 12202 PERTAINING TO THE PERSONNEL POLICY MANUAL FOR THE MUNICIPAL SERVICE OF JEFFERSON CITY, MISSOURI, AND ENACTING A NEW ORDINANCE IN LIEU THEREOF. Councilman Rick Nilges requested that Bill 96 -92 remain on the Informal Calendar RESOLUTIONS There were no resolutions to come before the Council at this time. COUNCIL LIAISON REPORTS There were no Council liaison reports given at this time. UNFINISHED BUSINESS REGULAR COUNCIL MEETING NOVEMBER 18, 1996 Councilman John Landwehr reported that the Annexation Committee is prepared to recommend to the Council that the Council endorse the Annexation Plan as part of the Comprehensive Plan, and stated that a resolution will be considered on same at the next City Council meeting. NEW BUSINESS Bill 96 -116. City Administrator Rich Mays explained that the Bill has already been prepared for distribution to Council at this time, and stated that since it deals with tree removal. If Council does not wish to hold a Special Council Meeting to allow for the introduction of the bill so that it may be passed at the December 2 Regular Council Meeting, staff is requesting suspension of the rules at the December 2 meeting so that the project can begin immediately while weather permits. Council did not wish to hold Special Council Meeting for the purpose of introducing the bill. The bill was distributed to the Council for their information at this time. EXECUTIVE SESSION MINUTES Executive Session Minutes of November 4, 1996 Councilman McDowell moved that the minutes by approved, seconded by Councilman Jackson, and approved unanimously. ADJOURNMENT There being no further business to come before the Council at this time, A motion was made by Councilman Steve Nelson that the meeting be adjourned, seconded by Councilman Charles Jackson and approved unanimously.
