HomeMy Public PortalAbout19961202REGULAR COUNCIL MEETING DECEMBER 2, 1996 CALL TO ORDER The Regular Council Meeting was called to order on December 2, 1996, 7:30 P.M. with Mayor Duane Schreimann presiding. Prayer was offered by Councilman Charles Jackson, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for roll call: Present: Byrd, Haake, Jackson, Jaynes, Landwehr, McDowell, Nilges and Vincent Absent: Kammerdiener, Nelson A quorum was declared present. SPECIAL PRESENTATIONS Mr. Dick Groner made a presentation regarding Innovative Housing Development that Uses an Overlay Zoning Process vs. That Which Now Exists in City Code. He distributed a proposed ordinance pertaining to that topic. Mr. Robert Carico, 338 Old Gibler Road, a representative of a government employee union, made a presentation regarding pending Bill 96 -92, specifically as it pertained to "at- will" employees and the dismissal process for same. CONSENT AGENDA The following items were brought before the Council on the Consent Agenda: a. Minutes of November 18, 1996, City Council Meeting A motion was made by Councilman Bill Byrd to approve the Consent Agenda, seconded by Councilman Charles Jackson and approved unanimously. MINUTES AND REPORTS RECEIVED AND FILED Mayor Duane Schreimann stated that the following minutes /reports have been received and are on file in the City Clerk's office: Solid Waste Committee, 9/17/96; Parks & Recreation Meetings: Commission Meeting, 10/14/96, Activities Committee, 10/22/96, and Long Range Planning Committee, 11/5/96; REGULAR COUNCIL MEETING DECEMBER 2, 1996 Planning & Zoning Commission, 10/10/96; Housing Authority Board of Commissioners, 10/29/96 ANNOUNCEMENTS BY MAYOR There were no announcements by the Mayor at this time. MAYORAL APPOINTMENTS Mayor Duane Schreimann made the following recommendations for appointments to the Council: a. Probationary Information Systems Coordinator - Matthew J. Mahon A motion was made by Councilman Larry Vincent to approve the appointments, seconded by Councilman Carolyn McDowell and approved unanimously. BILLS INTRODUCED Bill 96 -116, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH HARDT CONSTRUCTION LLC FOR REMOVAL OF TREES ON RESIDENTIAL AND COMMERCIAL BUYOUT PROPERTIES IN NORTH JEFFERSON CITY. Councilman Haake requested that the rules be suspended and Bill 96 -116 placed on final passage. There were no objections to the request for suspension of the rules. Bill was then read second and third times by title, placed on final passage, and passed by the following vote as Ordinance No. 12555: Aye: Byrd, Haake, Jackson, Jaynes, Landwehr, McDowell, Nilges and Vincent Nay: None Bill 96 -117, sponsored by Councilmen Byrd, Haake, Jackson, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, Nilges, Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING ORDINANCE 12544 PERTAINING TO CITY ELECTIONS. Bill 96 -118, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION REGULAR COUNCIL MEETING DECEMBER 2, 1996 19 -401 OF THE CODE OF THE CITY OF JEFFERSON, SCHEDULE (G) (STOP INTERSECTIONS) BY THE ADDITION OF DEL CERRO DRIVE AT EL DORADO DRIVE. Bill 96 -119, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI BY AMENDING CHAPTER 4, SECTION 4 -15 RELATING TO SALES OF INTOXICATING LIQUOR TO MINORS, DRUNKARDS, ETC. BILLS PENDING Bill 96 -113, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING A TWENTY FOOT WIDE NORTH -SOUTH ALLEY AND PART OF DUNKLIN STREET LYING SOUTH OF MISSOURI BOULEVARD, NORTH OF WASHINGTON PARK, AND WEST OF VIRGINIA STREET IN JONES ADDITION TO THE CITY OF JEFFERSON. Councilman James Haake requested that Bill 96 -113 be placed on the Informal Calendar. Bill 96 -114, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO CIGARETTE DEALERS BY REPEALING ARTICLE III (CIGARETTE DEALERS) OF CHAPTER 17 OF THE CODE AND ENACTING IN LIEU THEREOF A NEW ARTICLE III PERTAINING TO THE SAME SUBJECT. Bill 96 -114 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12556: Aye: Byrd, Haake, Jackson, Jaynes, Landwehr, McDowell, Nilges and Vincent Nay: None Bill 96 -115, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI BY ADOPTING A NEW SECTION 2 -355 PERTAINING TO APPROPRIATIONS. Councilman Rick Nilges requested that Bill 96 -115 be placed on the Informal Calendar. REGULAR COUNCIL MEETING DECEMBER 2, 1996 Bill 96 -111, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE JEFFERSON CITY AREA CHAMBER OF COMMERCE FOR THE CONVENTION AND VISITORS BUREAU. Bill 96 -111 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12554: Aye: Haake, Jackson, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Nay: None RESOLUTIONS RS96 -12 Adoption of Annexation Plan, 1996, as Part of Comprehensive Plan Update (Sponsored by Councilman Landwehr). A motion was made by Councilman Charles Jackson to adopt RS96 -12, seconded by Councilman Carl Jaynes and approved unanimously. RS96 -13 Adoption of Moratorium on Cellular Communications Towers in Non - Compliance with Interim Plan and Design Standards (Sponsored by Councilman Jaynes). Following discussion, a motion was made by Councilman Carl Jaynes to adopt RS96 -13, seconded by Councilman Bill Byrd and approved unanimously. INFORMAL CALENDAR Bill 96 -92, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING ORDINANCE 12202 PERTAINING TO THE PERSONNEL POLICY MANUAL FOR THE MUNICIPAL SERVICE OF JEFFERSON CITY, MISSOURI, AND ENACTING A NEW ORDINANCE IN LIEU THEREOF. Councilman Rick Nilges requested that Bill 96 -92 be removed from the Informal Calendar and placed on final passage. Bill 96 -92 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12557: Aye: Nay: Byrd, Haake, Jackson, Jaynes, Landwehr, Nilges and Vincent McDowell, Bill 96 -110, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE REGULAR COUNCIL MEETING DECEMBER 2, 1996 EXTENSION AND MODIFICATION OF THE 9 -1 -1 CONTRACT WITH COLE COUNTY. Councilman Rick Nilges requested that Bill 96 -110 remain on the Informal Calendar. Bill 96 -112, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 1 -13 (GENERAL PENALTY; CONTINUING VIOLATIONS), SUBPARAGRAPH (E), OF THE CODE OF THE CITY OF JEFFERSON BY THE ESTABLISHMENT OF NEW MINIMUM FINES CERTAIN OFFENSES, AND INCREASING EXISTING MINIMUM FINES FOR CERTAIN OFFENSES. Councilman Carolyn McDowell requested that Bill 96 -112 remain on the Informal Calendar. COUNCIL LIAISON REPORTS Councilman Carl Jaynes reported that Christmas cards are being made by local school children which will be sent to the crew of the USS Jefferson City Submarine. He also reported that a check has been issued to the Commander designated to be used for a Christmas party for the crew. Councilman Carolyn McDowell requested that staff advise Council if the Environmental Quality Commission is still active. Councilman Rick Nilges announced that a Finance Committee meeting will be held on Monday, January 13, at 7:30 P.M. UNFINISHED BUSINESS There was no unfinished business to come before the Council at this time. NEW BUSINESS Councilman Carolyn McDowell requested that Finance Director Robert Kenneyfind out how many packs of cigarettes were sold in the City last year. Councilman Carl Jaynes moved that the proposed PUD ordinance submitted by Mr. Dick Groner earlier in the meeting be referred to the Planning & Zoning Committee. Motion was seconded by Councilman Carolyn McDowell, and approved unanimously. City Administrator Rich Mays made comments regarding parking spaces requested by Missouri River Regional Library. He stated that the City would do everything possible to REGULAR COUNCIL MEETING DECEMBER 2, 1996 help the library with their parking needs. EXECUTIVE SESSION MINUTES Executive Session Minutes of October 24, 1996: Councilman McDowell moved that the minutes by approved, seconded by Councilman Vincent, and approved unanimously. EXECUTIVE SESSION Councilman Charles Jackson moved that the Council go into Executive Session at this time for the purpose of discussing real estate, personnel, and litigation.
