REGULAR MEETING NOVEMBER 17, 1970
The City Council of the City of Lynwood met in a
regular session in the City Hall, 11330 Bullis Road, on
above date at 7:30 p.m.
Mayor Green in the chair.
Councilmen Byork, Green, Liewer, Siokos, Stevens answered
the roll call.
It was moved by Councilman Byork, seconded by Council-
man Stevens, and carried, that the minutes of the
regular meeting of November 4, 1970, be approved as
written.
RESOLUTION N0. 70-62 entitl@d: "A RESOLUTION OF THE Res. 70-62
CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND Demands
APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS
DRAWN THEREFOR," was presented. It was moved by
Councilman Liewer, seconded by Councilman Stevens,
that said resolution be adopted.

Mayor Green proclaimed the week of November 16 to 22, November 16 -
1970, as "Teen Challenge Week." Mr. Gene Wilson, 22, Teen
Director of the Orange County Teen Challenge, Challenge Week
addressed the Council concerning the Teen Challenge
Rally being sponsored by the Lynwood Woman's Club,
Juniors. The rally will be held on November 21 at
the Lynwood High School Auditorium at 7:30 p.m, and
the public is invited.
PUBLIC HEARINGS
The hour of 7:30 p.m. having arrived, said hour
being the time fixed for public hearing on the
proposed vacation of that portion of Century
Boulevard, 42 feet wide, lying adjacent to Lot 11
Tract 20680, the Council was informed that notice
of hearing had been posted as required and that
no protests or objections had been received.
The City Manager presented a report reviewing
previous action on the request of Richard G.
and Mary S. Kieffner for vacation of the subject
portion of Century Boulevard to enable it to be
used for off street parking in connection with
the development of a United California Bank on
adjacent Lots 8, 9 and 10, Tract 20680. A map
indicating the area to be vacated was presented
for the Council's information.
The Mayor inquired if there were any present wishing
to be heard. As there was no response, the Mayor
declared the public hearing closed.

WRITTEN COMMUNICATIONS
Letter from DAV A letter from Lynwood Chapter No. 86, Disabled
expressing American Veterans, was read in which they expressed
appreciation for appreciation to the City officials and Chamber of
City cooperation Commerce for cooperation during the recent Fall
during Fall Festival in which they took part. It was moved by
Festival Councilman Liewer, seconded by Councilman Stevens,
and carried, that the letter be accepted and filed.
REPORTS AND REQUESTS
Diplomats - The request of the Diplomats Drum and Bugle Corps
refreshment for permission to operate a refreshment stand at
stand at parade the disbanding area of the Christmas Parade on
Novm 27 November 27 was presented. It was moved by
Councilman Stevens, seconded by Councilman Byork,
and carried, that the request be granted contingent
on compliance with applicable city ordinances.

The request from Girls Scout Troop 2010 for
permission to hold a garage sale at lOlg2 Colyer
Avenue was presented. Because such a sale would
be in direct violation of R-1 zone requirements,
the City Clerk was requested to notify the
applicants of the Council's inability to grant
the request.
~""" A request from Stephen D. Schertzer, g22 No.
Santa Fe Avenue, Compton, for permission to
'~ solicit and collect reclaimable waste items was
presented. Mr. Schertzer proposes to conduct a
private venture in which the home owner would
voluntarily save reclaimables such as newspapers,
aluminum cans, foil, frozen food trays, and
glass containers, all materials which can be
reprocessed and remanufactured into new products.
The letter explained in detail the method Mr.
Schertzer intends to use in carrying out
collection of reclaimable items and the benefit
to be derived from reducing the quantity of
waste material which must be disposed of by
land fill or other methods.
After discussion of Mr. Schertzer's proposal
and the City Attorney's comments that the
existing city trash collection contract should
be examined for possible conflict, the Council
asked that the City Attorney investigate the
matter. If it develops that permission cannot
be granted, the City Clerk should so notify Mr.
Schertzer; otherwise, he should be notified of
the proper application procedure to be followed.
The application of J. W. McCann and R. A. Lyons
for a dance permit at 3158 Century Boulevard
was presented. The City Council was informed
that the occupancy permit has been approved by
the Building Department and Fire Department
and the Police investigative report indicates
no reason why the permit should not be granted.
It was moved by Councilman Byork, seconded by
Councilman Liewer, that the Dance permit be
granted.

The application of Charles Barlia for a
special permit to conduct a Christmas tree
sales lot at 10721 Atlantic Avenue was presented.
It was moved by Councilman Liewer, seconded by
Councilman Stevens, and carried, that the special
permit be granted.
The City Clerk presented a request from Building
~~,,,,, Official Jack DeJong that the Council set a
public hearing in order to determine whether or

_ 11430 Pear Street is a public nuisance and should
be abated. Efforts to rehabilitate the property
were initiated by the Building Department on
March 7, 196g, by requesting that the owner
take necessary steps to overcome the substandard

dwellings and a garage which now, due to lack of
response by the owner, has become very dilapidated
and unsafe and action is necessary to correct the
situation.
Res. 70-64 RESOLUTION N0. 70-64 entitled: "RESOLUTION OF THE

Water Rate Study Public Works Director Lewis Garber presented a
report, the purpose of which was an analysis of the
Water Department operations and support of a
recommendation to increase water rates where it is
shown that water revenues are insufficient to meet
expenditures required for adequate service of
water to the community. The report was accompanied
by material which was projected upon a screen to
illustrate graphically the information contained
in the report. (See report on file in the office
of the City Clerk for details of analysis.)
Throughout his presentation, Mr. Garber answered
questions from members of the City Council and
the audience. After summarizing the report, Mr.
Garber recommended the following:
1. Revise Chapter 31 of the Lynwood City Code to
include all the following recommendations and, in
addition, those administrative changes proposed by
the staff under separate cover.
2. Maintain existing service connection charges,
except delete Flat Rate Connection Charge.
3. Raise General Flat Rate to $4.15 per month for
the first residential unit per service, and $1.75
for every unit thereafter.
4. Change General Metered Service Rate Structure to
a Readiness to Service Charge, plus a Quantity
Charge, and establish the respective rates as outlined
in Chapter VIII of this study.
5. Eliminate Special Flat Rate Service for public
schools and require them to be metered, at city
expense.
6. Raise Private Fire Protection Service Rates to
$2.00 per month per each inch of diameter of service ~~•••
connection.
7. Change the basis of determining the amount of
money to be transferred from the Water Fund to the
General Fund to an overhead rate based on ten
percent (10%) of gross revenue, to be effective
July 1, 1971.

8. Adopt a long range policy of creating a fully Water Rate Study
metered water system and, as a first step toward
this end, establish the following:
a. Prohibit the installation of any new
flat rate services.
b. Require that a service be metered, at city
expense, when property ownership changes.
c. Require all existing flat rate services be
metered, at city expense, that serve three
(3) or more residential units per service
per lot.
d. Require all flat rate services on lots in
excess of 9,000 square feet in area be metered,
at city expense.

July, 1972, to offset the continuing rising costs
of M.W.D.

Councilman Siokos commented on the many study
sessions that have been held on the water probler
and the Council's awareness of the problems
involved.
The Council was unanimous in commending Mr. Garber
for the excellence of his report.
Report on The Manager presented a report which recalled that
supplemental during the 1970-71 budget sessions it was
revenue determined that it would be necessary to develop
additional revenue from several sources, one of
which was the revision of the business license;
and other tax structures. Following intensive
investigation, the following changes were
recommended:
1. Manufacturing, retailing, wholesaling, etc.
at fixed locations: One employee, $20.00; two
employees, $25.00; three employees, $30.00; Four
employees, $35.00. The fee schedule for five
employees or more to remain as established by
amendment in 1868.
2. A license classification for professional
types of business such as doctors, dentists,
attorneys, engineers, etc., with the following
proposed fee schedule: For the first member of
the firm practicing his profession other than
as a salaried employee - $20 per year, plus
$15 per year for each additional practicing
professional. Four dollars each for the first
four employees and $2 each for employees in excess
of five .
3. A business license classification for
apartment houses of four units or larger on the
following fee schedule: All installations,
4 units and larger, $20.00 per year. Beginning
with the 10th unit, an additional $1.50 per unit
per year.
4. Change of fee for janitorial service from
the present $10 per year to $15 per year.
5. A license fee of $15 per year for non-State
licensed occupations such as maintenance and
repair work for residential, commercial and
industrial occupancies. .•

6. Change of fee for cigarette vending machines
from the present $5 per year to $7.50 per year.
7. Creation of three member review board
consisting of the City Attorney, License Collector
and City Manager to determine the placement within

the license fee structure of new or non-catagorized
businesses.

OF LYNWOOD AMENDING THE FOLLOWING SECTIONS OF THE

JANITORIAL SERVICE FEE), 20.67 (INCREASING FEE-
NUMBER OF EMPLOYEES}, 20.81 (b) (INCREASING FEE
~"" CIGARETTE VENDING MACHINES), 20.2 (ADDING REVEIW
BOARD) AND AMENDING CHAPTER XX OF THE LYNWOOD

The report also contained information concerning
State legislation which grants General Law cities
authority to levy a tax upon rent charged by
operators of hotel and motel dealing in transient
L_, rental service of 30 days or less (Government
Code Section 53010). The Council was informed
that the City Attorney has prepared an ordinance
establishing a 5% tax on all such room rentals
and the ordinance entitled: "AN ORDINANCE OF
THE CITY OF LYNWOOD AMENDING THE LYNWOOD CITY
CODE TO ADD ARTICLE IV TO CHAPTER 29 TO LEVY A
TRANSIENT ROOM TAX," was presented for first
reading. It was moved by Councilman Byork,
seconded by Councilman Liewer, and carried, that
further reading be waived.

The Manager also reported on issuance on a franchise Report on
for towing and impound storage requirements for the Towing
Police Department in which interest has been expressed franchise
by members of the City Council on previous occasions.
Besides the advantage of additional revenue, the
Manager commented on the ~,dYantage to the city of
being able to fix service fees, gain better control
of impound yards, and the advantage of dealing
with a single tow service in handling vehicles
in custody. The Manager stated that if it was

the Council's desire, he would proceed with further
investigation of a joint franchise.
The Council agreed that a towing franchise should
be investigated further.
ORAL COMMUNCATIONS
Discussion re Mr. Jerry Rokos, 12217 Bullis Road, informed the
proposed water Council that his dwelling consists of a duplex
rates which is being used as one dwelling and asked
if there is anything in the proposed water ordinance
which would enable him to pay only the single
unit rate, rather than the duplex rate. He was
informed that so long as it remains as two units,
there could be no change.
Mr. Rokos also objected to the proposed water
rate changes.
Liewer comments Councilman Liewer commented on the heavy east
on heavy traffic bound traffic on Imperial Highway at certain
on Imperial Hwy. hours of the day, much of which he felt might
turn southbound on the Long Beach Freeway. He
suggested that a directional sign be placed at
the intersection of Century Boulevard and Imperial
Highway indicating access to the southbound Long
Beach Freeway, ,thus possibly diverting some of
the Imperial Highway traffic east bound onto
Century Boulevard.
Crosswalks on Councilman Stevens commented on the failure
Long Beach Blvd. of motorists to observe the pedestrian's rights
& the art house at crosswalks on Long Beach Boulevard. He
discussed said he would welcome any suggestion that
would be of help in reducing the hazard to
pedestrians. He also asked about the possibility
of increasing the space at the art house for
those using the facilities, stating that because
of 'the interest in the class it is now extremely
crowded. The City Manager informed him that
because of the type of structure of the art
house, it is not safe to open the upper floor
to use without extensive and costly alterations.
Mayor Green Mayor Green commented on recent arrests made at
.commented on an establishment on Long Beach Boulevard wherein
arrests made the charge was reduced to distrubing the peace,
recently and asked Chief Darton for a report on the matter.
