HomeMy Public PortalAbout19970203REGULAR COUNCIL MEETING FEBRUARY 3, 1997 CALL TO ORDER The Regular Council Meeting was called to order on February 3, 1997, 7:30 P.M. with Mayor Duane Schreimann presiding. Prayer was offered by Councilman Bill Byrd, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for roll call: Present: Byrd, Haake, Jackson, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Absent: None A quorum was declared present. PUBLIC HEARINGS Annexation of 1.237 acres along West Boundary of Nuetzler's Early American Subdivision (Bill 96 -142). Keith DeVault, Director of Planning & Code Enforcement, made a presentation explaining the background and location of the proposed voluntary annexation area. Following Mr. DeVault's presentation, there were no statements from anyone in opposition to, or in favor of, the proposed annexation. Mayor Duane Schreimann declared the public hearing concluded. PRESENTATIONS FROM THE GALLERY Mr. Max Fisher, 221 E. Capitol Ave., made a brief presentation regarding Capital Main Street, and introduced Mr. Sam Cook, who made a detailed visual presentation regarding access to the downtown business district. The presentation included recommendations for alleviating some of the traffic and parking problems which impair accessibility to the downtown business district for persons wishing to do business there. Following Mr. Cook's presentation, a motion was made by Councilman Charles Jackson that staff look at these recommendations, and that the issue be placed on an upcoming Public Works Committee meeting agenda; that Council be prepared to discuss it at that time based on staff's analysis, and possibly refer it to some committee if deemed appropriate. Motion was seconded by Councilman Bill Byrd and approved unanimously. Mr. Joe Wilson, 422 Oberman Place, spoke in opposition to Bill 96 -121. Mr. Wilson stated he raises dogs, and made suggestions to persons having numerous animals for ways to prevent the animals from being "nuisances." REGULAR COUNCIL MEETING FEBRUARY 3, 1997 Ms. Kay Toft, 2510 Landwehr Drive, made a presentation on behalf of the Jefferson City Parks and Recreation Commission, reiterating the Commission's request that the Council close rather than vacate the alley specified in pending Bill 96 -136. CONSENT AGENDA The following items were brought before the Council on the Consent Agenda: a. Minutes of January 21, 1997, City Council Meeting A motion was made by Councilman Charles Jackson to approve the Consent Agenda as presented, seconded by Councilman Bill Byrd and approved unanimously. BIDS OVER $25,000 Bid 1654 - Signal Equipment, Police Department. A motion was made by Councilman Carl Jaynes to approve Bid 1654, seconded by Councilman Charles Jackson and approved unanimously. MINUTES AND REPORTS RECEIVED AND FILED Mayor Duane Schreimann stated that the following minutes /reports have been received and are on file in the City Clerk's office: Public Works & Planning Committee, 1/23/97; Heinrichs Estate Annual Report; Solid Waste Committee, 11/12/96. ANNOUNCEMENTS BY MAYOR There were no announcements by the Mayor at this time. MAYORAL APPOINTMENTS Police Personnel Board - Jim Goldammer. A motion was made by Councilman Rick Nilges to approve the appointment, seconded by Councilman Randy Kammerdiener and approved unanimously. BILLS INTRODUCED REGULAR COUNCIL MEETING FEBRUARY 3, 1997 Bill 96 -140, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH EVERREADY TOWING & RECOVERY, INC. FOR TOWING OF ABANDONED VEHICLES. Bill 96 -141, sponsored by Councilman Landwehr, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING SECTION 1 -17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. Bill 96 -138 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12580: Aye: Nay: RESOLUTIONS Byrd, Haake, Jackson, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent None RS96 -23 — Protest to County Planning Committee (Jaynes) Councilman Carl Jaynes requested that Resolution RS96 -23 be withdrawn due to the fact that Council felt the developers had satisfactorily answered all of Council's concerns regarding the proposed development. INFORMAL CALENDAR REGULAR COUNCIL MEETING FEBRUARY 3, 1997 Bill 96 -121, sponsored by Councilmen Landwehr and Byrd, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 5 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI BY ENACTING A NEW SECTION TO BE KNOWN AS SECTION 5 -24 RELATING TO THE NUMBER OF ANIMALS PERMITTED AT A RESIDENCE WITHIN THE CITY. Councilman John Landwehr requested that Bill 96 -121 be removed from the Informal Calendar for consideration, and moved that a substitute bill, with a further minor grammatical correction to Section 5 -72, be accepted in lieu of the bill currently pending before the Council, motion was seconded by Councilman Carl Jaynes and approved unanimously. Following a lengthy discussion, Councilman Larry Vincent moved to call for the question, seconded by Councilman Steve Nelson, and motion was defeated by the following roll -call vote: Aye: Byrd, Jackson, Jaynes, Nelson and Vincent Nay: Haake, Kammerdiener, Landwehr, McDowell and Nilges Following further discussion, Bill 96 -121 was placed on final passage and passed by the following vote as Ordinance 12581: Aye: Nay: Byrd, Jackson, Jaynes, Landwehr, Nelson, Nilges and Vincent Haake, Kammerdiener and McDowell COUNCIL LIAISON REPORTS Councilman Larry Vincent announced that a meeting will be held at 7:00 PM on February 6 to discuss the possibility of a new golf course in Jefferson City. UNFINISHED BUSINESS Councilman Charles Jackson announced that he would try to find a date for the new committee of the whole which has been formed to consider development ordinances, and that he would be in contact with Council members to discuss a date for its initial meeting. NEW BUSINESS There was no new business to come before the Council at this time. EXECUTIVE SESSION Councilman Randy Kammerdiener moved that the Council go into Executive Session at this REGULAR COUNCIL MEETING FEBRUARY 3, 1997 time for the purpose of discussing real estate, personnel, and litigation.
