HomeMy Public PortalAboutM 1971-05-18 - CC~i~~T REGULAR MEETING MAY 18, 1971 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road, on above date at 7:30 p.m. Mayor Liewer in the chair. Councilmen Byork, Green, Liewer, Siokos, Stevens answered the roll call. It was moved by Councilman Stevens, seconded by Council- man Byork, and carried, that the minutes of the May ~+, 1971, meeting be approved as written. RESOLUTION N0. 71-33 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR," was presented. It was moved by Councilman Stevens, seconded by Council- man Green, that said resolution be adopted. Roll Call: Ayes: Councilmen Byork, Green, Liewer, Siokos, Stevens. Noes: None. Absent: None. PUBLIC HEARINGS The hour of 7:30 p.m. having arrived, said hour being the time fixed for public hearing on the proposed vacation of that portion of Beechwood Avenue beginning at the east curb line of State Street and extending easterly to the northerly prolongation of the westerly curb line of Apricot Street, and that portion of Grape Street from the southerly prolongation of Beechwood Avenue southerly 270 plus or minus feet, the Mayor asked the City Manager for information concerning the subject hearing. The City Manager informed the Council that notice of public hearing has been posted as required, and no protests or objections have-been received. He presented a report reviewing previous action of the Council at the April 20, 1971, meeting in setting a public hearing on the proposed vacation as requested by Lynwood Development Corporation, and presented a map of the area delineating the portions of streets proposed to be vacated. If it is the Council's determination to order the vacation, a resolution has been prepared by the City Attorney which contains the specific conditions that the city retains all existing utility easements in the portions of streets to be vacated and that final vacation is subject to successful close of escrow on all properties facing upon the street system. Additionally, the City Attorney has recommended that the Council require a separate contractual agreement wiht the firm acquiring the .vacated street easements to facilitate recovery of the streets by the city in the event the proposed construction project has not been completed as planned within a prescribed period of time . The Mayor inquired if there were any present wishing to speak either for or against the proposed vacation. As there was no response, the Mayor declared the hearing closed. Res. 71-33 Demands Public Hearing - Vacation of portions of Grape St. & Beechwood ~~ Res. 71-34 RESOLUTION N0. 71-34 entitled: "RESOLUTION OF ORDER Ordering OF VACATION BY CITY COUNCIL OF THE CITY OF LYNWOOD vacation of OF PORTIONS OF STREETS DESCRIBED THEREIN," was portions of presented. It was moved by Councilman Siokos, Grape and seconded by Councilman Byork, and carried, that Beechwood further reading be waived. It was moved by Councilman Siokos, seconded by Councilman Green, that said resolution be adopted. Mr. Edward Pacheco addressed the Council to inquire when the streets would be closed and was informed they would not be closed until the close of all escrows. Roll Call: Ayes: Councilmen Byork, Green, Liewer, Siokos, Stevens. Noes: None. Absent: None. Mr. Bill Lomas, president of the Lynwood Optimist Club, presented the Council with bumper stickers and extended ar! invitation to be present at a June 2nd luncheon in connection with their "Respect for Law" observance. Mr. Earl Horsager, 11452 Hulme Avenue, was recognized by Mayor Liewer, who read a proclamation concerning VFW "Buddy Poppies" days. Mayor Liewer also proclaimed the week of May 16 to 22 as "National Insurance Women's Week" and the date of June 6, 1971, as "Hope Sunday." ORDINANCES AND RESOLUTIONS Ord. 890 ORDINANCE N0. 890 entitled: "AN ORDINANCE OF THE Regulating CITY OF LYNWOOD REGULATING. A PRIVATE PATROL OPERATOR private patrol AND AN OPERATOR OF A PRIVATE PATROL SERVICE, WITHIN licensees THE MEANING AND CONTEXT OF SECTION 7514 OF THE BUSINESS AND PROFESSIONS CODE TO REQUIRE REGISTRATION OF STATE LICENSE NUMBERS, TO REQUIRE PUBLIC LIABILITY INSURANCE, TO REQUIRE CERTAIN IDENTIFYING SIGNS ON VEHICLES, STANDARD COLORED UNIFORMS, SHOULDER PATCHES, BADGES AND INSIGNIA THEREON," was presented for second reading. It was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that further reading be waived. At the request of the Mayor, the City Attorney explained the provisions of the ordinance and said that it can be adopted as the State legislature has enacted laws delegating to the cities the power to regulate private patrol operators. Mr. Archie Legg, 3617 Platt Avenue, addressed the Council in opposition to the requirement that identifying signs on the patrol vehicles be lettered in not less than 1-1/2 inches in size. It was moved by Councilman Green, seconded by Councilman Stevens, that said ordinance be adopted as read for the second time, finally passed and be published as required by law, Roll Call: j~~ Ayes: Councilmen Byork, Green, Liewer, Siokos, Stevens. Noes: None. Absent: None. REPORTS AND REQUESTS The application of Richard J. and Rose M. Crawford Dance License for a dance permit at 10327-2g Long Beach Boulevard approved - ,,_.T was presented. The application was accompanied by 10327-2g Long ', an approved occupancy permit and the police department Beach Blvd. investigative report which indicated no reason why ` the permit should not be granted. It was moved by Councilman Byork, seconded by Councilman Green, that said dance permit be granted. Roll Call: Ayes: Councilmen Byork, Green, Liewer, Siokos, Stevens. Noes: None. Absent: None. The application of Paul Locklear, 12107 Piuma Avenue, Secondhand Norwalk; for a special permit 'to conduct a secondhand Store license store selling new and used furniture at 1Og07 approved Atlantic Avenue was presented. The Council was 10907 Atlantic informed that the occupancy permit has been approved by the Fire and Building Departments and the Police Department investigative report indicates no reason why a special permit and license should not be issued. It was moved by Councilman Byork, seconded by Councilman Stevens, that the application of Paul Locklear for a secondhand store selling new and used furniture at 10907 Atlantic Avenue be granted. A reugest from the Board of Supervisors that the Council City Council express opposition to Assembly Bill expresses 1708 which concerns allocation of State Gas Tax opposition to funds, was presented. It was moved by Council- AB 1709 man Siokos, seconded by Councilman Green, and carried, that the Council oppose the passage of Assembly Bill 1709 and that the Mayor and City Manager express this opposition to the City's State legislators and that the Board of Supervisors be informed of the Council's action. A request from Phil Thatcher, president, of Request from Shepherd Foundation, Inc. for exemption from the Phil Thatcher license fees for carrying on the foundation tabled business at 11457 Long Beach Boulevard was presented. Activities of the foundation include various types of assistance to prisoners and former prisoners. It was moved by Councilman Siokos, seconded by Councilman Byork, and carried, that the request be tabled until Mr. Thatcher is able to come before the Council to provide more information about the services provided by the foundation, and that the Chief of Police be requested to investigate and report on the sub,~ect request. Council was informed that the interim ordinances Extension of concerning relocation of structures in residential interim ords.- zones will soon expire and if it is Council's hearing set ~'7 U Hearing set for desire to extend the ordinances pending preparation June 1, 1971 of new relocation requirements, it will be necessary to set a date for public hearing on extension of the interim ordinances. It was suggested that the hearing be set for June 1, 1971. It was moved by Councilman Siokos, seconded by Councilman Byork, and carried, that a public hearing be set for June 1, 1971, on the proposed extension of Ordinances Nos. 887 and 889. Councilman Green suggested that the hearing be well publicized in the local press in order that all property owners affected by the freeway relocation will be aware of the hearing. Report on The City Manager reported that an audit of the Chamber budget City-Chamber budget indicates there was an over over-expenditureexpenditure of $147.11 in the Christmas Parade account. As an alternative to requesting Council approval of the over-expenditure, the Chamber has suggested that under expenditures totalling $142.93 in the Candy Cane and Los Angeles County Fair accounts be applied to the over-expenditure. It was moved by Councilman Siokos, seconded by Councilman Stevens, that authorization be granted to apply the under- expended accounts totalling $142.93 to the over-expended Christmas Parade account. Douglas The Manager presented the request of Douglas Mendoza granted Mendoza, Utility Maintenance Man, Water Department, 60 day leave for a 60 day leave of absence without pay beginning of absence June 4, 1971. Mr. Mendoza was recently inured in an accident and since he has exhausted the accrued sick leave and vacation benefits, the leave is necessary to maintain his employment status during the requested 60 day period. The report stated that the City Manager is'~ joined by the Water Superintendent in recommending Council approval of the request. It was moved by Councilman Stevens, seconded by Councilman Green, and carried, that the request be granted. Report on P.C. The Manager reported that at its meeting of actions of May 11, 1971, the Planning Commission took the 5/11/71 following actions: 1. Approved the home occupation application of R. W. Smoke, 3170 Euclid Avenue, for a permit to conduct a pet security service from his residence. 2. Denied the request of Miriam Cobian, 3354-A Norton Avenue and Maria Gener, 3354-B Norton Avenue for home occupation permits to conduct sewing businesses at their separate residences. 3. Studied appropriate standards for control of relocation permits and concurred in the recommendation that the initial moratorium on relocation permits be extended to allow additional time for development of a suitable ordinance. ORAL COMMUNICATIONS Mr. Richard Bowen, 11469 Copeland, and Mr. Norman Wasserman, of the Chamber of Commerce, addressed the Council concerning a previous request for erection of billboards at or near the City Hall and near the Long Beach Freeway calling attention to the city's 50th anniversary. Drawings of the proposed signs were displayed for the Council's consideration. The cost of the signs as proposed would be an estimated $350 each for material, with the work to be done by city forces and the sign printing to be furnished by an outdoor advertising company. The proposed signboards were discussed informally, with various alternatives being suggested, such as use of the Mobilelease sign, once used by the city, a sign on Western Gear property, overhead banners at Long Beach and Mulford and at Century and Bullis Road. It was concluded that Chamber representatives would investigate the Western Gear and Mobilease possibilities and report to the City Manager. Mr. R. V. Hansen, 3333 Fernwood Avenue, informed the Council that Television Channel 13 has a daily program, called "Dial for Dollars" which will give free advertising for special events such as the city's anniversary celebration. Mr. Hansen also asked if the proposed Montgomery Ward development would have any affect on viaducting of the freeway, and he was told it would have no affect, so far as is known. Dr. Verner Waite, 3121 Los Flores Boulevard, addressed the Council concerning the County Branch Library and its cost to the taxpayers of Lynwood. His investigation covered the revenue and expenditures for the local branch, as well as the Downey library system which is owned and operated by 'the City of Downey. It was Dr. Waite's opinion that the present library facilities available to the citizens of Lynwood, and especially with respect to the students, are inadequate both in space and content, and in need of expansion. He filed with the Clerk the documents resulting from his lengthy investigation. Dr. Waite was assured that the Council is interested in upgrading of the library, and that Councilman Green, the city's library advisory group, would seek some answers to the questions raised. Councilman Green inquired of the Building official the status of a large number of houses recently moved into the city. He was informed that if the owner does not complete them in a very short time, they will be removed. Councilman Stevens described the progress being made by the newly formed organization termed "LINDA" and stated that open house would be held on June 5 for the young people and on June 6 for adults. Discussion re billboards and signs advertising anniversary celebration Discussion concerning the operation of the County branch library Operation "LINDA" report Councilman Siokos asked that advertising signs placed on the sidewalk on the north side of Imperial 17~ near Alexander Street be investigated. Mayor Liewer asked about the progress of the house numbering, and the City Manager informed him that there is presently one group licensed to do such number painting.
