CALL TO ORDER
The Regular Council Meeting was called to order on February 17, 1997, 7:30 P.M. with
Mayor Duane Schreimann presiding.
Prayer was offered by Councilman Carl Jaynes, followed by the Pledge of Allegiance.
ROLL CALL
The following Council Members were present for roll call:
Present: Byrd, Haake, Jackson, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson,
Nilges and Vincent
Absent: None
A quorum was declared present.
PRESENTATIONS FROM THE GALLERY
City Counselor Allen Garner was asked by Mayor Duane Schreimann to give a brief history
of the issue of contract for towing (Bill 96 -140).
Mr. Mike Kever, 4319 Tanner Bridge Road, current owner of Broadway Shell, made a
presentation regarding Bill 96 -140, contract for towing. Mr. Kever stated it was his
understanding the City's contract for towing with his company was still in effect.
Mr. Jerry Venters, 325 Jefferson Street, representing Everready Towing, made a
presentation encouraging the passage of Bill 96 -140, contract for towing, based on the
recent bidding of the contract.
CONSENT AGENDA
The following items were brought before the Council on the Consent Agenda:
a. Minutes of February 3, 1997, City Council Meeting
b. Authorizing Amendment to 911 Agreement
c. Bid 1668 - Snow Removal Equipment with Operator, Public Works Dept.
d. RENEWAL of Bid 1506 (final) - Cemetery Maintenance Agreement, Planning
& Code Enforcement Dept.
A motion was made by Councilman Bill Byrd to approve the Consent Agenda as presented,
seconded by Councilman Carl Jaynes and approved unanimously.

MINUTES AND REPORTS RECEIVED AND FILED
Mayor Duane Schreimann stated that the following minutes /reports have been received
and are on file in the City Clerk's office:
Finance Reports for November & December, 1996; Board of Adjustment, 1/14/97; Parks &
Recreation Meetings - Commission Meeting, 1/13/97, Long Range Planning Committee,
1/14/97, Activities Committee, 1/30/97, Activities Committee Special Work Session, 2/6/97;
Board of Electrical Examiners & Review, 12/13/96
ANNOUNCEMENTS BY MAYOR
Mayor Duane Schreimann announced that he had received information from the Missouri
Municipal League requesting that cities write the Legislature to take an official position in
opposition to HB 282. The House Bill in question would require cities to allow a formal
administrative hearing process utilizing police officers in any disciplinary process. Mayor
Schreimann stated the City of Jefferson has had a Police Personnel Board established for
such a purpose for many years, and that the passage of this bill would render that board's
participation in disciplinary hearings null and void. He recommended that the City of
Jefferson correspond the City's opposition to HB 282. A motion was made by Councilman
Larry Vincent to accept the mayor's recommendation, seconded by Councilman Bill Byrd
and approved with Councilman John Landwehr abstaining.

Bill 96 -142, sponsored by Councilman Jaynes, entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A MEMORANDUM OF UNDERSTANDING
WITH GTLR DEVELOPMENT CORPORATION AND BIG BEN LLC FOR THE
DEVELOPMENT AND ANNEXATION OF COVINGTON GARDENS SUBDIVISION.
Councilman Carl Jaynes requested that the rules be suspended and Bill 96 -142 placed on
final passage. There were no objections to the request for suspension of the rules. Bill was
then read second and third times by title, placed on final passage, and passed by the
following vote as Ordinance No. 12583:

THE ALLEY BETWEEN HUB AND MANILA STREETS.

TOWING & RECOVERY, INC. FOR TOWING OF ABANDONED VEHICLES.
Following a lengthy discussion, Councilman Rick Nilges requested that Bill 96 -140 be
placed on the Informal Calendar. He requested that the Council receive any and all
information that was available on this issue before they are asked to vote on the bill.

RESOLUTIONS
RS96 -24— Reimbursement of City Expenses for Hwy. 179 Project Expenditures (Nilges)
A motion was made by Councilman Carl Jaynes to adopt RS96 -24, seconded by
Councilman Larry Vincent and approved unanimously.
COUNCIL LIAISON REPORTS
Councilman James Haake announced a Public Works and Planning Committee Meeting will
be held February 20 at 7:30 PM.
UNFINISHED BUSINESS
Councilman John Landwehr commended City staff for its time and effort on the recent issue
of the Covington Gardens Development.
NEW BUSINESS
Councilman James Haake commended Police Chief Tyler Brewer on the way he recently
dealt with the underage drinkers issue. Mayor Duane Schreimann stated that the City as a
whole will not tolerate the issue of providing alcohol to juveniles, and anyone doing so will
be found and prosecuted.
Councilman Carl Jaynes commended Police Chief Tyler Brewer for recently receiving the
Pedestrian Safety Citation Award from American Automobile Association's Community
Traffic Safety Program.
Councilman Carl Jaynes commended the Planning and Code Enforcement Department for
recently receiving the Excellence in Planning Award in the comprehensive planning category
from the Missouri Chapter of the American Planning Association.
EXECUTIVE SESSION
REGULAR COUNCIL MEETING FEBRUARY 17, 1997
Councilman James Haake moved that the Council go into Executive Session at this time
for the purpose of discussing real estate, personnel, and litigation. Motion was seconded
by Councilman Randy Kammerdiener and approved by the following roll -call vote at 8:15
PM:

and Vincent

ACTIONS TAKEN IN EXECUTIVE SESSION
Personnel
City Counselor Annual Performance Appraisal: Mayor Duane Schreimann recommended
a 3% meritorious salary increase for City Counselor Allen Garner. A motion was made by
Councilman Rick Nilges to accept the Mayor's recommendation, seconded by Councilman
Carl Jaynes and approved by the following vote:
Aye: Jackson, Jaynes, Kammerdiener, Landwehr, Nelson and Nilges
Nay: Byrd, Haake and McDowell
Abstain: Vincent
