HomeMy Public PortalAbout19970317REGULAR COUNCIL MEETING MARCH 17, 1997 CALL TO ORDER The Regular Council Meeting was called to order on March 17, 1997, 7:30 P.M. with President Pro Tempore Carolyn McDowell presiding. Prayer was offered by Rev. George Scantlan, Immanuel Baptist Church, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for roll call: Present: Byrd, Haake, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Absent: Jackson A quorum was declared present. PUBLIC HEARINGS Rezoning - 170.84 acres south of Capital City Industrial Park & County Park from RS -1, Single Family Residential to RS -3, Single Family Residential (Pending Bill 96 -148). Keith DeVault, Director of Planning & Code Enforcement, made a presentation regarding the background of the request for rezoning. No one present wished to speak in favor of, or opposition to, the request for rezoning. President Pro Tempore Carolyn McDowell declared the public hearing concluded. PRESENTATIONS FROM THE GALLERY Lt. Col. Robert Kopp, Whiteman AFB, made a presentation, naming Councilman Carolyn McDowell Honorary Commander of Whiteman AFB and presented her with a flag and cap bearing the base insignia. Mr. Donald Malott, 706 Broadway, made a presentation regarding the User's Tax in Jefferson City. He stated his opposition to a user's fee being charged at Parks and Recreation facilities. Following Mr. Malott's presentation, Councilman Rick Nilges explained the difference between a user's tax and a user's fee, and Parks & Recreation Department Director Bill Lockwood invited Mr. Malott to attend the next Parks and Recreation Commission meeting to express his views regarding users' fees. Bid 1674 - Street Marking Paint, Public Works Department A motion was made by Councilman Bill Byrd to approve the Consent Agenda as presented, seconded by Councilman Larry Vincent, and approved unanimously. REGULAR COUNCIL MEETING MARCH 17, 1997 INFORMAL CALENDAR Bill 96 -144, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19- 401 OF THE CODE OF THE CITY OF JEFFERSON PERTAINING TO PASSENGER OR SPECIAL LOADING ZONE ON MILLER STREET. Councilman Carolyn McDowell requested that Bill 96 -144 be removed from the informal Calendar and placed on final passage at this time. Councilman Carolyn McDowell presented a substitute Bill 96 -144. Councilman Bill Byrd moved that the bill distributed by Councilman Carolyn McDowell be accepted as the substitute for the formerly introduced Bill 96 -144, motion was seconded by Councilman Larry Vincent and approved unanimously. Substitute Bill 96 -144 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12595: Aye: Byrd, Haake, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, Nilges and Vincent Nay: None RESOLUTIONS RS96 -27 — Declaring Intent to Annex Land in the Algoa Area (Landwehr). A motion was made by Councilman Carl Jaynes to adopt RS96 -27, seconded by Councilman Steve Nelson and approved unanimously. COUNCIL LIAISON REPORTS Councilman James Haake announced the March 20 Public Works and Planning Committee meeting, and requested that any council member unable to attend please notify Public Works Department. UNFINISHED BUSINESS Councilman Rick Nilges asked questions of Public Works Directory Marty Brose regarding the speed limit on Edgewood Drive. Several Council Members indicated they had been contacted by citizens stating that they felt the speed limit of 30 mph was too slow for that particular street. Councilman Rick Nilges asked Public Works Directory Marty Brose the status of the improvement project for Sunset Lake Road. A discussion followed regarding projects which are scheduled to be given priority. Councilman John Landwehr stated that the presentation recently made to Council regarding suggestions for improved parking in the downtown business district will be brought before REGULAR COUNCIL MEETING MARCH 17, 1997 the Transportation and Traffic Committee at its April 10 meeting. Councilman Carolyn McDowell noted that TCI has announced it will once again be increasing its rates, and asked City Counselor Allen Garner to respond. Mr. Garner stated that any concerns with TCI as our current cable supplier can be an item addressed in the next franchise agreement between the City and TCI. The current franchise agreement expires in 1998, and a new agreement is currently being drafted. Councilman Bill Byrd announced that Jefferson City Police Sergeant Mike Struttman recently made a presentation to his church's congregation and commended Sergeant Struttman for the positive response he had received about the presentation. City Counselor Allen Garner announced that the City had received information about HB 450 pertaining to indemnity clauses which was scheduled to come before the State Legislature in the next few days. Mr. Garner explained the impact that this bill would have on municipalities. Following Mr. Garner's presentation, A motion was made by Councilman Bill Byrd to direct Mayor Duane Schreimann to draft a letter of opposition to the passage of HB 450, seconded by Councilman Steve Nelson and approved unanimously. Councilman Rick Nilges asked City Administrator Rich Mays for an update on the status of the ambulance service in which the city has recently become a participant. Mr. Mays reported that the City has received, on a consistent basis, two calls per day since the program was initiated on March 4. NEW BUSINESS Councilman Carolyn McDowell announced that a sister city meeting would be held at Whiteman AFB on April 3, and encouraged Council Members to attend. Lt. Col. Kopp was asked to introduce other Air Force personnel which were at the meeting with him, to which he complied. Councilman Carolyn McDowell announced that the Mayor and City Council were invited to take a trip on the 103 Flexliner between Jefferson City and Sedalia in the next few weeks, and encouraged them to take advantage of the invitation. EXECUTIVE SESSION Councilman Bill Byrd moved that the Council go into Executive Session at this time for the purpose of discussing real estate, personnel, and litigation. Motion was seconded by Councilman Randy Kammerdiener and approved by the following roll -call vote at 8:15 PM: Aye: Byrd, Haake, Jaynes, Kammerdiener, Landwehr, McDowell, Nelson, and Nilges and Vincent Nay: None ACTIONS TAKEN IN EXECUTIVE SESSION REGULAR COUNCIL MEETING MARCH 17, 1997 Personnel Assistant Fire Chief: Following a brief presentation by City Administrator Rich Mays, A motion was made by Councilman Steve Nelson to accept Mr. Mays' recommendation of Mr. Doug Strope for the position of Assistant Fire Chief at a beginning annual salary of $39,332.00. Motion was seconded by Councilman Bill Byrd and approved unanimously.
