Councilmen Byork, Morris, Rowe, and Stevens answered ••~w the roll call. Councilman Liewer was absent. It was moved by Councilman Byork, seconded by Council- man Stevens, and carried, that Councilman Liewer's absence be excused. The Mayor requested that the meeting be adjourned to executive session for the purpose of discussing possible litigation concerning the 105 freeway. Councilmen Byork, Morris, Rowe, Stevens answered the roll call. Councilman Liewer was absent. It was moved by Councilman Byork, seconded by Council- man Stevens, and carried, that Councilman Liewer's absence be excused. The Mayor presented a letter of resignation from Mr. Ronald Prince. It was moved by Councilman r--* Stevens, seconded by Councilman Byork, and carried, that the letter be received and filed. PUBLIC BUSINESS FROM THE FLOOR Mr. Archie Legg, 3671 Platt Avenue, addressed the Oral Council to clarify statements made at an earlier Communications Council meeting regarding the use of an outside security service for the Chamber of Commerce Fall Festival. He informed the Council that his company, Southeast Merchants Patrol, located in Lynwood, has furnished the security service since the first fall festival and all succeeding years. Mr. Leon Allison, 4054 Platt Avenue, addressed City ad purchasE the Council to request that the City purchase an in high school ad in the high school year book. It was moved by yearbook Cou ncilman Byork, seco nded by Councilman Stevens, and carried, that the City purchase a full page ad in the current high scho ol yearbook. Mrs. Rose Workman, 3849 Lilita, speaking on behalf of her mother who lives at 3843 Virginia Avenue, addressed the Council to request that steps be taken to correct the existing nuisances at 3540 Virginia Avenue, and presented a petition signed by herself and eight others protesting the lack of action. The City Attorney informed the Council of the problems involved in abating the nuisances (U complained of by Mrs. Workman and proposed that an ordinance be submitted for the Council's consideration which would provide for enforcement by the issuance of citations similar to the way in which traffic laws are enforced. Mrs. Workman also complained of the height of the ,~,~,~ fence erected by the property owner at 3540 Virginia. The Mayor suggested that the Council consider the ordinance proposed by the City Attorney and Council- man Stevens asked that the City Manager write to Mrs. Workman to inform her of what the Council will be considering. Mr. Philip Chance, 3726 Cedar Avenue, addressed the Council concerning the trimming of trees on the State property located at the southbound off-ramp from the Long Beach Freeway. He said his efforts to stop the cutting of the trees has been unsuccessful and at the request of the Mayor, the Public Works Director said he would attempt to learn who has jurisdiction over the property and see what can be done to stop the practice of cutting the trees. Mr. Herb Debold, 10366 Long Beach Boulevard, addressed the Council to inform the City Attorney that there are provisions in the State Penal Code which would be applicable to the nuisance abatement problem at 3540 Virginia Avenue. The City Attorney said the problem with the Penal Code provisions is that the District Attorney is the enforcing agent and the City has to depend on the District Attorney's cooperation; however, that approach will be investigated. PUBLIC HEARING Public The Mayor announced the time had arrived for public hearing - hearing to consider objections or protests to the Abatement itemized statement of expense involved in abating Cost report the nuisance at 5507 Cortland Avenue, and asked for 5507 Cortland information concerning said hearing. The City Manager's report on abatement of the nuisance was presented with the recommendation that the Council Res. 72-84 adopt RESOLUTION N0. 72-84 entitled: "RESOLUTION Confirming CONFIRMING THE REPORT OF THE BUILDING OFFICIAL OF THE abatement EXPENSE INCURRED BY THE CITY IN THE DEMOLITION OF cost report BUILDINGS DONE PURSUANT TO SECTION 203 OF THE UNIFORM 5507 Cortland BUILDING CODE 1970 EDITION AND THE UNIFORM HOUSING CODE 1964 EDITION AND ORDERING THE EXPENSE BE ASSESSED AGAINST THE REAL PROPERTY UPON WHICH THE BUILDINGS FORMERLY STOOD, CONFIRMING THE ASSESSMENT, THAT THE SAME TO BE RECORDED AND THE COUNTY TAX ASSESSOR, THE COUNTY TAX COLLECTOR AND THE COUNTY AUDITOR UPON RECEIPT OF NOTICES OF LIEN, TO RECEIVE THE SAME AND TO ADD THE AMOUNT OF THE ASSESSMENT TO THE NEXT REGULAR BILL FOR TAXES LEVIED AGAINST THE LOT OR PARCEL OF LAND THEREIN DESCRIBED AND THE AMOUNT OF THE COUNTY ASSESSMENT UNDER THE LAW IN SUCH CASES MADE AND PROVIDED." 71 The Mayor inquired if anyone present wished to be heard. As there was no response, he declared the hearing closed. It was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that Resolution No. 72-84 be adopted. MANAGEMENT STUDIES AND REPORTS An agreement between the City of Lynwood and the Southern Pacific Transportation Company for lease of additional right of way at Fernwood Avenue and Fir Street and a sublease agreement between the City of Lynwood and the International Church of the Foursquare Gospel for sublease of the additional right of way was presented with the recommendation that the Council approve the two agreements and authorize the Mayor to execute the agreements on behalf of the City. It was moved by Councilman Byork, seconded by Councilman Rowe, and carried, that the Council approve the two agreements. Pursuant to the request of Security Pacific National Bank and Southwest Realty Company for vacation of exterior boundary easements on Lot 121, Tract 2551, the Planning Commission recommended that a public hearing on the proposed relinquishment of easement be established. RESOLUTION N0. 72-85 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO ORDER VACATION OF A CERTAIN EASEMENT," was presented. It was moved by Councilman Rowe, seconded by Councilman Byork, and carried, that Resolution No. 72-85 be adopted. Pursuant to the request of Jesse Lee Taylor and New Brittany, Inc. for vacation of a 4" water easement on portions of Lots 1 and 2, Block A, Tract 10978, the Planning Commission recommended that the City Council set a date for public hearing on the proposed relinquishment of water line ease- ment. RESOLUTION N0. 72-86 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO ORDER VACATION OF A CERTAIN EASE- MENT," was presented. It was moved by Councilman Rowe, seconded by Councilman Stevens, and carried, that Resolution No. 72-86 be adopted. It was moved by Councilman Rowe, seconded by Council- man Stevens, and carried, that the Council concur in the recommendations of the Personnel Board. RESOLUTION N0. 72-88 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 67-9 DESIGNATING CERTAIN INTERSECTIONS AS STOP INTERSECTIONS," was presented. It was moved by Councilman Stevens, seconded by Councilman Byork, and carried, that Resolution No. 72-88 be adopted. It was moved by Councilman Stevens, seconded by Councilman Byork, and carried, that the Council concur in the Manager's recommendation. ORDINANCES Ord. 915 ORDINANCE N0. 915 entitled: "AN ORDINANCE OF THE CITY Amending COUNCIL OF THE CITY OF LYNWOOD ADDING SECTION 20.73A Code re Lics.TO THE CITY CODE OF THE CITY OF LYNWOOD TO ESTABLISH for real LICENSE FEES FOR PERSONS ENGAGED IN THE REAL ESTATE estate bus. PROFESSION," was presented. It was moved by Councilman Rowe, seconded by Councilman Byork, and carried, that said ordinance be read by title only. It was moved by Councilman Rowe, seconded by Council- man Stevens, and carried, that Ordinance No. 915 be adopted. DEMANDS RESOLUTION. Res. 72-87 RESOLUTION N0. 72-87 entitled: "A RESOLUTION OF THE Demands CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR," was presented. It was moved by Councilman Byork, seconded by Councilman Stevens, that Resolution No. 72-87 be adopted. Roll Call: Ayes: Councilmen Byork, Morris, Rowe, Stevens. Noes: None. Absent: Councilman Liewer. l .~ DEPARTMENTAL REPORTS The report on the Federal Revenue sharing program appearing in Information Bulletin No. 72-15 was discussed briefly with particular reference to its affect on the pay increases granted for the 1972-73 fiscal year. It was moved by Council- man Byork, seconded by Councilman Stevens, and carried, that Information Bulletin No. 72-1~j be received and filed. It was moved by Councilman Byork, seconded by Councilman Rowe, and carried, that Citizens' Service Request Log No. 72-14 be received and filed. It was moved by Councilman Stevens, seconded by Councilman Byork, and carried, that Code Enforcement Nuisance Abatement Report No. 72-9 be received and filed. It was moved by Councilman Byork, seconded by Councilman Stevens, and carried, that the report on Planning Commission actions be received and filed. COUNCIL AGENDA Councilman Stevens commented on the excellent job being done by Mr. and Mrs. Pengra in the community garden project at Bullis And Fernwood Avenue and .-, asked that an expression of appreciation be sent to them. Mayor Morris appointed Councilman Byork as voting delegate and Councilman Liewer as alternate delegate for the annual League of California Cities Conference. Departmental Reports A comprehensive report on the status of the 105 Freeway and a meeting of representatives of the affected cities and a subsequent meeting of the City Attorneys of those cities was presented by City Attorney John Murphy. He outlined various alternative actions the Council might take, and recommended that if the Council wishes to pursue the matter further that it join with other cities in a motion to intervene. It was moved by Councilman Byork, seconded by Councilman Stevens, that the Council authorize the retention of the firm of Burke, Williams and Sorensen as special counsel to represent the City of Lynwood through a motion to intervene in the law suit at a cost of not to exceed $1,000.
