Under the authority of the California Porter-CologneWater Quality Act, the State Water Resources Control Board delegated the authority to its regionalboards to invoke permitting requirements upon cities and counties. In 1991, the San Francisco BayRegional Water Quality Control Board (Water Board) notified San Mateo County of the requirements tosubmit a National Pollution Discharge Elimination System (NPDES) permit application by November30, 1992. In order to apply for its permit, San Mateo County in conjunction with all 20 incorporatedcities in San Mateo County prepared a San Mateo Countywide Stormwater Management Plan (Plan).The Plan was approved by the Water Board and made part of the County's 5-year NPDES WasteDischarge Permit CA 0029921. San Mateo County updated and renewed its plan and subsequent 5-yearterm permits in 1993, 1998 and 2003.In 2008, the NPDES permit went through a substantial overhaul and the Water Board decided to issue asingle permit for the entire San Francisco Bay region. The Municipal Regional Permit (MRP) forstormwater was issued by the Water Board in October 2009. The new single permit introduced manydifferent requirements pertaining to stormwater runoff. These requirements include:trash reduction by more frequent street sweepingmandatory treatment measures such as:o rainwater harvesting; ando bio retention measures for construction projects disturbing over 10,000 square feet.Page 1 of 216682800.2 The initial MRP expired in November 2014. In May 2014, six months prior to the expiration of theMRP, San Mateo County submitted a permit application to the Water Board to renew its MRP. ThatMRP was subsequently approved by the Water Board and became effective on November 19, 2015. Thenew MRP also known as MRP 2.0 is effective for five years.There are two NPDES permit stormwater fees that are collected on the San Mateo County Tax Roll.One stormwater fee is collected by the San Mateo County Flood Control District to help fund the costsassociated with the regional San Mateo Countywide Stormwater Program. The other stormwater fee iscollected by the San Mateo County Assessor through property tax roll to fund Millbrae's localstormwater maintenance programs such as: street sweeping, trash load reduction, stormwater facilitiesmaintenance, and canal, creek and inlet cleaning.The Millbrae City Council adopted Ordinance No. 608 on June 28, 1994 which established the MillbraeStormwater Program Fees as follows:Single Family ResidentialLow Density Single Family ResidentialMulti Family ResidentialCommercial and Industrial$ 25.66$ 91.60$ 58.50$223.23These fees totaling approximately $240,000 are collected every year. These fees are typically used bythe City to fund stormwater related maintenance activities such as: cleaning of storm drainage inlets,dredging and repair of canals, and street sweeping. The individual fees charged to the property ownershave remained unchanged since their inception in 1994. When initially enacted in 1994, these fees alsodid not include any annual inflation adjustment. The total amount of the fees has been consistentlyinadequate to cover the costs of the City's stormwater maintenance requirements and activities.Therefore, these programs have been funded by transfers from the City's General Fund. The costs tooperate the storm _systgm will continue to rise, especially with the added requirements of MRP 2.0. In2019 the CityA^nt$i.ll million and in 2020 $3.39 million on storm water improvements andmaintenance. The annual storm water fee collected of $244,000 is significantly less than the annualfunds required to maintain adequate storm water services in the City. In total the storm water masterplan identifies $42 million in needed improvements.FISCAL IMPACT:Millbrae's Stormwater Enterprise Fees collected on the San Mateo County Tax Roll generateapproximately $240,000 in revenues to the City's Stonnwater Enterprise Fund to pay for some of thecosts of municipal stonnwater maintenance activities necessary to comply with the San MateoCountywide NPDES M'unicipal Regional Permit. Adoption of the attached resolution to authorizecollection of Stormwater Fees on the San Mateo County Tax Roll will save administrative time andsimplify collection. The administrative fee charged by the County for collection is minimal.In Fiscal Year 2020, the City collected $244,000 in stormwater fees. In Fiscal Year 2020-2021, the Cityanticipates collecting approximately $244,000 in stormwater fees.COUNCIL ACTION:Adopt a resolution authorizing collection of Fiscal Year 2020-2021 Stonnwater Fees on the San MateoCounty Tax Roll.Page 2 of 216682800.2 CITY OF MILLBRAE, COUNTY OF SAN MATEOSTATE OF CALIFORNIA***RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MILLBRAEAUTHOMZING COLLECTION OF FISCAL YEAR 2020-2021 STORMWATER FEESON THE SAN MATEO COUNTY TAX ROLLWHEREAS, the Environmental Protection Agency, under amendments to the 1987Federal Clean Water Act, imposed regulations that mandate local government control and reducethe amount ofstormwater pollutant runoffinto receiving waters; andWHEREAS, under the authority of California Porter-Cologne Water Quality Act, theState Water Resources Control Board has delegated authority to its regional boards to invokepermitting requirements upon counties and cities; andWHEREAS, the City of Millbrae established the Stormwater Enterprise Fund to generaterevenue to fund the City of Millbrae Stormwater Program; andWHEREAS, the City Council in 1994 adopted a fee schedule, amended the MillbraeMunicipal Code to include Stormwater Fees, and authorized the San Mateo County Tax Assessorto include and collect the Stormwater Fees previously established and currently in place for theMillbrae Stormwater Program on the County Tax Rolls; the fees are as follows:Single Family ResidentialLow Density Single Family ResidentialMulti Family ResidentialCommercial and Industrial$ 25.66$ 91.60$ 58.50$223.23WHEREAS, each year the City Council is required to request the County Tax Assessorto include and collect the referenced fees with the County Tax Rolls and by this resolution, theCity Council submits this request for Fiscal Year 2020-21.NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THECITY OF MILLBRAE THAT:1. The City of Millbrae respectfully requests that all properties within the territoriallimits of said City be charged the Fiscal Year 2020-2021 Millbrae StormwaterFees in accordance with said charges stated above; and16682803.2 2.
