HomeMy Public PortalAboutM 1973-09-25 - CC3~7 ADJOURNED REGULAR MEETING SEPTEMBER 25, 1973 The City Council of the City of Lynwood met in an adjourned regular session in the City Hall, 11330 ,,.,,,,, Bullis Road, on above date at 4:30 p.m. Mayor Byork in the chair. Councilmen Byork, Liewer, Malchow, Morris, Rowe answered the roll call. City Manager Wright and City Attorney Cayer were also present. As directed by the City Council at the September 18, 1873, meeting the Manager presented ORDINANCE N0. 954 entitled: "AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE N0. 570 (ZONING ORDINANCE) OF THE CITY OF LYNWOOD PROHIBITING ALL CONSTRUCTION WITHIN THE NORWALK I-105 FREEWAY CORRIDOR." The Council was informed that an initial interim ordinance relating to zoning is limited by Government Code requirements to 120 days, not the 180 days suggested at the previous meeting. It was moved by Council- man Morris, seconded by Councilman Liewer, and carried, that the ordinance be read by title only. It was moved by Councilman Morris, seconded by Councilman Liewer, that Ordinance No. 954 be adopted. .~-.,, Ro 11 C a 11: ord. 954 Amending Ord. 570 re freeway corridor Ayes: Councilmen Byork, Liewer, Malchow, Morris, Rowe. ORDINANCE N0. 955 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SUB- SECTION (g) OF SECTION 30-21 AND ADDING SUBSECTION (g) OF SECTION 30-21 AND ADDING SUBSECTION (e) OF SECTION 30-22 TO THE CODE OF THE CITY OF LYNWOOD RELATING TO SALES AND USE TAX," was presented for second reading. It was moved by Councilman Liewer, seconded by Councilman Malchow, and carried, that the ordinance be read by title only. Ord. 955 Amending Code re sales tax It was moved by Councilman Liewer, seconded by '? Councilman Rowe, that Ordinance No. 955 be adopted. Absent; None. ~, RESOLUTION N0. 73-86 entitled: "A RESOLUTION OF THE Res. 73-86 CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE re sales tax EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF LYNWOOD agreement '""" AND THE STATE BOARD OF EQUALIZATION FOR THE PERFORMANCE BY SAID BOARD OF ALL FUNCTIONS INCIDENT TO THE ADMINISTRATION, OPERATION, AND COLLECTION OF THE UNIFORM LOCAL SALES AND USE TAX LAW," was presented by the~City Manager. It was moved by Councilman 3U~ Liewer, seconded by Councilman Morris, that Resolution No. 73-86 be adopted. Roll Call: Ayes: Councilmen Byork, Liewer, Malchow, Morris, Rowe. Noes: None. Absent: None. ':(Hearing set - Pursuant to an appeal of a Planning Commission decision zone determinationfiled by Mr. Otto Klemm, it was moved by Councilman 0. Klemm Morris, seconded by Councilman Liewer, and carried, 10/16/73 that a public hearing be set for October 16, 1973, at 7:30 p.m., on a request for zone determination on Lot 766, Tract 3078. Application for The Manager presented a Preliminary Grant Application planning assist.. for planning assistance for an Interstate 105 Freeway re 105 freeway Impact Analysis, with the recommendation that the impact approved Council authorize that it be submitted to the Council on Intergovernmental Relations Office of Intergovernmental Management for consideration. The need for action on the matter at this time was questioned by Councilman Malchow, who wished more time to study the proposal. The Council was informed that the application, to be considered, must be submitted prior to October 1, 1973• It was moved by Councilman Morris, seconded by Councilman Liewer, that the Council authorize the filing of the application. Roll Call: Ayes: Councilmen Byork, Liewer, Morris, Rowe. Noes: None. Absent: None. Abstain: Councilman Malchow. Cub Pack candy It was moved by Councilman Liewer, seconded by Council- sale 9/25 to man Morris, and carried, that the request of Cub 11/1/73 Scout Pack 437-C of Roosevelt School, for permission to conduct a candy sale from September 25 to November 1, 1973, be granted. The City Manager was asked to report to the Council on reporting requirements contained in the City- Chamber agreement. Edith Mitchell Mayor Byork read a letter from Mrs. Edith Mitchell appt. to real offering her services as a member of the Real Estate estate .commission Practices Commission, and placed her name in nomination for the unexpired term resulting from the resignation of Mr. Larry Pope. As there were no further nominations, the Mayor asked for a vote on the appointment of Mrs. Mitchell Roll Call: Ayes: Councilmen Byork, Liewer, Malchow, Morris, Rowe. Noes: None. Absent: None. It was moved by Councilman Liewer, seconded by Council- man Malchow, and carried, that the meeting be adjourned to executive session to discuss matters of litigation. ~Q J- 1 The Mayor excused the City Clerk from the remainder of the meeting and appointed Councilman LIewer City Clerk pro tempore.
