The meeting is recorded, and the audio files are public record. CALL TO ORDER: Mayor Dicker Cahill called the meeting to order at 7:00 PM. PRESENT: Mayor: Dicker Cahill Councilmembers: Carl Scandella Bruce Jones Tim Dillon - Excused Roger Myklebust Andy Valaas Staff: Anastasiya Warhol — Town Clerk -Treasurer Mona Green — Town Planner Guests: Lowell Press — Kirkland Resident Leslie Feller — Yarrow Point Resident Jill Follett — Kirkland Resident Brad Porter — Yarrow Point Resident Steve Bush - Yarrow Point Resident Tom Bailey — Kirkland Resident APPEARANCES: Lowell Press, representing Kirkland residents wishing to be annexed into Yarrow Point, presented a memorandum noting that the group will begin a fiscal impact study as recommended by Council. The 16 Kirkland houses will be working with Henderson, Young & Company. The study will be conducted at the sole expense of the 16 Kirkland petitioners. Mayor Cahill thanked the representative for moving forward with a study and reminded the petitioners that this is more than an economic decision. Leslie Feller, a Yarrow Point resident and wife of Planning Commission Chair David Feller, spoke in support of the Kirkland annexation. The petitioning residents have been December 10, 2013 Council Meeting deeply involved in mutual school functions, community events, and everyday life, she said. Jill Follet, a Kirkland resident, reiterated her desire to be part of the community. She explained that Yarrow Point has a history of being inclusive, which has been beneficial. Brad Porter, a Yarrow Point resident, spoke in opposition to the annexation. He explained to the council that residents along Points Drive have experienced the reality of having no barrier. Because of this negative experience, the Yarrow Point Points Drive residents are strongly opposed to this. Mr. Porter encouraged The Council and Mayor Cahill to find a way to stop this divisive debate, not prolong it. Steve Bush, a Yarrow Point resident, expressed disappointment over the lack of collaboration from Kirkland residents. Because this has a potential to be very divisive, it is important to have Yarrow Point residents participate in the process. Tom Bailey, a Kirkland resident, responded to remarks explaining that Kirkland residents have attempted continuous communication with Yarrow residents and welcome ongoing dialogue. MINUTES: MOTION: Councilmember Jones moved to approve the Regular Meeting minutes of November 12, 2013 as amended (scrivener's error). Councilmember Valaas seconded the motion. VOTE: 4 For, 0 Against, 0 Abstain. Motion carried CONSENT CALENDAR: MOTION: Councilmember Myklebust moved to approve the consent calendar as presented including the Payment of checks 2805 through 2890, for payments as described in the Payment Approval Report dated 12/09/2013 as shown totaling $40,787.47. Councilmember Jones seconded the motion. VOTE: 4 For, 0 Against, 0 Abstain. Motion Carried. STAFF REPORTS: Lieutenant Kyle Kolling reported on a DUI and a Hit and Run in Yarrow Point. The Hit and Run is still being investigated. The Town is officially three weeks away from having no 2013 burglaries. As a final note, Lieutenant explained that residents should be aware that there are thieves who are following Fedex or UPS trucks to steal packages from doorsteps. Planner Mona Green reported that the Town has received a notification from the Department of Commerce awarding the Town a grant to be applied towards work on the December 10, 2013 Council Meeting 2 Comprehensive Plan (CP). The Planning Commission will begin work on the CP in January of 2014. In the meantime, Ms. Green will be meeting with the assigned Planner to tour Yarrow Point. Regarding the Shoreline Master Plan, Ms. Green explained that the Town received comments from the Department of Ecology (DOE). The Town is waiting to see what type of response other cities are getting when challenging DOE on similar issues. REGULAR BUSINESS: AB 13-34 Council/Commission/Board Vacancies Mayor Cahill outlined the current vacancies on the Council, Planning Commission and Park Board. He explained that this is also Councilman Roger Myklebust's final meeting, he has finished his term. Mayor Cahill mentioned that that he is grateful for Roger's work on the Council. Councilmember Scandella agreed and commended Roger's leadership skills and his legal expertise. Regarding the Planning Commission, Mayor Cahill explained that he has interviewed Carl Hellings and is recommending that the Council confirm his appointment to the Planning Commission. MOTION: Councilmember Myklebust moved to confirm Carl Hellings to the Planning Commission Position No. 4. Councilmember Jones seconded the motion. VOTE: 4 For, 0 Against, 0 Abstain. Motion Carried. The Mayor requested that anyone interested in serving on the Council, Board, or Commission should submit a letter of interest to himself or the Town Clerk. AB 13-36 Peddlers' Permits, Ordinance No. 650, First Reading Town Attorney Wayne Stewart explained that the ordinance was drafted in response to residents who requested that solicitors be limited to solicit "until dusk". Because of constitutional rights of individuals to solicit freely, there are limited restrictions that the Town can impose. One approach is to require solicitors to obtain a permit prior to soliciting. While this may set certain limits, "at dusk" is not a viable option. Mayor Cahill has spoken with the Clyde Hill Police Department; they have agreed to undertake the permitting processing and issuance. An Interlocal Agreement for services will need to be drafted if this ordinance will move forward. Two specific residents requested that peddling be limited to "at dusk" hours. Council concluded that the solicitors' ordinance would not solve the issue. Upon questioning by Council, Attorney Stewart explained that this ordinance will not be able to keep solicitors out of Yarrow Point. Mr. Stewart advised that concerned residents place a "No Trespassing" or "No Soliciting" sign on their property, this will allow the Clyde Hill Police Department to respond to a criminal trespass.
