It was moved by Council.rnan Byork, seconded by Councilman. Green., and carried, that the r;rocl.amat:ion be authorized. Mayor Liewer read a proclamation.. designating the month of May, 1974, as Correct Posture Month. It was moored by Counci.l.man Byork, seconded by Councilman. Morris, and carried, than the proclamation be authorized. It was moved by Councilman. Byork, seconded by Councilman Green, that the City Attorney be asked to retire at the end of this meeting. Councilman Morris spoke in. opposition, stating that he has had no indication from other Co~zncilmen of any ineffi.ci.ency; department; heads have indicated full. cooperation from the City Attorney; that it has been a situation of less cost for better service; that the desirability of other c..ty personnel. being Lynwood residents has been. expressed and the law firm is a local one readily accessible to the Council and staff. Councilman Rowe referred to a .Letter dated April 29, 1974, from the firm of Rutan anal Tucker° to Mayor Liewer containing a proposal for legal services to the City, a copy of which he had received on May 7, and took exception to the firm submitting a proposal while the firm of Cayer & ~Tohnson was still City Attorney in good standing. After reading the proposal submitted by Rutan & Tucker, Councilman Rowe expressed the view that the action proposed was premeditated and, with the permission of° Mr. W1kFrt Malchow, played a. tape recording made by Mr. ilch.ow in which he described a series of con.ver;atons at which he was present during the time hF= was a member of the Council in which he stated boy Councilman r3york and Councilmen Liewer discussed xe~` .i1.rln(~ the fir°m of Rutan & Tucker aga.i.n. The City Manager recommended that the acquisition of Lot 317 and the south 15 feet of Lot 318, Tract 2551.., for the widening of Long Beach Boulevard be authorized by adoption of RESOLUTION N0. 74-33 entitled "A RESOLU~hION OF THE CITY COUNCIL OF THE CTTY OF LYNWOOD AUTHORIZING PURCHASE OF THE PROPERTY NECESSARY FOR THE WIDENING AND IMPROVING OF LONG BEACH BOULEVARD," It was moved by Councilman Liewer, seconded by Councilman Byork, that Resolution No. 74-33 be adopted. Upon recommendation of the City Manager that the Res. 74-34' Council. approve an application for an extension of Request for Gen'1 time to complete certain general plan elements, Plan element time it was moved by Councilman Green, seconded by extension Councilman Morris, and carried, that the Council adopt RESOLUTION N0. 74-34 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REQUESTING THE COUNCIL ON INTERGOVERNMENTAL RELATIONS TO GRANT A TIME EXTENSION FOR THE ADOPTION OF CERTAIN GENERAL PLAN ELEMENTS." Air conditioning A report on the Ci.ty's air conditioning maintenance contract approv. contract was presented by the City Manager with. the recommendation. that the Council approve an agreement between the City and Lynwood Refrigeration for the maintenance of the heating and air conditioning equipment. ~*a i t~t~ It was moved by Councilman Byork, seconded by Councilman Morris, that Council concur in the Manager's recommendation. Absent: None. +""; A request for nuisance abatement hearing on property at 3215 El Segundo Boulevard was presented by the City Manager with the recommendation that the Council adopt RESOLUTION N0. 74-35 entitled: "A RESOLUTION OF THE CITY,COUNCIL OF THE CITY OF LYNWOOD DIRECTING THE OWNER OF THE BUILDINGS AT 3215 EL SEGUNDO BOULEVARD TO APPEAR BEFORE THE CITY COUNCIL TO SHOW CAUSE WHY SUCH BUILDINGS SHOULD NOT BE CONDEMNED AS A PUBLIC NUISANCE AND SAID NUISANCE ABATED, AND PRESCRIBING THE FORM OF SAID NOTICE." It was moved by Councilman Green, seconded by Councilman Morris, and carried, that Resolution No. 74-35 be adopted. RESOLUTION N0. 74-36 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING RULES AND REGULATIONS RELATING TO THE INSTALLATION, MAINTENANCE AND OPERATION OF THE SILENT ALARM BOARD AT THE LYNWOOD POLICE DEPARTMENT BUILDING," establishing procedures for the silent alarm board installed in the Police Department by the Security Pacific Bank, was presented. It was moved by Councilman Byork, seconded by Councilman Morris, that the Resolution be adopted. Mr. W. R. Legg, 45284 N. Avenue 207, Lancaster, addressed the Council to discuss the fees to be charged for service connections. Mr. Legg was informed that he would receive information as to hook-up fees and monthly charges. All members of the Council voting aye, the Mayor declared the motion carried. ORDINANCES ORDINANCE N0. 966 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REPEALING SECTION 28-6 AND ADDING SECTION 28-7 TO THE CITY CODE OF THE CITY OF LYNWOOD RELATING TO NEWSRACKS," was presented for second reading. It was moved by Councilman Byork, seconded by Councilman Green, and carried, that the ordinance be read by title only. FINANCE 'DEPORT Res. 74=37 RESOLUTION N0. 74-37 entitled: "A RESOLUTION OF THE Demands CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR," was presented. Councilman Rowe called attention to the warrant for $586,000 of Highways through Cities funds which will have the effect of overdrawing the fund pending receipt of additional funding from the County of Los Angeles. The City Manager requested that a warrant payable to E & M Amusements in the amount of $75 be added to the warrant register. It was moved by Councilman Green, seconded by Council- man Morris, that Resolution No. 74-37 be adopted. Councilman Byork requested clarification of the Police Department overtime report and the matter was discussed with the City Manager and Chief of Police. Thompson addressed the Council concerning reports lighting on Abbott Road and asked that the City Council approach the City of South Gate regarding lighting of the South Gate side of Abbott Road to the same standards as the south side of Abbott Road. In discussing various items appearing on the Information Bulletin No. 74-9 the Mayor commented on commending the life saving efforts of employees of the Natatorium in a recent pool incident. Relative to the letter clarifying the terms of office of members of the Southeast Mosquito Abatement District Board, Councilman Byork suggested that the Lynwood member of the board should resign when the Council reorganizes and the incoming Mayor appoint a representative. Councilman Byork was informed that the terms of the members are statutory two year terms and the current term will expire in January 1975. It was moved by Councilman Byork, seconded by Council- man Green, that a resolution reaffirming the city's position on the I-105 freeway, similar to the action taken by the City of Inglewood, be adopted. t~ It was pointed out that the Council has previously adopted such a resolution and the motion was with- drawn by Councilmen Green and Byork. Councilman Morris questioned the meeting scheduled with Supervisor Hahn on May 8 and the late date on which he learned of the meeting. After a brief discussion, the City Manager said that he had discussed the matter with Councilman Morris and Rowe, and that in the future his office will attempt to provide more information to all Councilmen so similar incidents will not occur. PUBLIC BUSINESS Mrs. Thelma Higgins addressed the Council to express her oonaern about the Counoil's option to dismiss as City Attorney a looal firm and retain a law firm looatbd outside the City when it has been said that young people should be enoouraged to stay and work in Lynwood. Mrs. Higgins oommented on the oonoern earlier in the meeting about police salaries and subsequent approval of a large expenditure. Mrs. Higgins ooz~gratulated the Reoreation Department for its repent Unity Fair and oommented on the need for unity among those present. Mr. Philip Birkmaier, 5140 Century, inquired about issuance of identifioation badges and was informed whioh City personnel are issued auoh badges. Mr, Hill Anderson, 12013 Harris, inquired which members of the City Counoil oooasionally ride with police officers on duty. Mr. Anderson also expressed the view that there will never be a 1C5 freeway and asked the Council to loin in opposing the freeway. M~. Jerry Rokoa, 12217 Hullis Road, addressed the Counoil to question Counoilman Rowe about his Attorney-Client relationship with the firm o,f Cayer & Johnson, and to ask the Counoil to oonsidar establishing a rule requiring that the City Attorney sit in on all exeoutiva sessions to insure oompllanoe with the law.
