Councilmen Byork, Green, Morris Rowe answered the roll call. Councilman Liewer was absent. Also presented were City Manager Wright and City Attorney Murphy. It was moved by Councilman Green, seconded by Council- man Byork, and carried, that Councilman Liewer's absence be excused. After discussing matters appearing on the agenda for the regular meeting of October 1, 1974, the meeting was adjourned to executive session.for discussion of a matter of litigation. Councilman Liewer arrived. Councilman Byork, Green, Liewer, Morris, Rowe answered the roll call. Also presented were City Attorney Murphy and City Manager Wright. It was moved by Councilman Byork, seconded by Councilman Green, and carried, that the minutes of the adjourned regular meeting of September 17, 1974, regular meeting of September 17, 1974, and adjourned regular meeting of September 24, 1974, be approved as written. COMMENDATIONS Res. of commenda- The Mayor presented a resolution entitled: "A tion - Ralph RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD Herbold COMMENDING RALPH A. HERBOLD FOR HIS CONTINUING CIVIC CONTRIBUTIONS AND SERVICE TO THE COMMUNITY." It was moved by Councilman Byork, seconded by Council- man Morris, and carried, that the resolution be adopted. Proclamation - The Mayor read a proclamation designating the month October PTA mth. of October as "PTA MEMBERSHIP MONTH. " It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the proclamation be authorized. A copy of the proclamation was presented to Mrs. Edith Armstrong, representing the PTA. PUBLIC HEARING Hearing - Cond. The Mayor announced that the time had arrived for Use Permit - public hearing on the application of Dr. and Mrs. 3120 Los Flores Verner Waite, for a conditional use permit to conduct a commercial home in a residential area at 3120 Los Flores Boulevard (Lots 8, 9, 10, Block 20, Modjeska Park Tract). The Manager presented a report on the hearing before the Planning Commission which recommended approval of the conditional use permit subject to conditions set out in Planning Commission Resolution No. 566 and recommended concurrence in the Planning Commissi.on's action. The Mayor inquired if any one present wished to speak in favor of the conditional use permit. There was no response. The Mayor asked if any one present wished to speak in opposition to the conditional use permit. Mr. Vern Iberson, 3119 Los Flores Boulevard, and Mr. Henry Dahl, addressed the Council in opposition to the conditional use permit and objected to a commercial use in a residential area.. *" a. I~~ Mrs. Dahl addressed the Council to question the ownership of the property, stating she understands that Dr. Waite has sold it. In discussing the question raised by Mrs. Dahl, the Planning Secretary informed the Council that he was I~ informed that the property has been sold and is now ~ in escrow but that Dr. Waite wishes to proceed with the conditional use permit. After being informed by the City Attorney, that a conditional use permit runs with the land, it was moved by Councilman Morris, seconded by Council- man Rowe, and carried, that the hearing be continued to November 6, 1974. AWARD OF BIDS A report on bids received for signals, safety lighting and street signs on Atlantic Avenue, Abbott Road to Arlington Avenue, (Gas Tax Project 6-150-180) was presented by the City Manager with the recommendation that the Council award the bid to the low bidder, S. & W. Electrical Contractors, Inc., for the bid price of $103,470. It was moved by Councilman Byork, seconded by Council- man Green, that the Council concur in the recommendation and award the bid to S & W Electrical Contractors, Inc. for the bid price of $103,470. Cassingham Pursuant to a report on the selection of alternate a7_ternate public Public Sector board member for the Southeastern >~ector board Regional Community Action Agency, it was moved by member Councilman Green, seconded by Councilman Morris, and carried, that Assistant City Manager Cassingham be appointed as the City's alternate Public Sector Provisional Board Member of the Joint Powers Southeastern Regional Community Action Agency. :`second community The Manager reported on the second community block. T~l.ock meeting meeting to be held on October 3, 1974, and recommended that the Council consider the request of the Community Stabilization Commission to establish a fund to finance neighborhood block meetings. It was moved. by Councilman Byork, seconded by Councilman Morris, that the City allocate $50 for each of the remaining meetings to be held by the Community Stabilization Commission. The Manager presented a report on acquisition of police pursuit vehicles and recommended that the Council approve specifications No. 5-140-7410 for four police pursuit vehicles and authorize a call for bids at 2:00 p.m. on October 2g, 1974. It was moved by Councilman Morris, seconded by Councilman Byork, that the Council concur in the recommendation. It was moved by Councilman Byork, seconded by Councilman Green, that the specifications be approved except as to the blue color, that the cars remain white. The change in color of the police cars from white to blue was discussed among the Council and the Chief of Police. Roll Call on the amendment: Ayes: Councilmen Byork, Green, Liewer. The Manager reported on acquisition of a 3/4 ton ~"'"` cab and chassis pickup for the water department ~' and a 1 ton cab and chassis for the street department, and recommended that the Council approve specifications for the vehicles, Projects Nos. 2-209-74 and 5-182-749, and authorize a call for bids on October 29, 1974, at x:00 p.m. It was moved by Councilman Green, seconded by Council- man Morris, that the Council concur in the recommendation. ORDINANCES AND RESOLUTIONS ORDINANCE N0. 976 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SUBSECTION (b) OF SECTION 32-49 OF THE CODE OF THE CITY OF LYNWOOD RELATING TO GENERAL METER RATES FOR WATER SERVED THROUGH '~ METERS," was presented for second reading. The Manager stated that due to a typographical error the effective date had been omitted and the date of January 1, 1975, should be included in Section 2. It was moved by Councilman Byork, seconded by Council- man Green, and carried, that the ordinance be read by title only. Code re water rates 152 It was moved by Councilman Green, seconded by Counc:;~e~~- man Byork, that Ordinance Noo 976 be adopted. Councilman Morris stated he would prefer to see some type of negotiation with the major water users wrer~=: the increase in cost might be a progressive one spread over a period of time. Actual.. costs of water per cubic foot were discussed with the Public Works Director. Mr. Fred Richards of Richards Rack Co., 11754 Alameda Street, objected to the increase on the basis of the size of the increase at one time. Mr, Richards explained that improved methods have reduced the amount of water the company is presently using and possible reclamation of water was discussed with the Council. Mr. Jerry Rokos, 12217 Bulbs Road, spoke in favor of the change in water rates. It was moved by Councilman MOrris, seconded by Councilman Rowe, that the motion be amended to provide that the change in water rates be made over a period of four years. Mro Bruce Hagadone, 1.1.300 Annetta Street, addressed the Council concerning the increase in his water bill when a meter was installed at his residence. It was moved by Councilman Liewer, seconded by Councilman Byork, that Resolution No. 7~+-91 be adopted. In discussing the sale of the property, Councilman Morris favored it being offered at public sale and commented on the amount. of revenue accruing to the city as a result of the operations of the former tenant Mobilease Corp or°ation. Mrs. Ida Williams addressed the Council concerning the sale of the property and asked if there was any conflict of interest between Ryan Outdoor Advertising Inc, and those voting for the sale, if the transaction wi1.l be recorded for public inspection and what persons or group would benefit from the sale of the property. COUNCIL AGENDA, Comments re Co~.~ncilman. Green commented on a letter received from Independent Gities Bess Sparlin relative to clean up done at Long Beach conference, Boulevard and. Los Flores Boulevard. Councilman Green welcome party, also commented on the recent meeting of Independent freeway status Cities held in. San Diego when Congressman Del Clawson installed Mayor Liewer as President of the organization. Mayor Liewer announced that the seventy-fifth welcome party would be held on October 24, 1974. He also commented on the appointment of Mr. Dub Gist as the new Chamber Secretary-Manager. The City Manager presented a brief report on the status of the I-:1.05 freeway. Mrs. Lee Waranius, 12410 Long Beach Boulevard, addressed the Council to explain the costs for the first neighborhood block party which the Stabilization Commission held at Washington School. Mrs. Peggy Myers, 5164 Cortland, inquired about a rate increase far trash pickup. She was informed that the increase which has been publicized refers to commercial bins and that residential. pickup rates are not being increased at this time. Mrs. Meyers also asked that it is not necessary to offer the sale of surplus city property at public bid and she was informed that the Government Code does not impose the requirement of competitive bidding for the sale of such property.
