Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. Also present were City Attorney Murphy and City Manager Wright. The Mayor declared the meeting adjourned to executive session for personnel matters. COMMENDATIONS The Mayor read a Lynwood Police Department report Rodney Butler describing the heroic actions of Rodney Butler presented with when he pulled to safety a motorist who was trapped Certificate of in his overturned vehicle and presented to Commendation Mr. Butler a Certificate of Commendationo Recognition was given to members of the Hosier Band Hosier Barad & Dri11 and Drill Team who were present in connection with Team recognized their annual fund-raising for their appearance in the Las Vegas, Nevada, annual E1 Dorado Day Parade on May 21 and 22. AWARD OF BID The City Manager presented a report on bids Bid award - received for the Imperial Highway Roadway Improvement Griffith Co. for project and recommended that the Council award the Imperial Hwy. Road bid for the project to Griffith Company for the bid ~~. price of $67,830.40. MANAGEMENT STUDIES AND REPORTS The request of the Lynwood Unified School District Board of Education for support of Proposition "Z" to be voted on June 8, 1976 was presented by the City Manager. It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the City Council support Proposition "Z." The Mayor asked that a resolution be prepared expressing the Council's support of Proposition "Zo" ~-- A report on plans and specifications for reconstruction and renovation of the ceiling in Community Center Building was presented by the City Manager, with the recommendation that the Council approve the plans and specificationso was moved by Councilman Byork, seconded by Councilman Green, and carried, that the Council concur in the Mana.ger's recommendationso Lynwood Sch. A resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 2843 TO AUTHORIZE A LIMITATION OF THE NUMBER OF APPLICANTS TO BE EXAMINED FOR EMPLOYMENT WITH THE CITY." was presented for second reading. It was moved by Councilman Morris, seconded by Councilman Green, that the resolution be adopted. Rewording of the resolution to provide for review by the City Council and the advisability of in- cluding appeal provisions were discussed and the City Attorney reviewed various alternatives open to the Council in limiting numbers of applicants for City employment. Mrs. Betty Black, 4301 Walnut Avenue, addressed the Council to inquire if the proposed resolution in any way violates Affirmative Action and the City Attorney explained that any action taken would be subject to the City's Affirmative Action policy. The motion was withdrawn and it was moved by Mayor Rowe, seconded by Councilman Higgins, and carried, that the resolution be tabled for further study. Councilman Higgins asked that rewording of the resolution to include right of appeal be provided for consideration. A resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 2843 TO AUTHORIZE THE HIRING OF POLICE AND FIRE DEPARTMENT PERSONNEL THROUGH LATERAL ENTRY." was presented for second reading. Upon recommendation of the City Attorney, the words "if such is deemed necessary by the appointing authority" were inserted following the word "examination" in Line 7 of Section 2, Page 2, and the words "if any is to be given" following the word "examination" in Line '5 of Section 3.5, Page 3. Because of the changes the resolution was again considered for first reading. It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the resolution be read by title only. Res. on T:imitation of Applicants tabled for further study Res. first read Police Fire Dept. Lateral Transfer Prog. ~' In response to Mrs. Caffie Green's inquiry concerning lateral transfers of black police officers, Police Chief Darton stated none have applied for lateral transfer. FINANCIAL REPORT Res. 76-30 Resolution No. 76-30 entitled: "A RESOLUTION OF Demands THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ALLOWING AND ORDERING WARRANTS DRAWN THEREFOR." was presented. It was moved by Councilman Byork, seconded by Councilman Morris, that Resolution No. 76-30 be adopted with the exception of Warrant Nos. 13321, 13327 and 13368. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. Motion to abolish Mayor Rowe commented on the recently-adopted Asst. City Mgr. policy of reducing cost of city government position failed wherever possible and stated that in the interest of economy, he wished to move to abolish the position of Assistant City Manager. The motion was seconded by Councilman Higgins with the effective date to be the end of the fiscal year. Roll Call: Ayes: Councilmen Higgins, Morris, Rowe. Noes: Byork, Green. Absent: None. The Mayor announced that the motion had failed as the action required a four-fifths vote of the Council as provided by the Civil Service Ordinance. Mayor Rowe read a letter from Congressman Yvonne Burke concerning full funding of the Century Freeway. DEPARTMENTAL REPORTS Councilman Higgins made several suggestions concerning plans for the new library ground- breaking and asked the City Manager to call Mr. Harry Marlow of Supervisor Hahn's staff concerning the activity. inspection of Councilman Higgins described his recent state-owned prop. inspection of State-owned properties and asked ~y Councilman for authorization to visit the District iiggins Supervisor of CALTRANS regarding the manner in which the Freeway properties are being maintained. The Mayor suggested that he contact the CALTRANS representatives and report back to the City Council. Vew drinking It was moved by Councilman Morris, seconded by Fountain auth. Councilman Higgins, that the Council authorize purchase of a Sunrock drinking fountain for the Council Chamber foyer and that the existing drinking fountain be moved to the Police Department. It was moved by Councilman Byork, seconded by Councilman Green, and carried, that Information Bulletin No. 76-8 be accepted and filed. It was moved by Councilman Higgins, seconded by Councilman Green, and carried, that Citizens Service Request Log No. 76-5 be accepted and filed. It was moved by Councilman Byork, seconded by Councilman Green, and carried, that Report of Planning Commission Actions be accepted and filed. The Mayor announced that the speaker at the Coordinating Council meeting of May 3, 1976 will feature discussion of the County Assessor's practices and that he ha.d been asked to make the announcement of this worthwhile presentation by Mr. Mel Rice, Coordinating Council First Vice President. Councilman Byork announced that on Saturday, May 24, 1976 at 9:30 a.m. there will be a baseball game between the Lynwood Ministerial Association and members of Lynwood Police and Fire Departments. CITY CLERK'S AGENDA It was moved by Councilman Morris, seconded by Councilman Green, and carried, that the Council approve the request from St. Emydius Church for permission to hold its annual festival on May 1 and 2, 197b. It was moved by Councilman Morris, seconded by Councilman Higgins, and carried, that the claim for damages filed by Mike Sminez be denied and referred to the City's insurance carrier. St . Mrs. Ruffino, 11150 Franklin Avenue, addressed the Council to describe the problems arising from actions of the individual t® whom the petition referso ~-- Mrs. Santia~o,11112 Penn Street, addressed the Council to car~rcborate statements made by Mrs. Ruffino concerning the individual named in the petition. ~R COUNCIL AGENDA Councilman Morris inquired as to what progress has been made in the annual Spring Cleanup and the Public Works Director informed the Council he would have a full report for them at the next Council meeting. Councilman Morris congratulated Mr. Richard Armstrong, new President of the Lynwood Board of Education; and Mr. Ralph Darton, new Vice President, and asked that a letter of congratulations be sent to the School District. Councilman Green commented on the new lighting on Imperial Highway. Councilman Higgins commended St. Francis Hospital staff for their actions during a recent fire. W. Malchow appt'd Councilman Higgins nominated Mr . Wilbert Malchow to Traffic & for appointment to the Traffic and Parking Parking Comm. Commission. Hunt appt'd Councilman Higgins nominated Mr. John Hunt for to Recreation & appointment to the Recreation and Parks Parks Comm. Commission. It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that nominations be closed and the Clerk instructed to cast a unanimous ballot for Mr. John Hunt. HCDAB appts. Morris ~9 PUBLIC BUSINESS FROM THE FLOOR Mr. Bracey., 3231 Flower Street, addressed the Council Mr. Bracey re concerning the problems resulting from the boarded boarded-up dwellir~ up dwellings in his neighborhood. Efforts to have the structures removed were discussed and the City Attorney suggested that Mr. Bracee correspond directly with the Center for Law and the Public j Interest to make them aware of the impact of boarded up homes and structures on residential areas. Mr. Harold Essex, 3660 Cedar Avenue, addressed the Council concerning his neighborhood's Block Watch Program and urged that parking restrictions be enforced in that area. Mr. Essex also complained of dogs running at large in the neighborhood and Councilman Green suggested that he contact the Assistant City Manager for assistance. Mr. Dave Richman, 11106-B Benwell Drive, reported that several fire hydrants on Century Boulevard are leaking water and suggested that the waste be corrected. The Mayor declared the meeting recessed for the purpose of conducting a Lynwood Redevelopment Agency meeting. The meeting was reconvened at 10:30 p.m. Resolution No. 76-31 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD FINDING ~- AND DETERMINING THAT CERTAIN IMPROVEMENTS ARE OF BENEFIT TO LYNWOOD REDEVELOPMENT PROJECT AREA "A" AND APPROVING AN AGREEMENT WITH THE LYNWOOD REDEVELOPMENT AGENCY TO REIMBURSE SAID CITY FOR THE COSTS INCURRED BY IT IN CONNECTION WITH SUCH IMPROVEMENTS."
