Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. Also present were Acting City Manager Shepherd and City Attorney Murphy. The Acting City Manager reported that Michael Huddle, Water Department, has requested a thirty-day leave of absence to recuperate from surgery. It was moved by Councilman Byork, seconded by Councilman Higgins, and carried, that permission for the leave of absence be granted. Councilman Byork read a communication from the Rapid Transit District requesting that the Council take an immediate position for or against the RTD holding-the- line posture. It was moved by Councilman Byork, seconded by Councilman Higgins, that the Council go on record as being in favor of the position taken by the Rapid Transit District. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. The meeting was adjourned to executive session for personnel matters. PUBLIC HEARING .- The Mayor. announced that the time had arrived for a public hearing on the proposed nuisance abatement on property at 4217 Carlin Avenue. The Acting City Manager reported on the recommendations of the Planning Commission. The Mayor inquired if anyone wished to speak in favor of the proposed nuisance abatement. Gerald R. Sanders, Acting Secretary to the Planning Commission, testified as to the extensive deteriora- tion of the structures on the property and advised that the property owner will be given thirty days to abate the nuisance. The City Attorney requested that the seventeen photographs of 4217 Carlin Avenue on exhibit be marked for the City's file. There being no one wishing to speak in opposition to the proposed nuisance abatement, the hearing was closed. It was moved by Councilman Green, seconded by Councilman Morris, that RESOLUTION N0. 76-75 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING CERTAIN BUILDING OR BUILDINGS TO BE A NUISANCE AND DIRECTING THE OWNER TO ABATE IT." be adopted. No. 76-75 Directing Nuisance Abatement The Mayor announced that the time had arrived for a Public Hear3.rng - public hearing to hear arguments for and against a Cond. Use Permit conditional use hermit to operate a retail grocery 10400 Long Beach business and maintain a gas dispensing island at Blvd. 10400 Long Beach Boulevard. The Mayor inquired if anyone wished to speak in favor of the conditional use permit. C~ .,J Gerald R. Sanders advised that the application should be corrected to read three gas pumps, instead of the two originally applied for, to enable the applicant to sell the three types of gasoline. No. 76-76 The Acting City Manager reported on the proposed ~'k~g ~~b• parking restriction on Louise Street, from Bullis guise Street Road to Ernestine Avenue and presented RESOLUTION N0. 76-76 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 67-9 DESIGNATING CERTAIN STREETS WHEREIN PARKING IS PROHIBITED AT CERTAIN TIMES." It was moved by Councilman Higgins, seconded by Councilman Green, that the resolution be adopted. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. No. 76-77 The Acting City Manager reported on the Personnel rnployees' Board's recommendation that the Public Works teak Time Department Personnel Manual be amended to prohibit public works employees at a fob site to return to the City Yard for break time and presented RESOLUTION N0. 76-77 entitled: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, AMENDING THE PUBLIC WORKS DEPARTMENT PERSONNEL MANUAL RELATING TO BREAK TIME." (,i 157 The Acting City Manager reported on the Personnel Board's recommendation to amend Section 2 of Rule XI, Attendance and Rules, of the Personnel Rules and Regulations pertaining to sick leave and presented a resolution entitled: "A RESOLUTI~}N OF THE CITY COUNCIL ~~F THE CITY OF LYNWOOD, CALIFORNIA, AMENDING SECTION 2 OF RULE XI, ATTENDANCE AND RULES, OF THE PERSONNEL RULES AND REGULATIONS PERTAINING TO SICK LEAVE." It was moved by Councilman Green, seconded by Councilman Byork, that the resolution be introduced. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. The Acting City Manager reported on the Personnel Board's recommendation that notification be required at least three days in advance of a floating holiday. The Acting City Manager reported on the Personnel Board's recommendation limiting the number of hours an hourly employee may work and present a resolution entitled: "A RESOLUTIpN OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, AMENDING SECTION 23 OF THE PERSONNEL RULES AND REGULATIONS PERTAINING TO HOURLY EMPLOYEES." Tt was moved by Councilman Higgins, seconded by Councilman Green, that the resolution be introduced. Donald Snavely, Director of Parks and Recreation, addressed the Council to explain the effect of the resolution on the Recreation Department. He explained that many hourly employees work more than 20 hours per week, that hourly summer employees work more than 40 hours per week on a seasonal basis and that at the present time, there is only one hourly employee who works more than 40 hours per week, thus qualifying for benefits. Mr. Snavely suggested that an hourly employee be defined as one who works less than 35 hours per week, in order that the Recreation Department may have a flexibility of scheduling. Councilman Green withdrew his second. It was moved by Councilman Higgins, seconded by Mayor Rowe, to amend the motion to change the language of Section 23, Page 2 of the resolution, to read: "Section 23. Hourly Employees. Employees paid on hourly basis where necessary because of the nature of the work. No hourly person, temporary help, or seasonal help shall work 35 or more hours in any week, nor more than 1,000 hours in any year, and that no allowance be made for overtime work. Hourly employees have no civil service status, vacation, sick leave or holiday privileges." It was moved by Councilman Green that the amendment be referred to the Recreation Commission for recommendations before any action is taken. The motion died for lack of a second. Hanley re requested Council consideration of an alternative State Street plan for the widening of State Street . The widening Council advised Mr. Hanley that the plans are tentative and that a public hearing will be held in late October or early November. Mr. William Cunningham, 11821 Cirnish Avenue, W.- Cunningham re addressed the Council to complain of trash and corner Imperial & shopping carts at the corner of Imperial High- Cornish way and Cornish Avenue. He requested that action be taken to remedy the problem.
