ADJOURNED REGULAR MEETING JANUARY 4, 1977
The City Council of the City of Lynwood met in an adjourned
regular session in the City Hall, 11330 Bullis Road, on
above date at 7 p.m.
Mayor Rowe in the chair.
Councilmen Byork, Green, Higgins, Morris and Rowe
answered the roll call. ...,~

Also present were City Attorney Murphy and City Manager
Valliere.
It was moved by Councilman Byork, seconded by Councilman
Morris, and carried, that the meeting adjourn to executive
session for discussion of matters pertaining to personnel
and litigation.
Following the executive session, the meeting was adjourned.

REGULAR MEETING JANUARY 4. 1977
The City Council of the City of Lynwood met in a regular
session in the City Hall, 11330 Bullis Road, on above
date at 7:30 p.m.
Mayor Rowe in the chair,
Councilmen Byork, Green, Higgins, Morris and Rowe answered
the roll call.
Also present were City Attorney Murphy and City Manager
Valliere.
It was moved by Councilman Byork, seconded by Councilman
Green, and carried, that the minutes of the adjourned
regular meeting of December 21, 1976 and the regular
meeting of December 21, 1976 be approved as written.
PUBLIC HEARING
The Mayor announced that the time had arrived for a
public hearing to ascertain whether a nuisance is being
maintained on Lot 50, Tract 9235, commonly known as
4133 Josephine Street, Lynwood, and inquired if anyone
present wished to speak. The City Manager presented a
report reviewing the actions taken by the Building
Department in attempting to have removed from the
subject premises the accumulation of inoperative
vehicles and other material stored on the property.

Mr. Gerald Sanders, Building Official, was administered

' the oath for testimony before the City Council.
~, Mr. Sanders identified the property and described the
conditions which he believed constitute a nuisance.
He testified that the photographs on display accurately
describe and depict the condition of the-premises and,
in his professional opinion, they constitute a nuisance
within the meaning of the Lynwood City Code. He
further testified that the conditions on the property
have not changed substantially since the photographs
were taken on December 10, 1976. The Mayor inquired
if anyone wished to speak in favor of the abatement.
There was no response. The Mayor inquired if anyone
wished to speak in opposition to the proposed
abatement. There was no response.

~:ANAGEMENT STUDIES AND REPORTS
The request of C & J Sales Company for rerental of
State-owned property at Josephine and Wright Road, held
over from the previous meeting, was again discussed
with the owner of C & J Sales Company, Mr. V~, A. Bikov.
It was moved by Councilman Green, seconded by
Councilman Higgins, that the request be granted subject
to compliance with applicable City Code ordinances.
The second was subsequently withdrawn.
Rerental req. After further discussion of the intent of the
C & J Sales ordinance requiring a "solid architectural barrier"
app'd as it pertains to outside storage, the City Attorney
informed the City Council that it could approve the
rerental request subject to compliance with the
relevant law. It was moved by Councilman Morris,
seconded by Councilman Green, that rerental of the
property be approved subject to compliance with all
applicable Codes.

Tree removal A report on the request of Mrs . Lee Doyle,
5506 Pelleur 5506 Pelleur Street, for removal of a parkway tree
St. auth. in front of her residence was presented by the City
Manager. Mrs. Doyle was present and addressed the
Council concerning removal of the tree. It was
moved by Councilman Green, seconded by Councilman
Higgins, and carried, that the tree be removed
within 30 days.
Ord.first read In order to implement the change in the speed limit
Increase in on a portion of Atlantic Avenue, approved by the
speed limit City Council on December 21, 1976, the City Manager
presented an Ordinance entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING
SECTION 19-64 OF THE CODE OF THE CITY OF LYNWOOD
RELATING TO SPEED LIMITS ON CERTAIN DESIGNATED
STREETS." It was moved by Councilman Higgins,
seconded by Councilman Green, that the ordinance
be read by title only. As there were no objections,
the Mayor declared the motion carried<
It was moved by Councilman Higgins, seconded by
Councilman Morris, that the ordinance be introduced.

RESOLUTION
RESOLUTION N0. 77-2 entitled: "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF LYNWOOD RELATING TO THE
DESTRUCTION OF RECORDS." was presented. It was
moved by Councilman Higgins, seconded by Councilman
Green, that Resolution No. 77-2 be adopted.

Noes: None.

RESOLUTION N0. 77-3 entitled: "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF LYNWOOD DESIGNATING THE
CITY MANAGER AS MUNICIPAL EMPLOYEE RELATIONS
OFFICER." was presented. It was moved by Councilman
Byork, seconded by Councilman Morris, that Resolution
No. 77-3 be adopted.

RESOLUTION N0. 77-4 entitled: "RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND
.9.PPROVING THE DEMANDS PRESENTED AND ORDERING
WARRANTS DRAWN THEREFOR." was presented. Councilman
Higgins questioned the quarterly payment to the
Chamber of Commerce and asked if it could not be paid
on a monthly basis. Mr. Harry Johnston, President
of the Chamber of Commerce, addressed the Council
to explain the need for the money at this time. It
was moved by Councilman Morris, seconded by
Councilman Green, that Resolution No. 77-4 be
adopted.
It was moved by Councilman Rowe, seconded by
Councilman Higgins, that the payment to the Chamber
of Commerce be deleted until such time as the
Chamber representatives can meet with the City
Manager. Councilman Higgins subsequently removed
his second to the amendment.

It was moved by Councilman Higgins, seconded by Hemodialysis
Councilman Byork, that the Council grant the request Fdn. fund
of the Hemodialysis Foundation for renewal of a drive app'd

It was moved by Councilman Higgins, seconded by
Councilman Byork, and carried, that the Council
approve the request for renewal of the business
license exemption for the collection of salvage
materials by the following organizations:
St. Vincent de Paul Society, Deseret Industries,
The Rescue Army and Goodwill Industries.
Claim rejected- It was moved by Councilman Morris, seconded by
Mrs. B. James Councilman Byork, and carried, that the Council
reject the claim of Mrs. B. James and that the
claimant be notified that the claim failed to
comply substantially with the requirements of
Government Code Section 910.
Claim denied- It was moved by Councilman Byork, seconded by
Mrs. B. Crump Councilman Morris, and carried, that the claim
for damages filed on behalf of Mrs> Bessie Crump
be denied and referred to the City's insurance
carrier.
Recess The Mayor declared a recess at 8:30 p.m. and
the meeting was reconvened at 8:45 p.m.
COUNCIL AGENDA
Councilman Councilman Morris, requested that the City
Morris req.for Manager arrange for a study session concerning
study session the Lynwood Redevelopment Prod ect and it was
on LRA Project agreed that such a meeting would be held on
Monday, January 10, 1977 at 7 p.m.
Petition re It was moved by Councilman Green, seconded by
Sheriff's sere. Councilman Higgins, and carried, that the
accepted and petition concerning contracting with the County
filed for Sheriff's service presented to the individual
Councilmen prior to December 21, 1976 be accepted
and filed.
Councilman Green asked for an explanation of a
check for $40,694 which appeared on the
December 21, 1976 warrant register. The City
Manager explained that the charge was for auto
fleet insurance which has been written by a new
company and that premium refund from the former
carrier has been received. Councilman Green's
motion to declare the City's present broker no
longer the broker of record failed for lack of
a second. The City Manager informed the Council
that various insurance alternatives will be
presented upon renewal of coverage.
Councilman Councilman Green also asked that the warrant
Green req. for register be furnished to the City Council on
warrant regis. the Friday preceding the Council meetings .
Progress Rpt. on Upon request of Councilman Byork, Safety Coor-
Safety Prog. by dinator Michael Taft presented a progress report
M. Taft on the intensive safety program commenced in
September, 1976.

Councilman Higgins requested authorization to represent Coun. Higgins
the City at the Emergency Preparedness Commission to attend
Seminar for counties and cities to be held in Emergency
Los Angeles on February 9, 1977. There were no Preparedness
objections to Councilman Higgins attending the seminar. Seminar 2/9/77
Mayor Rowe commented on the petition concerning
._. Sheriff's services and stated that as of this date,
there is no basis for discussion as no proposal has
been submitted for the Council's consideration.

Mrs . Kathy Proctor, 11862 Duncan Avenue, addressed the K. Proctor re
Council in opposition to Sherriff's services and Sheriff's serv.
submitted a petition containing signatures of people
who do not want police services Furnished by the
Sheriff's Department.
Mrsa Peggy Myers, 5164 Century Boulevard, addressed
the Council in opposition to contracting with the
Sheriff's Department.
Mr. Gerald Wise, Lugo Avenue; Mr. Ed Thomas, 10761
E1~t~ Avenue; Mrs. Helen Pearce, Long Beach Boulevard;
Mrs Joy Louise Feryanitz, 10850 Alexander Avenue;
Mrs. Gladys Brooks, 11201 Harris Avenue; Mr. Kenneth
Betzer, 11820 Duncan Avenue; Mr. Herb Myers, 5164
Century Boulevard, all addressed the Council in
opposition to Sheriff's services.
Mrs. Sandra Sibley, 12002 Gertrude Drive, spoke in
favor of contracting with the Sheriff's Department
based on the cost to the City.
Mr. Leo Young, Manager of the Montgomery Ward store,
commended the local Police Department and urged that
careful consideration be given to the problem before
action is taken.

Mr. Ed Thomas again addressed the Council to ask that E. Thomas re
the City reconsider negotiations with the Lynwood nego. with
Police Officers and the City Attorney advised that Peace Off~.cers
since there is litigation pending, such a discussion
would be inappropriate.
Pastor Gray of the Lynton Village Church, 3945 Carlin
Avenue, informed the Council that one of the two trees
they were required to plant under the conditions of a
variance had been cut down by vandals and asked whose
responsibility it is to replace it. He also asked
that something be done about the north side of Carlin
Avenue between Atlantic and Harris Avenues where
trees and overgrowth require that the school children
walk in the street. Councilman Morris suggested that
it be investigated to see what can be done to correct
the problem.
