Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. ... Also present were City Attorney Murphy and City Manager Valliere. At the request of the City Attorney, it was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the meeting adjourn to executive session for matters of litigation. Councilmen Byork, Green,. Higgins, Morris and Rowe answered the roll call. Also present were City Attorney Murphy and City Manager Valliere. It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the minutes of the adjourned regular meeting of February 1, 1977 and the regular meeting of February 1, 1977 be approved as written. The Mayor stated that the Sheriff's Report on law Sheriff's enforcement services was received on February 10, 1977 and Rept. recd. unless notified to do otherwise, the Sheriff will proceed 2/10/77 no further. Councilman Byork suggested that the matter be tabled and Discussion of taken up at a later add ourned meeting in Bateman Hall; Sheriff's that the Sheriff's representatives be invited to attend services as well as all interested citizens to participate in the scheduled for discussion. The Mayor recommended that at the close of 2/16/77 in the meeting, it be adjourned to Wednesday, February 16, Bateman Hall 1977, in Bateman Hall for a meeting devoted exclusively to discussion of the Sheriff's services. _.. Mrs. Helen Pearce, representing "Citizens Against Sheriffs" addressed the Council to invite them to a meeting to be held on Wednesday, February 23, 1977 in Bateman Hall. Councilman Higgins reported on the recent Central Basin Coun.Higgins' Water District meeting, problems of water shortages, and Rept. on the need to respond to Governor Brown's recent action Central Basin regarding reduction of water usage. He informed the Water Dist. Council that the Governor has requested that information meeting be sent by 10 p.m. February 17, 1977 as to what water conservation measures will be undertaken by the City. It was moved by Councilman Higgins, seconded by Councilman Morris, that the City, in the interest of water conservation, pursue the water-metering program as outlined by the Lynwood City Code. PROCLAMATIONS The Mayor read a proclamation designating the week of "Junior ,.,,, February 19 through 26 as "Junior Catholic Daughters Catholic , of America Week." It was moved by Councilman Higgins, Dgtrs.of seconded by Councilman Morris, and carried, that the America Wk." proclamation be authorized. Members of the organization 2/19 - 2/26 were present to receive a copy of the proclamation. n "Feather Day" The Mayor read a proclamation designating February 25 2/25 & 2/26 and 26 as Southwest Indian Scouts "Feather Day." It was moved by Councilman Morris, seconded by Councilman Higgins, and carried, that the proclama- tion be authorized-. A copy of the proclamation was presented to a member of the organization. MANAGEMENT STUDIES AND REPORTS Res.No. 77-17 The City Manager reported that negotiations had been Long Bch.Blvda completed for acquisition of Parcel No, 30 for the acquis. autho Long Beach Boulevard Widening Project, Phase III, (portion of Lot 8, Tract 2794, Mabel Craft). He recommended that acquisition be authorized by adoption of RESOLUTION N0. 77-17 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING PURCHASE OF PROPERTY NECESSARY FOR THE WIDENING AND IMPROVEMENT OF LONG BEACH BOULEVARD." It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the resolution be adopted. Res.Noo '77-18 A report on the recommendation of the Traffic and Parking prohib. Parking Commission that a 60-foot passenger load- at passenger ing zone be installed ad,j acent to the Child Day loading zone Care Center at 2950 Industry Way, was presented by the City Manager with the recommendation that the installation be authorized by adoption of RESOLUTION N0. 77-18 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 67-9 WHEREIN PARKING IS PROHIBITED AT ALL TIMES IN A PASSENGER LOADING ZONE." It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that Resolution No. 77-18 be adopted. Tree removal A report on the necessity for removing trees at auth. - 11324, 12146 Louise Avenue and 11324 and 11341 Cornish 11341 Cornish 8~ Avenue was presented by the City Manager with 12146 Louise the recommendation that the removal be authorized, It was moved by Councilman Morris, seconded by Councilman Byork, and carried, that the Council concur in the recommendation. Bid call autho A request for authorization to invite bids for for flooring in installation of a new floor in the Community Coiranunity Ctr. Center gymnasium was presented. The project was gymnasium previously approved for funding in the 1976-77 fiscal year under the Housing and Community Development Act program. After discussing the type of flooring available, it was moved by Councilman Higgins, seconded by Councilman Green, and carried, that the request for bids be authorized. ~~~ ORDINANCE AND RESOLUTION The City Manager presented a report on an amendment of the Lynwood City Code to provide fora 50~ delinquent dog license penalty fee and recommended that an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADDING SUBSECTION (c) TO SECTION 5-39 OF THE CODE OF THE CITY OF LYNWOOD PERTAINTNG TO DOG LICENSE FEES." be introduced. It was moved by Councilman Byork, seconded by Councilman Higgins, that the ordinance be introduced. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. A report on State legislation which permits the use of public funds for removal of graffiti from public and privately-owned structures under certain conditions was presented by the City Manager with the recommenda- tion that an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADDING ARTICLE V (COMMENCING WITH SECTION 8-81) TO CHAPTER 8 OF THE LYNWOOD CITY CODE AUTHORIZING THE EXPENDITURE TO ELIMINATE GRAFFITI." be introduced. It was moved by Councilman Byork, seconded by Councilman Green, that the al~ut7a.nce be read by title only. As there were no object:iUns, the Mayor declared the motion carried. It was moved by Councilman Higgins, seconded by Councilman Green, that the ordinance be introduced. Implementation of the graffiti removal program under !~-- the provisions of the proposed ordinance was discussed with the City Attorney. Fire Chief Johnson exhibited slides depicting some of the graffiti photographed in a recent survey. Rev. Charles Floyd commented on the display of graffiti on his church and Mr. James Moss, 11024 Duncan Avenue, took exception to identification of the gang symbols shown in the pictures. Mr, Ed Chavarria, 4527 Carlin Avenue, commented on meetings he has attended at which a Police representative has been present for discussions aimed at elimination of graffiti by the youth gangs. A report on recent State legislation which permits local agencies to establish at 90-day statute of limitations for seeking review of administrative decisions pursuant to Section 1094.5 of the State Code of Civil Procedure was presented by the City Manager. FINANCIAL REPORT Res.No. 77-20 RESOLUTION N0. 77-20 entitled: "RESOLUTION OF THE Demands CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR." was presented. CITY CLERK'S AGENDA Purple Heart It was moved by Councilman Higgins, seconded by Veterans exempt Councilman Morris, and carried, that the Council business lic. grant the request from the Purple Heart Veterans aPP'd for renewal of their exempt business license for salvage collection. Claim denied - It was moved by Councilman Byork, seconded by P.Goldsmith Councilmen Higgins, and carried, that the claim for damages filed on behalf of Phyllis Goldsmith be denied and referred to the City's insurance carrier. Claim denied - It was moved by Councilman Byork, seconded by A.Frl~uckic Councilman Morris, and carried, that the claim for damages filed on behalf of Adzura Frl~uckic be denied and referred to the City's insurance carrier. COUNCIL AGENDA Purchase of After a brief discussion of the Council Chamber microphone sound system, it was moved by Councilman Higgins, stands auth. seconded by Councilman Morris, that the expenditure of $130.95 be authorized for the purchase of "gooseneck" type microphone stands. County Fire Councilman Higgins noted that no formal action Protection Dist. had been taken relative to the proposal submitted Proposal not to the City by the County Fire Protection District acceptable to and moved that the proposal submitted be found to City be not acceptable to the City Council of the City of Lynwood. L Councilman Byork commented on the block-watch program on his block and asked if it would be feasible to put up signs indicating that a block-watch program is in actiono The City Manager said he would have a report on an appropriate sign and the cost at the next meetingo ~.-• Councilman Green questioned comments made by the City's auditors in their most recent audit report concerning use of federal anti-recessionary funds. Use of the funds was explained by the City Manager. It was moved by Councilman Green, seconded by Councilman Byork, that the matter of contracting with the County Sheriff for law enforcement services be put to a vote of the people immediately. After discussion with the City Attorney, 3.t was determined that the next date in which a special election could be held would be May 31, 1977. Roll Call: Ayeso Councilmen Byork, Green.
