HomeMy Public PortalAboutM 1977-03-01 - CC~~ ADJOURNED REGULAR MEETING MARCH 1, 1977 The City Council of the City of Lynwood met in an adjourned regular session in the City Hall, 11330 Bullis Road, on above date at 7 p.m. Mayor Rowe in the chair. Councilmen Byork, Green, Higgins, Morris, Rowe answered the roll call. Also present were City Attorney Murphy and City Manager Valliere. The City Attorney reported to the City Council that the League of California Cities has authorized an amicus curiae brief in a case involving the legality of at-large elections in general law cities. It was moved by Councilman Higgins, seconded by Councilman Byork, and carried, that the name of the City of Lynwood be allowed to be used as one of the parties of the brief. Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. Also present were City Attorney Murphy and City. Manager Valliere. It was moved by Councilman Morris, seconded by Councilman Byork, and carried, that the minutes of the ad,~ourned regular meeting of February 15, 1977 and the regular meeting of February 15, 1977 be approved as written. AWARD OF BID A report on bids received for installation of a boiler in the Natatorium (Project No. 5-19-764) was presented by the City Manager with the recommendation that the Council accept the bid of Spencer Boiler and Engineering, Inc., the low bidder, in the amount of $7,166.01. It was moved by Councilman Morris, seconded by Councilman Green, that the Council concur in the recommendation and award the bid to Spencer Boiler and Engineering, Inc. at the bid price of $7,166.01. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. MANAGEMENT STUDIES AND REPORTS The City Manager presented a report on the proposed lease of 220 acre-feet of water from Citrus Grove Heights Water Company at $28 per acre-foot, and recom- mended that the Council approve the Water Right Lease and Agreement and authorize its execution by the Mayor. It was moved by Councilman Higgins, seconded by Councilman Morris, that the Council concur in the recommendation. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. ORDINANCES ORDINANCE N0. 1013 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CLTY OF LYNWOOD ADDING SUBSECTION (c) TO SECTION 5-39 OF THE CODE OF THE CITY OF LYNWOOD *-- PERTAINING TO DOG LICENSE FEES." was presented for second reading. It was moved by Councilman Higgins, seconded by Councilman Morris, that the ordinance be read by title only. As there were no objections, the Mayor declared the motion carried. Bid award- Natatorium boiler to Spencer Boiler & Eng., Inc. Water lease from Citrus Grove Hgts. Water Co. app'd Ord.No. 1013 pertaining to dog lic. fees ~ ~ `~ ~~-~ Lt was moved by Councilman Green, seconded by Councilman Morris, that Ordinance No. 1013 be adopted. It was moved by Councilman Byork, seconded by Councilman Green, that the ordinance be read by title only. As there were no objections, the Mayor declared the motion carried. FINANCIAL REPORT Res.No. 77-21 RESOLUTION N0. 77-21 entitled: "RESOLUTION OF THE Demands CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR." was presented. It was moved by Councilman Higgins, seconded by Councilman Green, that Resolution No. 77-21 be adopted with the under- standing that there is an additional warrant in the amount of $419 payable to the U. S. Post Office. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe, Noes: None, Absent: None. CITY CLERK'S AGENDA Amer.Cancer It was moved by Councilman Byork, seconded by Soc. Fund Councilman Higgins, and carried, that the Council campaign app'd approve the request from the American Cancer Society for permission to conduct its annual fund campaign during April, 1977. Pop Warner fund It was moved by Councilman Byork, seconded by solicitation Councilman Green, and carried, that the Council app'd approve the request from the Pop Warner Association for permission to solicit funds. Claim denied - It was moved by Councilman Byork, seconded by BaJ. Bell Councilman Green, and carried, that the Council deny the claim for damages filed by Benjamin J. Be11 and refer the claim to the City's insurance carrier. -~l.!~ cat ~ .'~ COUNCIL AGENDA Councilman Byork gave a report on the status of the Coun. Byork to I-105 Freeway and suggested that if the Council desires, attend SCAG he and the City Manager might attend a SCAG meeting to rr~=sting be held at Pasadena and suggested there might be a need to go to Sacramento in an effort to get action on the ~-- freeway. It was moved by Councilman Higgins, seconded ' by Councilman Morris, that Councilman Byork be authorized to attend. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. Councilman Byork expressed to the Chief of Police his Coun. Byork re opinion that police officers should question children. children on they see on the street during school hours as to why streets they are not in school and why they are on the street if they are observed after the curfew hour. Mayor Rowe commented on the request from County Mayor Rowe to Supervisor Hahn that the City support the County attend L. A. Sanitation District's proposal to use the Mission City Council Canyon Landfill and stated that he would be present at ME:eting 3/3/77 the Las Angeles City Council meeting on March 3, 1977 when the matter will be considered. Councilman Morris asked the City Attorney the legality Sheriff's services of providing the taxpayers of the community with info. to be mailed information pertaining to the Sheriff's services by in water bills means of a mailing in the water bills. The City '~ Attorney informed the Council that the- courts have held it is not appropriate to spend public funds to - influence one side or another of the question but funds can be spent to inform concerning the affairs of the City. After a lengthy discussion of the propriety of such a mailing, it was moved by Mayor Rowe, seconded by Councilman Morris, that information be sent to the people based solely on the data on hand from the Sheriff and City costs. Councilman Morris stated that he would like to have the City Attorney review the statement to determine if there were any political aspects to it. It was moved by Councilman Higgins, seconded by Councilman Morris, that the motion be amended to provide that the statement be reviewed by the City Council before it is mailed. Green re a statement made by Councilman Higgins concerning gas gas tax funds tax funds and to provide members of the Council with a full report on handling of funds, ~r+~. . ~~~ PUBLIC BUSINESS FROM THE FLOOR Dr. Edney re Sheriff's Dr. James Edney addressed the Council to inquire if services info the statement concerning Sheriff's services will . contain all the ramifications of the proposal and what proof would there be that the report will be truthful. H. Pearce re Sheriff's Mrs < Helen Pearce, 11500 Long Beach Boulevard, ... serv. addressed the Council to inquire if a referendum would stop the action on the Sheriff's services and made reference to appearing in a Long Beach court in an attempt to obtain a temporary restrain- ing order. Councilman Higgins made a brief state- ment urging that more positive attitudes be taken toward the City's problems and that negative attitudes be put aside for the betterment of the community. C. Waranius re 1972 election Mr. Cass Waranius, 12416 Long Beach Boulevard, addressed the Council to read a political ad concerning the 1872 municipal election. T. Rauzan re availability of Mrs . Thelma Rauzan, 3970 Shirley Avenue, addressed information the Council to describe an incident involving her daughter and asked if the City contracts with the Sheriff, would citizens have to go into Los Angeles for reports and other information. After discussing the question with Lt. John Hammergren, Mrs, Rauzan was assured that all reports generated at the station would be maintained at the station and it would not be necessary to go to Los Angeles. ... In response to a question from Councilman Higgins, Lt. Hammergren explained that in unincorporated areas of the County, the California Highway Patrol is responsible for traffic enforcement and their reports are maintained centrally. Coun. Green re disposition of Councilman Green inquired what disposition was stolen bicycles made of stolen bicycles and Lt . Hammergren stated that if the owners can be ascertained, they are returned; otherwise, they are donated for TOYS FOR TOTS. E, Thomas re Mr. Ed Thomas discussed with Lt. Hammergren how recovered long and where recovered property is kept, how property complaints are handled and questioned the City Manager about "carry over" costs of contracting with the Sheriff. P.
